Minutes of the regular council meeting held in the city municipal building
June 27, 1978. Meeting called to oPder at 8:00 p.m. by Mayor Cotant.
Present: Mayor John O. Cotant, Jr., Councilmen Boyd L. Fullmer, Dwain A.
Kinghorn and Earl L. Romriell. Engineer Steven M. Smart and City Clerk
Vera C. Armstrong. Councilman LeRoy S. Quick and Attorney Donald L.
Burnett, Jr. excused.
Mayor Cotant asked for any corrections or additions to minutes of May 23,
June 6 and June 13.
Councilman Romriell moved to approve minutes of May 23, June 6 and June 13
as written, Councilman Fullmer seconded motion with an unanimous
vote in favor.
FIREWORKS PERMITS - The following three fireworks permit applications have
been submitted to the city office for approval; l) Galaxie Company
2) Chubbuck Jaycees 3) Denny Jones.
After reviewing the requirements in Ordinance #180, Councilman Romriell
moved to approve the permits subject to complete compliance with the
Fireworks Ordinance #180, inspection of stands and contents by the
Fire Chief and approval of mayor after the fire chief has inspected.
Councilman Kinghorn seconded motion. Voting was unanimous in favor of
motion.
MOUNTAIN PARK SUBDIVISION FINAL PLAT - Developers Mark Bunce and John Alder
presented their final plat.
Proposed plans show curb, gutter, and sidewalk from the subdivision
boundary to the bridge being constructed over Hiline Canal and 30 ft.
of paved street from the centerline of the canal bridge to Hiline Road.
The possibility of the Mountain Park Subdivision sewer being served by
entering Pocatello sewer lines, was discussed.
Mr. Alder informed council they plan to install the sewer line to the
lots bordering Chateau Street and requested council put in water services
so the street will not be dug up again.
A discussion followed concerning the manner in which to handle the reserve
strip.
Councilman Romriell moved to approve the final plat of the Mountain Park
Subdivision as presented with the following reserve strip requirements
on Chateau Street; the developer making the dedication of the street may
reserve a strip not less than one foot in width parallel to the street or
easement, between the street or easement and the undeveloped lands; provided,
however, that said developer must execute and deliver to the City an
instrument binding him, his successors or assigns, to convey the reserved
strip to the owner (s) for a stated monetary consideration, fixed by the
City, consisting of the fair value at that time of the strip itself and
the reasonably apportioned value of improvements properly chargeable to
the adjoining lands, and interest at the legal rate for contract obligations~
and subject to approval of the city attorney as pertains to the storm
drainage easement agreement. Councilman Fullmer seconded motion. All
councilmen voted in favor of motion.
ORDINANCE #189 - The Rezoning of Mountain Park Subdivision from Agricultural
to Single Family Residential (R-l) and Multiple Family Residential (R-3)
as described in ordinance was read in full by Mayor Cotant.
Councilman Fullmer made motion to dispense with rule of reading ordinance
on three separate days. Councilman Kinghorn seconded motion, Roll call
vote: Fullmer, yes; Kinghorn, yes; Romriell, yes.
Councilman Kinghorn made motion to approve Ordinance #189, rezoning of the
Mountain Park Subdivision. Councilman Fullmer seconded motion. Roll
call vote: Fullmer, yes; Kinghorn, yes; Romriell, yes.
ORDINANCE # 190 ~ Expressing an intent to sell certain described parcels of
real property owned by the city was read in full by Mayor Cotant and
considered as first reading of ordinance.
GENERAL DISCUSSIONS:
1. Councilman Romriell requested Engineer Smart to write a letter to
Mrs. Harris, Tree Valley Rd. in regards to city water service line.
2. Mayor Cotant asked Engineer Smart to check subdivision ordinance
requirements in regards to subdividing of property bordering Tree
Valley Rd., and notify owners by letter of the requirement.
3. Liquidated damages in regards to water tank construction.
4. False Arrest Insurance proposal from Wolfestone, Donnelly Co. -
Councilman Fullmer stated he had reviewed the coverage and premium
and find the coverage and premium to be in line.
5. Report on Litle League Baseball program by Councilman Fullmer.
Councilman Fullmer suggested paying a baseball commissioner for
all the work involved in the organizing and managing of the program.
6. Councilman Kinghorn presented a title report on the Farrell Poole
property. Engineer Steve Smart to get the title report to Attorney
Burnett.

Councilman Fullmer moved and Romriell seconded with all councilmen approving,
that meeting adjourn at 10:30 p.m.
