Minutes of a public hearing held by the city council May 16, 1978
in the city municipal building.
Meeting called to order at 8:18 p.m.
Present: Mayor John O. Cotant, Jr., Councilmen Boyd L. Fullmer,
Dwaih A. Kinghorn, LeRoy S. Quick and Earl L. Romriell, Attorney
Donald L. Burnett, Engineer Steven M. Smart and City Clerk Vera
C. Armstrong.
This public hearing is a continued hearing being held on the following
items:
1. Adoption of a comprehensive plan for the City, as required by the
Idaho Local Planning Act of 1975. Such a plan has been prepared,
and the Chubbuck Planning and Zoning Commission has recommended
that it be adopted, with certain amendments.
2. Ratification of the establishment, by earlier ordinance, of an
"area of city impact" also required by the Idaho Local Planning
Act of 1975. Such ratification has been recommended by the
Chubbuck Planning and Zoning Commission.
A motion with several amendments was made May 23 and tabled for vote
until further public notice was given.
Mayor Cotant asked for any further discussion in regards to the
substitute motion made May 23, 1978.
Mayor and council disucssed the zoning in the Comprehensive Plan map
concerning the area along the north side of West Chubbuck Road from
Lish Road to Hawthorne Road. The question arose as to how deep the
commercial zone should be in this particular area.
A long discussion followed concerning this zoning question and it was
decided that no further changes would be made to the comprehensive plan
map.
Attorney Burnett read the motion as substituted in the May 23 minutes
in its entirety.
Attorney Burnett advised Mayor Cotant to call for votes in sequence
because of the disclosures on potential conflict of interests.
Mayor Cotant asked for a vote on all aspects of the motion except
those aspects as to which there had been any disclosure of potential
conflict of interest by any person. Voting was unanimous by all
councilmen.
Then the Mayor asked for a vote as to those aspects of the motion
which pertain to the subject matter of disclosures made by Councilman
Romriell and Councilman Kinghorn. Voting was unanimous among those
boting on that aspect of motion. Councilman Romriell and Councilman
Kinghorn abstained from voting.

Mayor Cotant deemed himself disqualified to call for any further
vote or otherwise participate on the remainding aspects of the
motion due to his disclosure of potential conflict.
Accordingly, Councilman Romriell, duly elected President of Council,
called for a vote on those aspects of the motion. The voting was
unanimous among those voting.
Motion having been voted on in it's entirety, the Mayor resumed the
chair and placed before the city council Resolution #3-78, providing
for adoption of the Comprehensive Plan. Resolution #3-78 was read
in full by Mayor Cotant.
Councilman Kinghorn moved to adopt Resolution #3-78 which encompasses
the adoption of the Comprehensive Plan. Councilman Quick seconded
the motion. Roll call vote: Fullmer, yes; Kinghorn, yes; Romriell,
yes; Quick, yes.
Mayor Cotant declared the public hearing closed on the comprehensive
plan.
Mayor Cotant called the hearing resumed on the area of city impact.
Mayor Cotant asked for any further discussions in regards to ratification
of the enactment of an earlier ordinance establishing an area of city
impact.
Engineer Smart informed mayor and council he had contacted the
county in regards to this hearing on the area of city impact.
Councilman Romriell moved to ratify the earlier enactment of Ordinance
#177, establishing an area of city impact, co-extensive with the
area so defined in the Comprehensive Plan. Councilman Fullmer seconded
motion with the voting unanimous in favor.
Mayor Cotant declared the public hearing closed on the ratification
of the enactment of Ordinance #177, establishing an area of city
impact.
REQUEST FOR AREA TO PARK CAMPERS AND TRAILERS during the republican
convention, headquartered at the Ramada Inn. Mr. T.V. Hanks, 143
Parrish Drive requested from the city some help in providing an
area for these larger type vehicles to park.
Mayor Cotant told Mr. Hanks the city engineer would look into the
possibility of using the Geisler property for this parking and
if necessary the city will clean off their property at 4545 Yellowstone
for this use.
A.I.C. CONFERENCE in Sun Valley - Mayor Cotant asked the councilmen of
their plans in connection with attending conference in Sun Valley,
July 12 thru 14th.
Councilman Kinghorn indicated he would be attending, Mayor Cotant is
attending, Councilman Fullmer cannot attend and Councilmen Quick
and Romriell are not sure at this time if they will be able to attend
or not.
ALCOHOLIC BEVERAGES IN CHUBBUCK CITY PARKS - Mayor and council dis-
cussed adopting a resolution allowing the parks to be posted in
certain areas for the drinking of alcoholic beverages.
The mayor and council were in full agreement as to leaving the
ordinance as is, which prohibits drinking alcoholic beverages in
public places, including public parks.
PROSECUTION OF BAD CHECKS BY POLICE DEPARTMENT - Mayor Cotant read a
letter prepared by Attorney Burnett concerning setting forth the
guidelines on "bad check" cases. Police Chief to send this letter
out to merchants in the city.
GENERAL DISCUSSIONS: 1. Sewer alarm at Valenty Station not working and the flooding of
the basement in the house at 203 Hiway Avenue.
2. Electrical disconnects on outside of pump houses.
3. Placement of fences and regulations regarding same.
4. Consideration of allowing pigs in the city.
5. City acquisition of one acre of property which lies directly
west of the present city property. Farrell Poole owns this
acre of ground and it has been appraised. Mayor Cotant and
all councilmen voiced approval of purchasing this acre of ground.
Attorney Burnett suggested city have Mr. Poole provide a
preliminary title report, prior to having a lease purchase
agreement perpared.
6. City employee personnel policy, the police policy was
studied.
