Meeting called to order at 8:05 p.m. by Mayor Cotant. Present: Mayor John O. Cotant, Jr., Councilmen Boyd L. Fullmer, Dwain A. Kinghorn, LeRoy S. Quick and Earl L. Romriell, Attorney Donald L. Burnett, Engineer Steven M. Smart and City Clerk Vera C. Armstrong. The public hearing being held on the following items: 1. Adoption of a comprehensive plan for the City, as required by the Idaho Local Planning Act of 1975. Such a plan has been prepared, and the Chubbuck Planning and Zoning Commission has recommended that it be adopted, with certain changes. 2. Ratification of the establishment, by earlier ordinance, of an "area of city impact" also required by the Idaho Planning Act of 1975. Such ratification has been recommended by the Chubbuck Planning and Zoning Commission. Mayor and Council went through the comprehensive plan, discussing thoroughly. PAGE # C 101 - Council discussed the fluorine study. Councilman Fullmer expressed opposition to having the complete study as part of the comprehensive plan. Councilman Fullmer thought the study ought to be reason for concern and study should be made available. It was discussed at length if the full fluorine study should be kept in the comprehensive plan or not. Attorney Burnett said he sees no problem that these studies be maintained on file rather than be inserted in the comprehensive plan. PAGE # ¢ 102 -~ Mayor and council discussed the Planning and Zoning Commission's recommendation to delete all the language in goal #1 after "area of city impact." Mayor and council agreed with this amendment. PAGE # D 102 - Number 2 under B Goals - Council discussed to what extent city should cooperate with establishing bus transportation, and decided to leave as is. MAP FOLLOWING PAGE # D 102 - Future street plan of arterial and collector streets. Council questioned if Hawthorne Rd. north of Chubbuck should be made an arterial street or not. Attorney Burnett asked logic of Hawthorne Road being arterial south of Chubbuck Rd. but not north of Chubbuck Road. After some discussion, the general feeling was to make Hawthorne Road an arterial street through the city and area of impact. Council also considered adding Tyhee Road as an arterial street. Council considered creating a through street location at Evans Lane from Hiline Road to Hawthorne because of the bottle neck of Transportation at the Burnside location. Councilman Fullmer also suggested that East and West Chubbuck Roads be arterial from Hiline Road to Hawthorne Road. DISCLOSURE - Councilman Romriell said he understood the plan required the governing body to make a disclosure of property owned when comprehensive plan shows changes in their area. Attorney Burnett advised that it would be a good point to make these disclosures. Page 2 - PUBLIC HEARING - Comprehensive Plan and Area of Impact 75 PAGE D 203 - Council in agreement to add a goal numbered 8 as follows: Cooperate with other governmental and taxing units in the use of public facilities. MAP OF FUTURE WATER AND SEWER PLAN FOLLOWING PAGE D 203 - Council agreed to show future water and sewer main lines to extend from Siphon Road to Tyhee Road along Yellowstone Avenue. PAGE E 101 - Land Use and Development - Paragraph A in second paragraph, fifth line, --council agreed to delete word "residential". Item #4 under B Goals amend to: Establish new requirements for off-street parking according to density of development. PAGE E 102 - #5 under B Goals - last sentence - to delete "at earliest feasible opportunities" and add "in a manner consistent with orderly transition of affected neighborhoods". LAND USE AND DEVELOPMENT COMPREHENSIVE PLAN MAP - Council discussed changing land use map and description accordingly for area extending from Siphon Road to Tyhee Road on east side of Yellowstone. Council agreed to amend map and description to an Industrial zone. Council also discussed extending industrial from Tyhee to Reservation on east side of Yellowstone to the railroad tracks. Decision was to leave this area in the residential zone. Council also considered industrial zone from present industrial zone to Whitaker Road from present city limits to Siphon Road. Decision was to leave this zone residential as in the comprehensive plan. COMPREHENSIVE PLAN MAP - FOLLOWING PAGE E 102 - Council agreed to delete all Residential 1 uses within the area bounded by Interstate - 86 Highway, Siphon Road, Rio Vista Roads and Philbin Road thus creating Residential - 2 uses throughout entire area except where C-1 locations are shown as recommended by the Planning and Zoning Commission. Council discussed adding another residential zone. Attorney Burnett suggested setting down some criteria for existing residential uses rather than adding another residential zone. COUNCILMAN QUICK MOVED TO PASS A RESOLUTION ADOPTING THE ORIGINAL DRAFT OF the comprehensive plan as initially proposed to the Planning and Zoning Commission with the following changes Which take into consideration the recommendations submitted by the Planning and Zoning Commission: 1~ Page C 10X ~ 4th paragraph - last sentence to read as follows: To the extent available, the latest ambient air quality surveys and depiction of point sources of air and water polution will be acquired on a continuous basis by the city engineer and made available at c~ty offices for permanent public references. Further that th6 October 1977 fluoride studies be iextracted'f~om the original draft~df the plan but included among the items maintained for permanent public reference. 2. Page C 102 - Amend goal #1 to read as follows: Encourage conversion of agricultural land to residential, commercial or industrial land use within the corporate boundaries of the city as opposed to the area of city impact, and to delete other language from the original draft. 3. On map following page D102 to show East and West Chubbuck Roads as arterial thoroughfares between Hawthorne Road and Hiline Road., to make Page 3 - PUBLIC HEARING - Comprehensive Plan and Area of Impact 3. cont'd - Philbin Road an arterial street all through city and area of impact, to make Tyhee Road an arterial street from Rio Vista to Hiline Road, and to make Hawthorne an arterial street all through city and area of impact. Further to create a public street on Evans Lane and make it a collector street from HIline Road to Hawthorne. 4. Page D 203 - Add a new paragraph #8 as follows: Cooperate with other governmental and taxing units in the shared use of public facilities. 5. On the map following D 203 to show a future sewer trunk, in addition to a future water main, running along Yellowstone Avenue from Siphon Road to Tyheee Road. 6. Page E lO1 - 2nd paragraph, lines 4 and 5, with respect to off-street parking, eliminate reference to the limiting adjective "residential"; and at paragraph B-4 delete all existing language and substitute, "Establish new requirement for off -street parking based upon density of development." 7. Page E 102 - Goal 5, last sentence, strike the phrase "at earliest feasible opportunities" and ~ubstitute the phrase "in a manner consistent with orderly development of the affected neighborhoods." 8. As to the map following Page E 102 and the description of land use pattern following the map: a. Eliminate residential uses in area bounded by Siphon Road, Yellowstone Avenue, the C-1 area at the Yellowstone and Tyhee intersection, and the Industrial zone paralleling railroad tracks and extend the Industrial zone to include said area. b. Delete all R-1 uses within the area bounded by Interstate -86 Highway, Siphon Road, Rio Vista Road, and PHilbin Road thus creating R-2 uses throughout entire area except where C-1 locations are shown. Councilman Fullmer seconded motion. DISCLOSURES At this time Mayor Cotant disclosed the potential conflict of interest, if he were required to vote, within the meaning of the Local Planning Act of 1975 as to that portion of motion that creates an arterial thoroughfare on East and West Chubbuck Roads between Hiline Road and Hawthorne Road and as to the portion of Evans Lane which pertains to creating a public street along Evans Lane and making it a collector street from Hawthorne Road to Hiline Road. Councilman Romriell also disclosed a potential conflict to that portion which pertains to the Evans Lane, and as to that portion of the plan which provide for non-residential uses in areas along Yellowstone and Hiway Avenue now zoned residential. Councilman Kinghorn also disclosed a potential conflict as to that portion of the plan which provide for non-residential uses in areas along Hiway Avenue now zoned residential. Councilman Kinghorn then made motion to table the motion until 8:00 p.m. Tuesday, May 23, 1978. Councilman Quick seconded motion with all councilman voting in favor. AREA OF CITY IMPACT - Mayor and Council discussed the present area of city impact as in the comprehensive plan. The Planning and Zoning Commission have recommended that the council ratify the earlier enactment of an ordinance establishing an area of city impact as depicted in the comprehensive plan without change. 77 AREA OF CITY IMPACT - cont'd - Attorney Burnett told council they could enact 79 area of city impact tonight but city will need to meet with the Bannock County PLanning and Zonning Commission and Bannock County Commissioners to negotiate whose ordinances will apply, and advised council to make the motion to ratify earlier enactment of ordinance, table motion and then invite Bannock County representatives to communicate their views in regard to city impact. Councilman Fullmer moved to adopt an ordinance ratifying the earlier enactment of an ordinance establishing area of city impact as depicted in the comprehensive plan. Councilman Quick seconded motion. Councilman Kinghorn moved to table the motion until 8:00 p.m. Tuesday, May 23, 1978 and that in the meantime representatives of Bannock County be invited to communicate their views to the city in regard to area of city impact. Councilman Romriell seconded motion. All councilmen voted in favor of motion. Councilman Fullmer moved to recess hearing on Comprehensive Plan and the hearing on the Areas of City Impact until Tuesday, May 23, 1978 at 8:00 p.m. Councilman Romriell seconded motion with an unanimous vote in favor of motion.
