Present: Mayor John O. cotant, Jr., Councilmen Boyd L. Fullmer, Dwain A. Kinghorn, Earl L. Romriell. Attorney Don Burnett, Engineer John Alder and Clerk Vera Armstrong. Councilman LeRoy S. Quick excused because of illness. Meeting called to order at 8:00 p.m. by Mayor Cotant. Mayor Cotant asked for corrections or additons to council meeting minutes of January 24 and Janu~y 31. Councilman Romriell asked for an additions to January 31 minutes to show reason the city feels they don't have to spend the $10,000.00 paid by Aztec, Inc. in lieu of well, for direct benefits of residents in Alturas Park. The reason being for not spending the $10,000.00 in Alturas Park is because city council feels money has already been spent there by providing city water that was promised but not provided by Alturas Park Subdividers, which was a part of the agreement to being annexed to city. And further addition by Councilman Fullmer; the well which was to be provided was for general city purposes~ so the money provided in lieu of well should be for general city and not specifically Alturas Park residents. Councilman Kinghorn moved to approve January 24th and 31st minutes with the above addition to January 31st minutes. Councilman Romriell seconded motion with an unanimous vote in favor. STREET SWEEPER BIDS City has re-advertised for bids on a street sweeper. Mayor Cotant opened the bids, Attorney Burnett checked the bids for bid bond requirements and Engineer John Alder checked the bids for bid specification requirements. The bids were as follows: GLENN DICK EQUIPMENT CO.= Mobil street sweeper Model 1-TE-3, F.O.B. Chubbuck:$32,780.O0 less trade-in of 1957 Wayne (1500) =$31,280.00 ARROWHEAD MACHINERY COMPANY= Model 1-973 Wayne Sweeper-S27,909.00 less trade-in allowance($5,163.00)=$22,746.00; Model 1-984 Wayne Sweeper-S29.159.00 less trade-in allowance(5,413.00) =$23,746.00~ Model 1-4MH Wayne Sweeper-S32,415.00 less trade-in allowance (5,000.00)=$27,415.00; Model 1-4AH Waye Sweeper-S33,665.00 less trade-in allowance($5,500.O0)=$28,165.00; Model 1-993 Wayne Sweep Loader -$32,564.00 less trade-in allowance(~6,585.00)=$25,979.00; Model 1-993-AH Wayne Sweep Loader-S36,314.00 less trade-in allowance(7,317.00):$28,997.00; Model 12 Wayne Sweeper, Four wheel design-S44,375.00 less trade-in allowance(¢,O00.O0)=$38,375.00. Bostrom seats an additional $155.00 and all F~O.B. Chubbuck. Chubbuck. Engineer Alder made a report on the bids after reviewing, and said his recommendation was still the Wayne 12 and said he felt if the council is interested in three wheel high dump machines they should investigate the machines further. Mayor Cotant said he felt the full council should be present when a decision is made on the bids. Mayor also said he liked the flexibility of Arrowhead Machinery financing. Engineer Alder told council he was very concerned of visibility of safety of three wheeled sweepers. Councilman Romriell also voiced concern of visibility and safety of machines. Councilman Fullmer said he too was concerned of safety and visL ibility, however, he feels with a competent operator the machine could be safely operated. Councilman Fullmer further added if present sweeper will do job, he is dis-appointed with city personnel for spending the amount of time that has been spent towards bidding, both by bidders and city. Mayor Cotant said he didn't think the present sweeper will take care of the street sweeping demands of the city. Councilman Kinghorn agreed that the present sweeper is inadequate. Councilman Fullmer moved to accept the bid of Starline Equipment for the Elgin Pelican III with hydrostatic drive for $29,282.00 and add the diesel power option of $2,620.00. Councilman Kinghorn seconded motion. Roll call vote: Fullmer, yes; Kinghorn, yes; Romriell, no. Mayor Cotant asked that he go on record as opposing having any three wheeled sweeper in the city, strictly as a safety factor. REZONING REQUEST - Glade P. Kynaston owner of property at 435 East Chubbuck Road nas requested a rezone of his property from AT Agricultural Transitional to commercial zone to facilitate the development of an overnight trailer park. The Planning request of Councilman commission Councilman area being and Zoning Commission voted to deny the re-zoning Mr. Kynaston's at the public hearing meeting. Kinghorn told councilmen that no plan was given and the proposed use was somewhat indefinite. Fullmer said he was not in favor of that particular zoned commercial, especially at this time. Councilman Romriell noted that the surrounding neighborhood that attended the hearing were against the zone change. Councilman Romriell moved to deny request of Mr. Glade P. Kynastd~/~ for a change in zoning classification of his property located on East Chubbuck Road from Agricultural Transitional to a commercial zone. Councilman Fullmer seconded motion and all councilmen voted in favor. 21 INTENT OF ZONING ON EAST CHUBBUCK ROAD - Emilio Esquibel attended the Planning and Zoning Commission meeting and has made a request of determination of the present zone of his property. Councilman Kinghorn reported it was the intent of the city for all existing lots along East Chubbuck Road east of Hiline to be zoned Residential 2 at time of original city zoning in 1971. However, the property lying between the Chatterton Subdivision and the Mountlake Terrace Subdivision not being subdivided and recorded, the map has not been colored properly to scale. Attorney Burnett informed council that with the adopting of the new zoning ordinance the correction could be made and city is not too far away from adopting this ordinance, or it could be done by a separate ordinance. No decision made. LIQUOR CATERING PERMIT - Dave Benko and Dave Ferretti of Press Box has applied for a permit to cater wedding of Sandy and Gert Kyle's daughter at E1 Cielito~ February 17, 1978. Councilman Romriell moved to approve for catering permit to be issued to Dave Benko and Dave Ferretti of Press Box to cater wedding at E1 Cielito, February 17~ 1978. Councilman Kinghorn seconded motion, with all councilmen voting in favor. LIQUOR LICENSE APPLICATION - David Johnson and Greg Leeds representing the Ramada Inn's appplication for a liquor and beer license were present. Mr. Johnson reported to council that he is expecting their state license very soon and would like to get approval for issuance of city licenses as they plan to open the Ramada In the 15th of February. Councilman Kinghorn made motion to approve the application and issuance of the license to Gibson Jack Inc. DBA Ramada Inn upon receipt of proof of State and County liquor and becrlicense issuance, the reason being Ramada Inn expects to have the state and county license by February 15th. Councilman Romriell seconded motion and all councilmen voted in favor. VARIANCE REQUEST TO CONSTRUCT SINGLE FAMILY RESIDENTIAL HOME - Lynn Hitchcock, son of Jerry Hitchcock requested a variance to allow him to build a single-family residential home on his property which is zoned commercial. The Planning and Zoning Commission approved for the variance request to be granted pursuant to interpretation of subdivision regulations by city council with agreement to provide adequate easement in fro~tof said property to facilitate a 40 ft. street. Mayor Cotant told Mr. Hitchcock that his division of property has triggered the sub-division requirement. Attorney Bistline represented Jerry Hitchcock and son Lynn at meeting and stated their utmost desire is to be able to obtain a building permit to build a home for Lynn. Mr. Hitchcock said he would give the required frontage of property for a street. Attorney Bistline requested a rezone or conditional use on property so Mr. Hitchcock can build. 23 VARIANCE REQUEST TO CONSTRUCT SINGLE FAMILY RESIDENTIAL HOME-cont'd- Attorney Burnett said if the lots are on a dedicated street with 30 ft. frontage the zoning could be taken care of by a grant of variance or change at time of adopting the land use ordinance. Mayor Cotant said if residents along East Evans Lane would dedicate property for street, city would consider graveling and chip and sealing the street. Attorney Burnett said he felt the property of Hitchcock should be platted, however, city could waive whatever development requirements of the street they might desire. Attorney Burnett added that the proper way for Hitchcocks to deed property for a street would be by platting, the main reason for platting is to provide orderly growth and land descriptions. Attorney Burnett told council it might be worth the citys' interest to get a condemnation appraisal on the narrow portion of the dedicated street from Hitchcocks west to Yellowstone Highway. PETROLANE BUSINESS ON BURLEY Petrolane Company is interested in buying a parcel of property on Burley Drive in a Light Industrial zone to place their business and storage facilities. Engineer John Alder told council the light industrial zone is open to interpretation if the zone allows such a business or not. Building Inspector Dan Stuart has prepared a plot plan of the proposed building location and Petrolane Company has sub- mitted a request for a waiver of the fifty ft. requirement from storage tank to property 46 ft. available. Councilman Romriell requested and a recommendation from the lines. Plan shows they have only a letter from Petrolane Company building inspector prior to city making a decision. Matter tabled. ORDINANCE # 186 - amending criminal code to provide that certification be made by the Chief of Police or his designee, as well as by a licensed veterinarian was read in full by Mayor Cotant. Councilman Romriell asked that an amendment also be added to penalize dog owners that arrange for their dogs to be adopted back from the animal shelter. Mayor and council discussed adding the amendment proposed by Councilman Romriell and instructed Attorney Burnett to include same in the amended ordinance which will be considered again at next council meeting. FINANCIAL STATEMENT for January presented to Mayor and Council. CLAIMS TO BE PAID IN FEBRUARY presented to mayor and council. After a review of the bills, Councilman Kinghorn moved to approve the claims. Councilman Fullmer seconded motion. Voting was unanimous in favor of motion. AMENDMENT TO WATER AND SANITATION ORDINANCE - Attorney Burnett was instructed to add an amendment to sanitation ordinance to require a concrete pad for commercial containers and making sanitary service compulsory to all residential and commercial users.
