Land Use and Development Commission Meeting Minutes
August 6, 2013

Minutes of the Land Use and Development Commission regular meeting held at Chubbuck City Hall,
5160 Yellowstone, on August 6, 2013.
Chairman Peter Anderson: Commission Members: Rodney Burch, Dan Stoddard, Morris Kinghorn, James
Eborn, and Jason Mendenhall. City Staff: Steve Smart, Paul Andrus. Attorney: Tom Holmes. Secretary:
Ranelle Simmons
Chairman Anderson called the meeting to order at 7:02 pm.
Burch led the commission in the Pledge of Allegiance.
APPROVAL OF THE MINUTES:
Anderson entertained a motion to approve the minutes as mailed. Mendenhall moved the minutes of
July 2, 2013 meeting be approved as mailed; Eborn seconded. The full authority approved.
GENERAL BUSINESS
Discuss City Code 18.24.050 nonconforming uses of structures or of structures and land in
combination
Andrus was the representative from the City of Chubbuck and had supplied the commission with a list of
nineteen cities with how they handle the rebuilding percentages.
The commission discussed for a considerable amount of time making no changes to city code 18.24.50,
taking city staffs recommendation to remove "F" from the city code and changing "A" and "B" to be less
restrictive to the homeowner.
Holmes agreed with staff recommendation that "F" is causing the problem and that is the only area of
the city code that should be dealt with.
Anderson reminded the commission that if changes to the city code are recommended those changes
will be on the September 3`d meeting agenda as a Public Hearing.
Mendenhall made the motion to change city code 18.24.50 nonconforming use by striking out "F" from
the code and moving forward with a Public Hearing. Motion carries.
Anderson entertained a motion to adjourn; Kinghorn made the motion M en seconded. All voted
to adjourn at 7:55 pm.
