Land Use and Development Commission Meeting Minutes
May 7, 2013 - 7:00 p.m.
Minutes of the Land Use and Development Commission regular meeting held at Chubbuck City Hall,
5160 Yellowstone, on May 7, 2013.
Chairman Peter Anderson: Commission Members: Rodney Burch, George Merrill, Morris Kinghorn,
James Eborn, Jason Mendenhall. City Staff: Steve Smart, Paul Andrus.
Attorney: Tom Holmes. Secretary: Ranelle Simmons
Chairman Anderson called the meeting to order at 7:00 pm.
Burch led the commission in the Pledge of Allegiance.
APPROVAL OF THE MINUTES:
Anderson entertained a motion to approve the minutes as mailed. Kinghorn moved the minutes of April
2, 2013 meeting be approved as mailed; Mendenhall seconded. Motion carries.
GENERAL BUSINESS:
1. Discuss the draft ordinance amending 18.08.040A to permit childcare centers in industrial areas
rather than conditionally permitting them.
Andrus informed the board of the request by a city resident to locate a child care center in an industrial
zoned area which is conditionally permitted. Most of our city's industrial areas are considered light
industrial. Dance studios are permitted in the industrial areas.
Burch asked where the industrial areas are in the city. Andrus explained Industry Way, both sides of the
railroad tracks, and part of Burley Drive.
Anderson voiced a concern for a day care being allowed in the Industry Way area with a safety factor
involving large trucks and being able to stop quickly. Smart commented there has been a day care in the
Industry Way area in the past and he did not recall any problems.
Burch commented that the C -1 and C -2 zoned areas have more traffic than most industrial areas.
Eborn has a concern with the railroad tracks being a temptation for children.
Burch commented to regulate safety issues in an industrial area is tough. Maybe the section 6 in the
code that is dedicated to day cares needs to have some attention. Making sure there are requirements
for outdoor space and fencing.
Holmes mentioned that the Fire Department and the Police Department check the requirements very
thoroughly.
Anderson stated maybe it's time to look at the industrial areas and the zoning and possibly break it into
two designations.

Holmes commented the initial inspection for day care facilities is done by the Fire Department, Police
Department and the Building Official. Follow -up inspections are done by the police and fire on an annual
basis. Our City day care codes are quite strict.
Burch would not have a problem permitting the day care center in the industrial zoned areas after
Holmes comments.
Andrus stated there are two distinctions with day cares. Home day care has an occupancy limit of 12
children. Commercial day care occupancy limit depends on fire sprinkler systems and square footage.
The code is 35 square feet per child.
Anderson entertained a motion. Mendenhall made a motion to move the draft ordinance 18.08.040A to
permit day care centers in industrial areas rather than conditionally permitting to a public hearing.
Kinghorn seconded. Motion carries.
Anderson entertained a motion to adjourn. Kinghorn made the motion. Mendenhall seconded. All voted
to adjourn at 7:20 pm.
