July 24, 1980
Minutes of the adjourned meeting of July 22, 1980, held in the municipal building
July 24, 1980,
Present: Hayor John O. Cotant, Jr., Councilmembers Becky A. Hopkins, Earl L.
Romriell, LeRoy S. Quick and Attorney Donald L. Burnett, Jr., City Engineer Steven
Smart and Secretary Dorothy ~Iard.
PURSUANT TO A CALL of the mayor to the city council of adjourned meeting, notice
having been given to all the members, Mayor Cotant called the meeting to order
at 5:30 p.m.
Mayor Cotant asked for any additions or corrections to the minutes of July 8, 1980
and July I0, 1980 minutes. Attorney Burnett asked that the minutes of July 10,
be corrected ~_ 'under Review of General Liability: to strike, the policy that,
and to read Insurance Designers policy was comparable, and strike, the low bid, and
read Mr. Fullmer's low bid on general liability insurance. Second paragraph to
strike $12,370.00.
There being no other corrections, Councilwoman Honkins moved to approve minutes
of July 8, and with the above noted corrections to approve the minutes of July
10. Councilman Romriell seconded the motion with a unanimous vote in favor.
ORDINANCE CONSIDERATION - Ordinance Amending No. 206, providing that all structures
or improvements dedicated to the public, and accepted, shall be warranted
against defects for period of three years from the date of acceptance.
Engineer Smart discussed with the council his concern about amending this
ordinance. He said proposed ordinance requires a three year warranty and
'under present ordinance there are provisions for the city to adopt schedule

of inspection fees to protect the city against poor construction. He said
the city has a problem now and the city needs to have some way to charge back
to the developer these inspection charges. He said with this particular project
they need an inspector on the job.
The council discussed with Mr. Smart the responsibility of the project engineer.
He said the engineer that designs projects are not construction project inspectors.
Attorney Burnett joined the council meeting at this time, he said the council needs
to make a decision whether they want to go forward with the three year warranty on
dedicated improvements,or either in addition to or in lieu 6f extending the
warranty approach,keep up the in process of inspections which means incurring
more front end expense for the city which has to be someway equitably charged to
the developers. Present ordinance allows city engineer by shedule to establish
the charges for inspection and the city council by resolution to approve the
schedule.
Engineer Smart said he would like to put developers on notice the city is going
to inspect and developer will be billed for service. He said he would recommend
city not adoot Ordinance #206 for three year warranty but rather adopt a schedule
for inspection only, plus testing as needed, with all being charged back to
the developer, at same cost the city incurs,

RESOLUTION # 7-50 authorizing Inspection Fee Schedule was read in full by ~ayor
Cotant, Councilwoman Hopkins made motion to pass Resolution #7-80. Councilman
Romriell seconded the motion. Roll call vote: Hopkins, yes; Romriell, yes;
Quick, yes.
CLAIM for Pickens Electric was presented by Mayor Cotant. Councilwoman Hopkins
made motion to pay claim. Councilman Quick seconded the motion. The voting
was unanimous in favor.
CERTIFICATION AND NOTICE OF DELIHQUENCY on the Chubbuck Local Improvement District
No. 1, was read in full by Mayor Cotant.
Councilwoman Hopkins made motion to adopt resolution setting forth the certification
and notice of delinquency, pertaining to the assessment against the Parrish
property, Chubbuck L.I.D. #1, which was due July !, 1980. Councilman Quick
seconded the motion. Hopkins, yes; Quick, yes, Romriell, no.
AMERICA~I HERITAGE BUILDERS, Inc. requesting a 6 month extension on the approval
of the remainder of the final plat of Heritage ~lest Subdivision. The council
discussed how the development was proceeding.
Councilman Romriell made motion to grant a 6 month extension to Heritage ~!est
Subdivision, subject to any changes in the subdivision ordinance that are
applicable at the time of development. Councilman Quick seconded the motion.
Hopkins, yes; Romriell, yes, Quick, yes.

ORDINANCE REGULATING SIGNS within the city. The council discussed the sign
regulations, Mayor Cotant asked the council to study the uniform sign
ordinance.
Councilwoman Hopkins made motion to adjourn at 8:30 p.m, seconded by Councilman
Romriell with all voting in favor.
