HomeMy WebLinkAbout06 10 1980 CMlO1 COUNCIL MEETING MINUTES June 10, 1980 Minutes of the regular council meeting held in the city municipal building June 10, 1980. Present: Mayor John O. Cotant, Jr., Councilmembers Becky A. Hopkins, Dwain A. Kinghorn, LeRoy S. Quick and Earl L. Romriell. Engineer Steven M. Smart,Myrna Crap( secretary, Attorney Donald L. Burnett, Jr. attended the meeting at 9:20 p.m. until adjournment, and Dan Stuart, Building Inspector. Meeting called to order at 8:00 p.m. by Mayor Cotant. Mayor Cotant asked for additions or corrections to minutes of June 3. There being no corrections, Councilman Quick moved to approve minutes as written for June 3. Councilman Romriell seconded motion, with an unanimous vote in favor. FINAL PLAT - S & N Estates - Kent Shiozawa, Ronald Nelson, and Richard Nelson, developers, through their engineers, Harper, Morgan and Associates presented their final plat. Engineer Smart explained about the plat and informed the council that the construction drawings conform to everything. He only had two remaining items that needed to be cleared up. 1. They haven't presented their restrictive covenants. 2. They haven't presented their instrument of dedication of the well lot. Jim Harper of Harper, Morgan, and Associated told the council that it was his understanding that the attorney would draft the instrument dedicating the well to the city so it would be done the way the city wante~ it. Mayor Cotant felt that the council should see the restrictive covenants before approving the final plat. *The Council wanted the restrictive covenants prior to the June 24 meeting so they can be reviewed. The Mayor and council reviewed the final plat and discussed fire hydrants, well, sewer systems, well lot, easements and water lines. Councilwoman Hopkins moved to table the final plat until the June 24th regular meeting. Councilman Quick seconded motion, all councilmembers voted in favor. SIGN REQUEST - Robert Moore, Smith's Food .S Drug Center. Mr. Moore showed the council drawings of the proposed signs to be erected and explained them. Engineer Smart explained the problem that Smith's Food King & Drug Center were having. The store at 4845 Yellowstone wanted to open on July 17th and in order to get a conditional use permit to put their signs up, it would take two months to go through the Land Use and Land Development Commission and the Council. Dan Stuart the building inspector explained that Smith's were using more = square footage on their surface sign then the allowed even on a conditional ~ use permit. Motion died for lack of second 103 SIGN REQUEST- continued effect in June. This problem would go away in a couple of weeks. Engineer Smart recommended that a review committee consisting of the Mayor and some of the council be set up. Attorney questioned if the counc~ would want to have a review mechanism to expedite review.*Coucilman Romriell moved that they approve this application and that the blacktop go in front subject to the proper elevation, It died for lack of, secona A discussion was held on how to speed up the design review permits. Attorney Burnett stated he wanted to see if he could provide for direct application on design review to go to the city council after it goes through the staff. Instead of before the Land Use and Land Development Board first. The council could test this method to see if it would work and speed up the review. Attorney Burnett informed the council that he will prepare an ordinance by next week to give the council the authority on expedited basis to handle cases pending at the time the ordinance is adopted. Mayor Cotant informed those present that anyone with a sign problem will have it resolved by June 24. DESIGN REVIEW PERMIT - A-1T.V, Service, David L. Garvin, 5003 Yellowstone, presented to the council the results of a survey that he had taken. The survey showed that he had 8.3 feet in front and 10 feet in back. He informed the council that his lot was 50 foot and he was going to put parking in the back. He had enough room for about 20 vehicles to park. The council discussed whether they should require black topping and curbs on Yellowstone when the state highway department was proposing their project for Yellowstone for 1982. David Garvin told the council he was going to have the back surfaced. He needed to put in a dry well for drainage but he didn't want to do sidewalks and curb if the state high project was going to be done and he would have to tear it out again, Councilman Kinghorn felt that the see what they want the city to do that a direction should be set to city needed to meet with the state to concerning Yellowstone. He told the group show where the city is going. Councilman Quick expressed concern over the access problems, if we required them to do the work now. Councilwoman Hopkins and Engineer Smart felt that blacktopping should be done now. Councilman Romriell moved to grant the permit subject to installation of curb, gutter and sidewalk and the paved portion of the parking lot all within six months after completion oflstate highway improvement project, or within six monthsafterApril'l, 1980. All such improvements to conform to state highway elevations. Councilman Quick seconded motion. Kinghorn, yes; Quick, yes; Romriell, yes; Hopkins, no. 105 FIRE WORKS PERMIT - LeRoy Hawkins, 4719 Yellowstone. After a discussion Councilman Kinghorn moved to approve acceptance of fire works permit on condition of compliance to city ordinance and subject to approval of the ~ity staff. Councilman Quick seconded with all voting in favor. LITTLE LEAGUE BASEBALL - Bob Eldredge who is in charge of the Little League umpires explained some problems that the umpires were having, with the coaches. Councilman Quick suggest that Bob Eldredge meet with the commissioners of baseball and discuss this problem with them. A discussion was held on what could be done. Councilwoman Hopkins complimented the Tee Ball league on the fine job they were doing. She was impressed with the game she had watched. ORDINANCE #215 making it unlawful to park in traveled portion of roadway or street right-of-way, Etc. was read by title by Mayor Cotant as the third reading. Councilwoman Hopkins moved to pass Ordinance #215. Councilman Kinghorn seconded motion. Roll call vote: Hopkins, yes; Kinghorn, yes; Quick, yes; Romriell, yes. ORDINANCE #216 amending Ordinance No. 78, concerning installation of pressure regulators was read by title by Mayor Cotant as the third reading. Attorney Burnett informed Engineer Smart that he needed to send out a letter informing the people of the provisions of this ordinance. Councilman Kinghorn moved to pass Ordinance #216 amending Ordinance No. Councilwoman Hopkins seconded motion. Roll call vote, Hopkins, yes; Kinghorn, yes; Quick, yes; Romriell, yes. 78~ ORDINANCE #217 amending Ordinance #127, concerning the requirement of surety bond when private individuals install their own curb, gutter, and sidewalk was read by title by Mayor Cotant as the third reading. Councilman Romriell moved to pass Ordinance #217 amending Ordinance #127. Councilman Kinghorn seconded motion. Roll call vote: Hopkins, yes; Kinghorn, yes; Quick, yes; Romriell, yes. ORDINANCE AMENDING ORDINANCE NO. 148 and ORDINANCE NO. ]67 by providing for additional requirements regarding design and reinforcements of walls and additional means of emergency egress from basements was read in full by Mayor Cotant and accepted as second reading. ORDINANCE AMENDING NO. 206, providing that all structures or improvements dedicated to the public, and accepted, shall be warranted against defects for a period of three years from the date of acceptance was read by title by Mayor Cotant and accepted as the second reading. ORDINANCE AMENDING NO. 179 to re-define "Subject Vehicle:" was read in full by Mayor Cotant and accepted as the second reading. ORDINANCE PROHIBITING cRoss-cONNECTIONS to the water supply system of the city 107 ORDINANCE PROHIBITING CROSS-CONNECTIONS continued was read by title by Mayor Cotant and accepted as the first reading. Engineer Smart explained that this was required by the Department of Health and Welfare. CLAIMS to be paid in June presented to Mayor and Council. Claims reviewed by mayor and council, Councilman Romriell moved to approve all claims. Councilwoman Hopkins seconded motion, all councilmembers voted in favor.
