May 6, 1980
Minutes of the adjourned meeting and continued public hearing council
meeting of April 29 held in the city municipal building, May 6, 1980
Present: Mayor John O. Cotant, Jr., Councilmembers Becky A. Hopkins,
Dwain A. Kinghorn, LeRoy S. Quick, Earl L. Romriell, Attorney Donald L.
Burnett, Engineer Steven M. Smart and City Clerk Vera C. Armstrong.
Land Use and Development Commission members Del Peters, Del Bunce
and Mike Metcalfe.
Mayor Cotant called meeting to order at 7:10 p.m.
PUBLIC HEARING - February 19 Land Use public hearing - Item #5 - and
Item #6 (5) Whether the ordinance should be further amended to create
a category of residential dwellings known as "Mobile Homes" separate
from "Production Dwellings" category now existing in the ordinance
and setting forth specific regulations for such Mobile Homes.
(6) Whether the ordinance should be further amended with respect to
Production Dwellings and the proposed category of Mobile Homes to
bring the requirements for Production Dwelling Courts and Mobile
Home Courts into closer conformity with the requirements imposed for
conventional housing in General Residential (R-2) land use districts
under the Land Use Ordinance and other applicable ordinances.
After a lengthy discussion Attorney Burnett brought the ideas together
with the following summation.
1)All Mobile Homes must be clustered and consists of at least 10 lots,
and not intended for multiple dwellings.
2) Mobile #2 type clusters may be located in General Commercial or
Industrial areas but not within 500 feet (or a selective figure)
of any residential unit and they will be subject to the mobile home
standards set forth in the ordinance.
3) Mobile Home #1 will meet General Residential (R-2) standards at least, and
may be located in General Residential (R-2) areas.
4) Mobile Home #1 will require 10 foot side yards, 20 foot front yard,
20 foot rear yard, 60 foot frontage, 6,000 sqaure feet. Mobile #1
home to be at least 20 feet wide, set on permanent foundation with
pitched shingled roofs.
5) As to individual units, they would be allowed only in family
hardship cases, subject to six month limitations and would be abated
as nuisances by the city as time expires and the units have not
been removed from the premises.
Councilwoman Hopkins made motion to close the public hearing with respect
to all items set forth in the public hearing notice dated January 21, 1980.
Councilman Quick seconded motion, all councilmembers voted in favor.
Councilwoman Hopkins made motion to direct city attorney to prepare one
or more amendatory ordinances to implement the consensus of the council
following its hearings on the items set forth in the hearing notice
dated January 21, 1980. Councilman Kinghorn seconded motion with an
unanimous vote in favor.
PUBLIC HEARING - LAND USE ITEMS - continued
Councilman Kinghorn made motion to continue the public hearing until
7:00 p.m. May 13, with respect to those items set forth in the hearing
notice dated March 18, 1980.
SPECIAL MEETING SESSION - Mayor Cotant declared the special meeting
in session. Purpose of special meeting is to consider extension of
Mobile Home Moratorium,
Mayor and council discussed the necessity of extending the moratorium
on mobile home conditional use permit applications, which will allow
council to consider the amendatory ordinance being prepared as a
result of recent hearings. Attorney Burnett was directed to prepare
a resolution to extend the moratorium for a period of 60 days.
RESOLUTION 4 - 80 - extending Mobile Home moratorium was read in full
by Mayor Cotant.
Councilwoman Hopkins moved to adopt Resolution 4 - 80. Councilman
Quick seconded motion. Roll call vote: Hopkins, yes; Kinghorn~ yes;
Quick, yes; Romriell, yes.
GEN AL DISCUSSIONS'
Councilman Kinghorn asked mayor and council how they felt about sending
a police officer to Moscow for a weeks training in firearms and he would
return and teach other officers.
After discussion Councilman Kinghorn moved to approve for Officer Moore
to attend the firearms school at Moscow the week of May 12, transportation
and $15.00 per day board costs to be paid by city. Councilman Romriell
seconded motion with all councilmembers voting in favor.
Councilman Romriell moved to reconsider the motion to authorize the
attendance at the police firearms training session in Moscow. Councilman
Quick seconded motion with full council approval.
Councilman Kinghorn withdrew his motion concerning the officer attending
the firearms school and Councilman Romriell agreed to the withdrawal.
2) Mayor Cotant said a salary needs to be set for the newly appointed
Assistant Fire Chief and the same was discussed.
Councilman Romriell moved, Councilman Quick seconded,
approval for meeting to adjourn at 10:30 p.m.
