Minutes of the adjourned meeting of April 83 held in the city municipal
building April 15, 1980.

Present: Mayor John O. Cotant~ Jr.~ Councilmembers Dwain A. Kinghorn,
LeRoy S. Quick, Earl L. Romriell, Engineer Steven M. Smart, City
Clerk Vera C. Armstrong. Councilwoman Becky A. Hopkins and Attorney
Donald L. Burnett, Jr. excused.
Mayor Cotant called the meeting to order at 8:20 p.m.
FIRE TRUCK - Chief Denny Jones presented data on a new fire truck. Chief
Jones also asked council to consider approving financial assistance
for up to 10 volunteer firemen to attend the State Fire School,
June 18, 19, and 20th at Moscow, Idaho.
Chief Jones to check with volunteer firemen and determine which fire-
men would be going. Council to consider approval of firemen attending
the fire school at the April 22 council meeting.
PUBLIC HEARING - LAND USE AMENDMENTS - CONTINDATION OF 1st PUBLIC HEARING
NOTICE - 2-19-80.
1) Council in favor of having a notice of public hearing prepared
and published on the conditional use permit amendment.
2) Signs - Council reviewed the Uniform Sign Code and also the
Sign Code of Idaho Falls. Mayor and council were very impressed by
the Idaho Falls sign code and will study for further consideration
at the continuation of hearings on April 29.
PUBLIC HEARING - LAND USE AMENDMENTS AND LAND DEVELOPMENT AMENDMENTS -
CONTINUATION OF 2nd PUBLIC HEARING NOTICE 4-8-80.
1. Whether the Chubbuck Land Use Ordinance #205 should be amended
in the following respects.
A. Whether amendments should be made to the Schedule of General
Controls in Section 2-3 (b), including the addition of "Government
Facilities" as a land use within said Schedule.
After discussion, Councilman Romriell moved to accept the Land Use
Commission recommendation of including "Government Facilities" as a
land use within the Schedule of General Controls in Section 2-3 and
to permit the use in Agricultural and General CommercialIC-1) and
Industrial zones and to require a conditional use in Limited Residential
(R-l), General Residential (R-2) and Limited Commercial (C-I) zones.
Councilman Kinghorn seconded motion. Roll call vote: Kinghorn, yes;
Quick, yes; Romriell, yes.
B. Whether the ordinance should be further amended to limit the
placement of fences which obscure vision within specified distances
from street intersections.
A lengthy discussion took place on the meaning of the wording as now
in ordinance. It was the consensus of mayor and council that the
present wording in Section 3-5 (f), page 26, in regards to fences,

structures, object or vegetation obscuring line-of-sight vision
will need modified only slightly to remove the uncertainty of the
present wording. The mayor and council desire that the line-of-sight
vision not be obscured within ten feet of the point that a back-out
driveway intersects with a street or vehicular way, and to a point
within fifteen feet along an intersecting street and vehicular way.
Council to discuss this later with Attorney Burnett.
Councilman Romriell recommended that no fence be allowed with a
height over three feet from the street to the setback of the houses
in residential areas. Further thought to go into this item and
will be discussed at the continuation of these public hearings.
Councilman Romriell moved to adjourn the public hearings until
after the regular scheduled agenda at the April 22 meeting, and
to adjourn this meeting at 11:00 p.m. Councilman Quick seconded
motion with all councilmembers present voting in favor.
