HomeMy WebLinkAbout04 08 1980 CMCOUNCIL MEETING MINUTES April 8, 1980 55 Minutes of the regular council meeting held in the city municipal building April 8, 1980. Present: Mayor John O. Cotant, Jr., Councilmembers Becky A. Hopkins, Dwain A. Kinghorn, LeRoy S. Quick, Earl L. Romriell, Attorney Donald L. Burnett, Engineer Steven M. Smart and City Clerk Vera C. Armstrong. Meeting called to order at 8:05 p.m. by Mayor Cotant. Mayor Cotant asked for corrections or additions to minutes of March 25 and April 1. Councilman Kinghorn moved to approve minutes of March 25 and April 1 as written. Councilman Quick seconded motoion with all councilmembers voting in favor. PUBLIC HEARING - S & N Estates, a proposed subdivision in the Chubbuck impact area lying north of Tyhee Road, just east of the railroad tracks. Developers Kent Shiozawa, Ronald Nelson and Richard Nelson were present, also present was Engineer Harper of Harper, Morgan and Associates, Inc. Kent Shiozawa and Mr. Harper asked if city would waive the following requirements; 1) curb, gutter, and sidewalk, 2) underground wiring, 3) 6" ductile iron or cast iron water pipe to P.V.C. 6" water pipe, 4) variance of zoning in city impact area from industrial to residential suburban, 5) providing park area, since the church plans to develop a three acre ball field. Mr. Shiozawa said they planned to provide fire hydrants and a well that would be capable of producing 400 g.p.m.. He also told mayor and council they have approached the Latter Day Saints church and have proposed to give four acres to them. The church has also requested an additional acre and plan to develop three acres for a ball field. Mr. Shiozawa asked if this would be sufficient to handle needs of park area. He also noted this area would be owned and maintained by the church. Mayor Cotant suggested the S & N developers go to the county land development board and ask that the proposed road easement to the east be deleted_from, the Flat. Attorney Burnett suggested, regarding the road easement, the enactment of a deferred development agreement, providing that the party owning the property be responsible for development of street, however, agreement could also be written with a reserve strip held by owner so that he could be reimbursed for cost of development if Bannock County insists on the road. In reviewing the Land Use and Development ordinances, Attorney Burnett informed mayor and council that anytime a developer requests relief from ordinance provisions a written statement shall be submitted with the preliminary plat and that the public hearing notice also has to include the fact that a request for relief has been made by the developer, and a new hearing would need to be held. PUBLIC HEARING - S & N ESTATES - A discussion followed in regards to relief from the park dedication with general consenus that the drilling of a larger well would be accepted in lieu of park ground dedication. Mr. Harper withdrew consideration of the preliminary plat for re- submission of preliminary plat to the Land Use Commission at a special meeting on April 24 and at a council meeting April 29. PRELIMINARY PLAT EXTENSION - Richard Allen, representative of Ashley, Craig and Associates informed mayor and council that they have submitted written request for a six month extension of approval on the Chubbuck Center preliminary plat. Councilman Romriell moved to grant new approval of preliminary plat for another six months. Councilman Quick seconded motion, all councilmembers voted in favor. LIQUOR CATERING PERMIT - Bill Kalivas, Pressbox, has applied for a liquor catering permit for a wedding reception to be held at the E1 Cielito Wedding Chapel, April 12, 1980. Police Department have approved the permit. RESOLUTION 3-80 providing for city to apply for grant for development of Mary's Park was read in full by Mayor Cotant. Council requests to see the plans prior to approving the resolution. Engineer to present at next council meeting. ORDINANCE amending No. 1~8, providing for additional requirements regarding design and reinforcement of walls and additional means of emergency egress from basements was read by title only as the second reading of ordinance. ORDINANCE amending No. 185, making indecent exposure a misdemeanor and making it unlawful to draw or write indecent~ profane or offensive words or pictures on public premises, etc.~ was read in full by Mayor Cotant as the first reading of ordinance. ORDINANCE amending No. 205, referring to conditional use permits read in full by Mayor Cotant. This ordinance is for consideration only as a public hearing will need to be held on this matter. ORDINANCE prohibiting parking in the traveled portion of a roadway and against traffic was read in full by Mayor Cotant as first reading of redrafted parking ordinance. LAND USE COMMISSION MEMBER - Mayor Cotant asked council members for their consideration approving the appointment of Del Bunce to the Land Use Commission. Councilman Quick seconded motion with all councilmembers voting in favor. 57 GENERAL DISCUSSIONS: 1. 2. 3. 59 Little League Baseball, Councilman Quick reported on summer plans. Fire Department report from Mayor Cotant. Energy, Councilman Romreill requests city investigate grant possibilities. Impact area. Heating at Fire Station, a discussion as to what can be done to lower the bill. FINANCIAL STATEMENT for March presented to Mayor and Council. CLAIMS TO BE PAID IN APRIL presented to Mayor and Council. After a thorough review of claims, Councilman Romriell moved to approve all claims as presented. Councilwoman Hopkins seconded motion.
