HomeMy WebLinkAbout0597 Speed Limits 2005CITY OF CHUBBUCK, IDAHO ORDINANCE NO. 5 9 7 AN ORDINANCE OF THE CITY OF CHUBBUCK, IDAHO, AMENDING SECTION 10.08.050 TO SET THE SPEED LIMITS ON CHUBBUCK ROAD FROM HILINE ROAD TO HAWTHORNE ROAD AT 35 MPH; TO SET THE SPEED LIMITS ON HAWTHORNE ROAD FROM CHUBBUCK ROAD TO QUINN ROAD AT 35 MPH; REPEALING PRIOR CONFLICTING ORDINANCES; PROVIDING FOR THE SEVERABILITY OF THE PROVISIONS OF THIS ORDINANCE, PROVIDING THAT ALL OTHER SECTIONS AND PROVISIONS OF CHAPTER 10.08 NOT HEREIN AMENDED SHALL REMAIN IN FULL FORCE AND EFFECT; AND PROVIDING WHEN THIS ORDINANCE SHALL BECOME EFFECTIVE. BE IT ORDAINED BY THE MAYOR AND COUNCIL OF THE CITY OF CHUBBUCK, IDAHO: Section 1. Section 10.08.050 is amended as follows: 10.08.050 Speed Limits: A. The health, safety and welfare of the inhabitants of the City, as well as of persons visiting the City, require that reasonable limits be imposed upon the speed at which vehicles may be operated within the City. After appropriate traffic surveys and with the advice of the City's Public Works Director and other staff, the following limitations are adopted: 1. Thirty-five (35) miles per hour, or such other limit as the Idaho Department of Transportation or its successor may establish, upon any thoroughfare within the City which is part of the highway system maintained by the Idaho Department of Transportation or its successor agency. 2. Thirty-five (35) miles per hour on Poleline Road as it extends from the intersection with Yellowstone Avenue to the southerly boundary of the City. 3. Thirty (30) miles per hour on thoroughfares which are designated as "arterial thoroughfares" except for the following limits: Location Speed Limit (miles per hour) Hiline Rd. from Chubbuck Rd. 35 north to City limits Hiline Rd. from Chubbuck Rd. 35 south to City limits Chubbuck Rd. from Hiline Rd. 35 to Hawthorne Rd. Hawthorne Rd. from Chubbuck 35 Rd. south to City Limits "Arterial thoroughfares" are East and West Chubbuck Road, Hawthorne Road, Hiline Road and Siphon Road. Ordinance - Page 1 chubbuck052505speedordinance.wpd 4. Twenty (20) miles per hour on all thoroughfares not classified in this Section. B. The Chief of Police and Public Works Director arers authorized to post or cause to beposted the speed limits set forth in this Section upon thoroughfares within the City, consistent p with the standards for traffic -control devices prescribed by Idaho Code. C. It is unlawful and punishable as an infraction for any person to operate a vehicle upon any public thoroughfare, including any street, highway, vehicularway or other thoroughfare, at a � speed eater than is reasonable and prudent under the conditions having regard to the actual and P potential hazards then existing. In every event, speed shall be so controlled as may be necessary to avoid colliding with any person, vehicle or other conveyance on or entering the thoroughfare in compliance with legal requirements and the duty of all persons to use due care. Where no special hazard exists that requires lower speed for the purpose of compliance with this subsection, the speed of any vehicle not in excess of the limits specified in subsection A of this Section shall be lawful, but any speed in excess of such limits shall be prima facie evidence that the speed is not reasonable or prudent and that it is unlawful. ADMINISTRATIVE PROVISIONS Section 1. Repeal of Conflicting_Ordinances. The provisions of any Ordinance of the City of Chubbuck, Idaho, and any provision of the Chubbuck Municipal Code which are in conflict with the provisions of this Ordinance are hereby repealed to the extent of such conflict. All other sections and provisions of Chapter 10.08 not herein amended shall remain in full force and effect. Section 2. Severability. If any provision of this ordinance is held invalid, for any reason, by any court of competent jurisdiction, such holding shall not affect the validity or enforceability of any of the remaining provisions. Section 3. Effective Date. The rule requiring an ordinance to be read on three separate days, one of which shall be a reading in full, is hereby dispensed with, and this Ordinance shall become effective upon its passage, approval and publication as provided by law.
