HomeMy WebLinkAbout001.02.13City of Chubbuck Land Use and Development Commission Meeting Minutes January 2, 2013 - 7:00 p.m. Minutes of the Land Use and Development Commission regular meeting held at Chubbuck City Hall, 5160 Yellowstone, January 2, 2012. Vice - Chairman Jason Mendenhall: Commission Members: George Merrill, James Eborn, Ron Horner, Bryan Nield. City Staff: Steve Smart, Paul Andrus, Sean Harris. Attorney: Tom Holmes. Secretary: Ranelle Simmons. Vice - Chairman Mendenhall called the meeting to order at 7:00 p.m. Merrill led the commission in the Pledge of Allegiance. Mendenhall asked if any commissioners had a conflict of interest within the items before the board tonight. No conflict voiced. APPROVAL OF THE MINUTES: December 4, 2012 Mendenhall entertained a motion to approve the minutes as mailed. Horner moved the minutes of December 4, 2012 meeting be approved as mailed; Eborn seconded. The full authority approved. NOTICE OF PUBLIC HEARING 1. An application by Mike Dance, 209 West Siphon Road, Chubbuck, ID 83202 for a Change of Land Use District to a Planned Unit Development together with the Preliminary Plat and Preliminary Development Plan. The property is located at 209 West Siphon Road, NW % of Section 3 T6S, R34E, B.M., Chubbuck, ID 83202. Andrus, city staff, reported that the original application had the wrong address. The actual address is 209 West Siphon. After review of the application the proposed units are allowed in the R4 PUD. No questions from the commission for city staff. Rodney Burch from Dioptra, 4751 Afton Place, Chubbuck, ID is in attendance to represent the applicant. 209 West Siphon Road is on the South side of Siphon Road. The application shows a driveway off of Siphon Road to access 7 multifamily 4 -plex units. Currently the zoning on this land is R2. Applicants are asking for a R4 PUD zoning which is in compliance with the comprehensive plan. The entire parcel is just over 2.1 acres which includes the existing home. Each apartment will have a private individual storage unit. Between the storage units there will be a concrete pad for tenants to use. By ordinance there could be 10 buildings constructed but with only 7 there will be more open space and an open feel to the complex. The PUD ordinance requires 10% of the gross land area to be open space. This project has 26 %. Utilities coming from Siphon Road will also extend to the east and west property lines in anticipation of future growth. The intent is to have a one ownership facility with the common area being maintained by management from the existing home where Mr. Dance lives. Mendenhall asked if commission members had questions. Burch explained that the ditch on the south will be maintained, piped and put under ground. The ditch that runs the west property line is only used by Mr. Dance's parcel so it will be taken out of service. Mendenhall opened the public hearing asking for comments in favor of the application. No comments. Mendenhall asked for comments opposed to the application. No comments. Mendenhall asked for comments uncommitted to the application but would like to be heard. Dave Finkelburg lives at 8767 West Pocatello Creek Road, Pocatello ID. His family owns the property on the west side of the development. He expressed concern that when he irrigates his property there may be water run -off onto Mr. Dance's property. No further comments. Mendenhall closed the public hearing and brought the meeting back to the commission for discussion. Commission discussed the irrigation water and run -off issues. Burch assured the members that they will work with the other owners to alleviate any problems. The buildings will be built at least 9" above the parking lot which will provide drainage for the apartment complex. Mendenhall entertained a motion. Neild made a motion to recommend approval to city council a Change of Land Use District to a Planned Unit Development together with the Preliminary Plat and Preliminary Development Plan. The property is located at 209 West Siphon Road, NW % of Section 3 T6S, R34E, B.M., Chubbuck, ID 83202. Roll Call Vote: Merrill, Yes; Eborn, Yes; Horner, Yes; Nield, Yes; Mendenhall, Yes. Motion carries. The recommendation will go to City Council on January 22, 2013. Mendenhall entertained a motion to adjourn; Horner made the motion. Eborn seconded.
