GZ /"**N A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF CHUBBUCK, A MUNICIPAL CORPORATION OF IDAHO, ALLOWING THE USE OF SAFE AND SANE FIREWORKS WITHIN THE CITY LIMITS OF THE CITY OF CHUBBUCK ON JULY 4, 2012, ONLY, FROM TWELVE O'CLOCK NOON UNTIL TWELVE O'CLOCK MIDNIGHT, WHEREAS, fire danger levels are extremely high within the boundaries of the City of Chubbuck; and WHEREAS, the Chubbuck City Council issued a resolution on June 29, 2012 prohibiting the discharge of fireworks within the corporate boundaries of the City of Chubbuck; and WHEREAS, the commitment of City resources for the containment and control of the Charlotte Fire has lessened to the extent that the City Fire Chief has advised the Council that the City's Fire Department has sufficient resources for fire prevention and suppression during the Fourth of July Holiday; and WHEREAS, in recognition of the Fourth of July holiday, the Chubbuck City Council, in conjunction with the Pocatello City Council, has determined that the discharge of safe and sane fireworks within the Chubbuck city limits should be permitted for a limited time period on July 4, 2012, only; and WHEREAS, the multiple occurrences of fires within the City limits of Chubbuck and Pocatello, and Bannock County have endangered the life, health and safety of the citizens of the City of Chubbuck; and NOW, THEREFORE, the City Council of the City of Chubbuck hereby resolves as follows: n /'IN, 1. That the discharge of safe and sane fireworks shall be permitted on July 4, 2012 only, between the hours of twelve o'clock noon and twelve o'clock midnight within the city limits the City of Chubbuck. 2. The burning of all open fires within the City of Chubbuck shall be prohibited until further notice. RESOLVED this � `° day of July, 2012. A disaster emergency exists with Bannock County, resulting in existing and imminent danger and danger to property. 2. Such disaster requires State assistance to supplement local efforts to protect rehabilitate and replace public property, and avert .and lessen the impact of the disaster; 3. The Bannock County Board of Commissioners requests that Governor of the State of Idaho, together with other appropriate State officials, make such declaration emd provide such assistance within Bannock County as are required and allowed by law. Adopted the 28th day of June, 2012 by those Commissioners subscribing their nwnes below. No. 2012 -78 FIRES AND USE OF FIREWORKS DUE TO FIRE DANGER._-) July 28, 2012 RESOLUTION WHERAS, the vegetation conditions in Bannock County are extremely dry; and WHEREAS, there have been several fires in the area in the past and severe wildfires throughout Bannock County; and WHEREAS, it is a commonly known fact that open fire and improper use of fireworks under such dry conditions can create'the potential for a fire; and WHEREAS, the Board of County Commissioners of Bannock County, Idaho, are granted authority under Idaho Code Section 39 -2602 to prohibit the use of fireworks and open fires in any unincorporated areas that constitute a severe fire threat based on the vegetative conditions during the fire season; and WHEREAS, under Idaho Code Section 31 -2227 the Bannock County Sheriff has the primary responsibility of enforcing all penal Statues of the State of Idaho; NOW, THEREFORE, BE IT RESOLVED that a motion was matte by Commissioner Howard Manwaring, seconded by Commissioner Karl E. Anderson, to ban all open fires and fireworks throughout Bannock County, beginning June 28, 2012 until further notice to insure public safety and avert possible fire danger. The motion passed and the voting was unanimous, as takers by roll call vote.
