A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF CHUBBUCK, A MUNICIPAL CORPORATION OF IDAHO, BANNING OPEN FIRES AND THE USE OF FIREWORKS DUE TO FIRE DANGER EFFECTIVE IMMEDIATELY UNTIL FURTHER NOTICE. WHEREAS, fire danger levels are extremely high within the boundaries of the City of Chubbuck; and WHEREAS, the multiple occurrences of fires within the City limits of Chubbuck and Pocatello, and Bannock County have endangered the life, health and safety of the citizens of the City of Chubbuck; and WHEREAS, Idaho Code §50 -310 empowers the City of Chubbuck to prevent the discharge of firearms, rockets, powder, fireworks or other dangerous, combustible or explosive material in the City; as follows: NOW, THEREFORE, the City Council of the City of Chubbuck hereby resolves 1. That the discharge of all fireworks, and the burning of all open fires are hereby prohibited within the City of Chubbuck effective June 28, 2012 until further notice to insure public safety and to avert possible fire danger. 2. This resolution shall remain in full force and effect until repealed by the City Council of the City of Chubbuck. RESOLVED this �9 V day of June, 2012. A disaster emergency exists with Bannock County, resulting in existing and imminent danger and danger to property. 2. Such disaster requires State assistance to supplement local -efforts to protect rehabilitate and replace public property, and avert and lessee the impact of the disaster; 3, The Bannock County Beard of Commissioners requests that Governor of the State of Idaho, together with other appropriate' State officials, make such declaradon and provide such assistance within Bannock County as are required and allowed by law. No. 2012 -78 FIRES AND USE OF FMEWORKS DUE TO FIRE DANGER } July 28, 2012 RESOLUTION WHERAS, the vegetation conditions in Bannock County are extremely dry; and WHEREAS, there have been several fires in the area in the past and severe wildfires throughout Bannock County; and WHEREAS, it is a cornmonly known fact that open fire and improper use of fireworks under such dry conditions can create the potential for a fire; and WHEREAS, the Board of County Commissioners of Bannock County, Idaho, are gauited authority under Idaho Code Section 39 -2602 to prohibit the use of fireworks and'open Tres in any unincorporated areas that constitute a severe fire threat based on the vegetative conditions during the fire season; and WHEREAS, under Idaho Code Section 31 -2227 the Bannock County Sheriff has the primary responsibility of enforcing all penal statues of the State of Idaho; NOW, THEREFORE, BE IT RESOLVED that a motion was made by Commissioner Howard Manwaring„ seconded by Commissioner Karl E. Anderson, to ban alt open fixes and fireworks throughout Bannock County, beginning June 28, 2012 until further notice to insure public safety and avert possible fire danger. However, the ban on the discharge of all fireworks and burning of all open fires is still in effect until further notice. Citizens are being urged to be aware of the existing dry conditions and lack of available resources to respond due to the extensive region -wide efforts at the Charlotte Fire. JAMES JOHNSTON GARY MOORE EVA JOHNSON NYE Pocatello Mayor Brian Blad and the City Council, as well as Chubbuck Mayor Steven England and the Chubbuck City Council, have decided to lift the ban on the sale of all fireworks within city limits. However, the ban on the discharge of all fireworks and the burning of all open fires is still in effect until further notice. City and County officials are strongly urging residents to be aware of the existing dry conditions. Citizens should also be aware of the lack of available resources to respond due to the extensive region -wide efforts at the Charlotte Fire. "Please, please, please show extreme caution given these conditions," said Mayor Brian Blad. "We all need to do our part to avert any further possible fire danger. I know I speak for our community when I say that our hearts are with the families affected by the tragic incident occurring in the Mink Creek, Gibson Jack, and Johnny Creek areas."
