HomeMy WebLinkAbout2009-011 Chubbuck & Hawthorne & Philbin Intersections1- CITY OF CHUBBUCK, IDAHO RESOLUTION No.11 -2009 WHEREAS, the Bannock Planning Organization, the Metropolitan Planning Organization that encompasses the City of Chubbuck, conducted a study and evaluation of certain street and intersection improvements; WHEREAS, the final report dated May 11, 2007 studied improvements for the Chubbuck and Hawthorne intersection and the Chubbuck and Philbin intersection; WHEREAS, the report recommended a stop light be utilized for the Chubbuck and Hawthorne intersection based upon the recommendations noting the number of accidents at the Chubbuck and Hawthorne intersection for the years 2001 through 2005 to be a total of seven accidents involving 14 vehicles, 26 people and one injury; WHEREAS, a similar analysis for the intersection at Chubbuck and Philbin for the same period of time, 2001 through 2005, showed a total number of accidents of 26 involving 21 vehicles, 84 people and 24 injuries; WHEREAS, the analysis by Bannock Planning Organization for the Chubbuck and Philbin intersection notes: "Traffic calming and safety tie together at this intersection. The current posted speed limit is 35 mph. Many complaints from local residences of the speed in the area have been registered with the County. A 2003 speed study showed the major street (Philbin) at the 85 percentile speed at 55 mph and West Chubbuck at 35 mph. This difference in a transitioning area can lead to accident problems. Over the period 2001 to 2005, 26 accidents occurred at the intersection and most of those were angle collisions. Roundabouts are very good at eliminating this type of accident due to the design. "; RESOLUTION Chubbuck 111809.roundaboutresoluti on mpd n n WHEREAS, the final recommendation for the Chubbuck and Philbin intersection was to install a two lane roundabout noting as justification that: This intersection does not have a capacity problem, but does have a history of high crash rates. The area is transitioning from rural to urban and the existing speeds must be controlled. The intersection will also provide a gateway to the City of Chubbuck. These issues are almost textbook reasons to consider a roundabout at an intersection. A single lane can work but to achieve the desired entrance and plan for the future, a two lane was considered a better option. "; WHEREAS, the City has chosen to follow the recommendation of Bannock Planning and has implemented a design for a two lane roundabout at the Chubbuck and Philbin intersection; WHEREAS, the City does hereby adopt the recommendations of Bannock Planning Organization for the Chubbuck and Philbin intersection improvement. WHEREAS, property has been acquired on three of the four corners for building of the roundabout; WHEREAS, the City contracted with Negotiation Services, LLC to pursue negotiations with Diane Bilyeu for the northeast corner of the intersection, the McNabb Family Limited Partnership for the southeast corner of the intersection and Clawsons for the southwest corner of the intersection; WHEREAS, the Negotiation Services, LLC has reported that it is unable to make any reasonable bargain for the taking of said real property necessary for the intersection or from Diane Bilyeu or to settle on the damages due her for use of that portion of her property needed for the intersection; WHEREAS, the property necessary for the intersection to be acquired from Diane Bilyeu is .336 acres; RESOLUTION chubbuck 1 11809.roundaboutresolution.wpd WHEREAS, the City has had the property appraised resulting in an appraised value for property in that area of $25,000 per acre plus damages for trees that will need to be removed to accommodate the improvement; WHEREAS, Negotiation Services, LLC reports all offers made by it for purchase of the property required for the improvement have been rejected; WHEREAS, Negotiation Services, LLC has recommended the City pursue condemnation of that portion of the Bilyeu property necessary to construct the intersection improvement. NOW, THEREFORE, BE IT RESOLVED by the Mayor and City Council of the City of Chubbuck as follows: The City Attorney is directed to file a complaint for condemnation of the Bilyeu property to acquire the .336 acres necessary to complete the Chubbuck and Philbin intersection improvement.
