HomeMy WebLinkAbout010.02.12City of Chubbuck Land Use and Development Commission Meeting Minutes October 2, 2012 - 7:00 p.m. Minutes of the Land Use and Development Commission regular meeting held at Chubbuck City Hall, 5160 Yellowstone, October 2, 2012. Chairman Peter Anderson: Commission Members: Rodney Burch, George Merrill, Jay Buttars, Morris Kinghorn, James Eborn, Jason Mendenhall. City Staff: Steve Smart, Paul Andrus, Sean Harris. Attorney: Tom Holmes. Secretary: Ranelle Simmons Chairman Anderson called the meeting to order at 7:00 p.m. Mendenhall led the commission in the Pledge of Allegiance. APPROVAL OF THE MINUTES: Anderson entertained a motion to approve the minutes as mailed. Mendenhall moved the minutes of August 7, 2012 meeting be approved as mailed; Kinghorn seconded. The full authority approved. GENERAL BUSINESS: REMINDER THAT ELECTION DAY IS TUESDAY NOVEMBER 6, 2012 SO THE NOVEMBER LAND USE MEETING WILL BE HELD ON TUESDAY OCTOBER 30, 2012 AT 7:00 PM. At the present time there is no business for the October 30th agenda. Unless there is business the meeting will be cancelled. DISCUSS THAT THE FIRST TUESDAY IN JANUARY 2013 IS JANUARY 1, NEW YEAR'S DAY. If there is business the meeting will be moved to January 2, 2013 otherwise it will be cancelled. REVIEW OF ORDINANCES FROM OTHER CITIES ON RESIDENTIAL ALLOWANCE OF BACKYARD BEES AND CHICKENS (HENS) Andrus had supplied the commission with copies of ordinances for bees and chickens from other cities in Idaho and elsewhere. There is nothing in the City of Chubbuck ordinances regarding bees. There have been hives in Chubbuck for years with no complaints. He further explained that a 20,000 square foot lot allows 25 hens, putting them in the livestock classification but there is nothing in the ordinances for a residential lot and chickens. Discussion and suggestions continued from the commissioners, staff and legal council: • There are other city's ordinances that allow 6 chickens on residential lots • 3 to 4 chickens will supply on average 1 to 2 dozen eggs per week • Eggs cannot be sold • Residents need to be informed if any changes are made • Maintenance enforcement be included J: \Planning \LUDC \LAND USE SECRETARY \Minutes \Minutes 2012 \10.2.12.docx 1 • How strong on the nuisance ordinance? • Leave ordinance the same with no changes • Make any changes as simple as possible • Should ducks, geese, rabbits and turkeys be included? • What are the liability concerns for the city? In conclusion the commission agreed that the Idaho Falls and Blackfoot ordinances for chickens seems to fit Chubbuck's needs the best. Making any changes to the ordinance regarding bee keeping does not need to be made at this time. Anderson's recommendation is to have Tom Holmes draft an amendment or ordinance for the commission to consider. Commission agrees. Anderson entertained a motion to adjourn; Mendenhall made the motion. Eborn seconded.
