Council Meeting Minutes
January 25, 2011
7:00 p.m.
Minutes of a regular council meeting held at the Chubbuck City Council Chambers, January 25,
2011. Present: Mayor Steven England, Council Members Josh Ellis, Kevin England, Kent
Kearns, Kermit Morrison, Attorney Thomas Holmes, Deputy Clerk Eric Jablonski, Public Works
Director Steve Smart.
Meeting was called to order at 7:OOpm by Mayor England.
Pledge of Allegiance to the Flag was led by Parker Johnson of BSA Troop 327.
Approval of Minutes - Mayor England asked for corrections and additions to the regular meeting
minutes of January 11, 2011.
Council Member Kearns moved to approve the regular meeting minutes of January 11, 2011.
Council Member Morrison seconded. Roll call vote: Ellis -yes, England -yes, Kearns -yes,
Morrison -yes.
Proclamation - Mayor England read the proclamation declaring February 5, 2011 as "National
Girls and Women in Sports Day." Council Member Kearns moved to approve the proclamation.
Council Member Morrison seconded and the full council approved. Upon approval the
proclamation was presented to Cynthia Pemberton.
Ordinance - Storm Water Quality Management Ordinance was read by title for the second time.
Ordinance 691 - Occupational Licenses Ordinance was read by title for the third time. Council
Member England moved to waive the rule requiring the ordinance to be read in full. Council
Member Morrison seconded. Roll call vote: Ellis -yes, England -yes, Kearns -yes, Morrison -yes.
Council Member Kearns moved to approve Ordinance 691 - Occupational Licenses Ordinance.
Council Member Morrison seconded. Roll call vote: Ellis -yes, England -yes, Kearns -yes,
Morrison -yes.
Resolution 2011 -3 Authorizing the donation of certain City Assets. Andy Despain, IT Director
provided additional information regarding the items being donated. Council Member England
moved to approve resolution 2011 -3. Council Member Kearns seconded. Roll call vote: Ellis -
yes, England -yes, Kearns -yes, Morrison -yes.
Water Facilities Planning discussion - Judicial confirmation hearing date will be on March 7,
2011 with Judge Nye regarding the water rights acquisition. We are now under contract for
design on the emergency generator for well 4.

Computer print -out claims for January 25, 2011 were presented to Mayor England and Council.
One item was questioned for proper coding and Andy Despain, IT Director provided additional
information to the council. Council Member Kearns moved to approve the computer print -out
claims as presented. Council Member England seconded. Roll call vote: Ellis -yes, England -yes,
Kearns -yes, Morrison -yes.
Resident, Boyd Byrd at 5036 Kevin, questioned if additional public notice is going to be given
regarding the judicial confirmation procedure. Attorney, Tom Holmes, provided the public
hearing information.
At 7:25pm Council Member Morrison moved to adjourn. Council Member England seconded
and the full council approved.
