ORDINANCE NO. 695
AN ORDINANCE OF THE CITY OF CHUBBUCK, IDAHO, AMENDING SECTION
15.04. 10 TO FORMALLY ADOPT THE PLUMBING AND ELECTRICAL CODES
AND TO PROVIDE FOR INSPECTION BY THE CITY BUILDING DEPARTMENT;
ADDING CHAPTER 15.08 ELECTRICAL CODE; ADDING CHAPTER 15.12
PLUMBING CODE. REPEALING PRIOR CONFLICTING ORDINANCES;
PROVIDING FOR THE SEVERABILITY OF THE PROVISIONS OF THIS
ORDINANCE; PROVIDING THAT ALL OTHER SECTIONS AND PROVISIONS OF
CHAPTER 15 NOT HEREIN AMENDED SHALL REMAIN IN FULL FORCE AND
EFFECT; AND PROVIDING WHEN THIS ORDINANCE SHALL BECOME
EFFECTIVE.
BE IT ORDAINED BY THE MAYOR AND COUNCIL OF THE CITY OF
CHUBBUCK, IDAHO:
Section 1. Amended Section 15.04.010. The following is adopted effective April 15,
2011:
15.04.010: BUILDING CODES ADOPTED: The approved editions of the following
nationally recognized codes, as adopted by the state of Idaho or the Idaho building code board
("board") are adopted as the official building codes of the city:
International building code, including all rules promulgated by the board to provide
equivalency with the provisions of the Americans with disabilities act accessibility
guidelines and the federal fair housing accessibility guidelines.
International energy conservation code.
International fire code and such appendices as have been or are from time to time adopted
by the state of Idaho acting through the department of insurance. For purposes of section
10 1. 1 insert "city of Chubbuck fire department" and for section 109.3, insert
"misdemeanor - $300.00 - 60 days".
International residential code, partes I-IV and IX.
National Electrical Code, 2008 Addition,and Appendix H.
Uniform Plumbing Code 2006 edition, and its appendices as follows:

The adopted versions of these codes shall be deemed superseded by successive versions
of such codes as they are adopted or approved by the board, effective on the date and such
codes are made effective by the board.
Any provisions of any such code that conflict with the personnel procedures and the
general employee policy of the city as it relates to the status of any employee and that
employee's due process rights or with Idaho Code sections 50-204 through 50-206
regarding appointed officers of the city shall not be applicable; state law and the
personnel policies of the city shall control those matter.

the building official is hereby authorized to utilized other nationally recognized safety
codes and standards as guidelines in determining_ applicable regulations.
Section 2. The following Chapter 15.08 is adopted effective April 15, 2011.
CHAPTER 15.08
ELECTRICAL CODE
15.08.010: APPLICABILITY OF CODES:
15.08.020: REGISTRATION LICENSE, BOND AND INSURANCE

ELECTRICAL CODE:
15.08.060: RIGHT TO INSPECT PREMISES:
15.08.010: APPLICABILITY OF CODES AND DEFINITION: All installations in the
city of wires and equipment to convey electric current and installations of apparatus to be
operated by such current, except as provided in this chapter, shall be in conformity with the
national electrical code as adopted in chapter 15.04 of this title. Electrical work shall include the
installation of electric wires, wire, fixtures, appliances or apparatus, or the addition to any wire,
fixture, appliance or apparatus, used or to be used on or in any building for the purpose of
transmitting electrical current for electric light, heat, and power, house annunciators, burglar
alarms, electrical bells, electric signal systems, fire and security alarm systems, classes 2 and 3
signaling circuits, key card operators, nurse call systems, motor and electrical apparatus controls,
lighting fixtures or the installation of electrical apparatus of any kind or description covered by
electrical codes as amended and adopted by the city and state of Idaho.
15.08.020: REGISTRATION, LICENSE, BOND AND INSURANCE
REQUIREMENTS: Electrical contractors are required to obtain a city business license. Prior
to commencement of any construction regulated by the national electrical code of this city code,
contractors must meet requirements for registration and insurance and bond coverage as set out
in Section 15.04.110.

15.08.030: PERMITS REQUIRED:
A. Prior To Commencement Of Work: Permits are required for electrical work as
defined herein. It shall be unlawful for any person to perform any work regulated thereby, or to
have such work performed on that person's behalf, unless and until a permit for such work has
been secured by a licensed contractor from the building department prior to the commencement
of the work.
B. Exceptions: Permits may be issued directly to a property owner performing
electrical work in the owner's primary or secondary residence or associated outbuildings, on
condition that the owner performs all the electrical work himself in compliance with standards,
rules, and regulations applicable to electrical work.
Railway companies, telegraph companies, telephone companies, cable television
companies and power companies shall not be required to obtain permits for electrical work on
their own generating systems, their own power distribution systems, or their own signaling
systems.
C. Electrical Contractor/Property Owner Responsibility: The electrical
contractor/property owner doing the work shall ensure that required permits have been obtained
prior to commencement of any work.
15.08.040: PERMIT FEES:
A. Applications for permits shall be accompanied by permit fees as set periodically
by resolution of the city council.
B. A double permit fee shall be charged and/or a misdemeanor citation shall be
issued if the contractor or property owner fails to acquire the necessary permits prior to
commencement of construction.
15.08.050: ADDITIONAL PROVISIONS AND EXCEPTIONS TO THE NATIONAL
ELECTRICAL CODE. The following exceptions are authorized to the provisions of the
national electrical code as adopted in chapter 15.04 of this title:
A. All wiring for electrical fixtures, appliances or apparatus for all commercial,
educational, institutional, and industrial buildings and structures shall be installed in approved
"raceways", busways, cable trays, or types MI, AC, and MC cables.
B. Flexible cord and plug connections shall not be allowed for required emergency
illumination equipment.
C. All low voltage wiring that operates at twenty five (25) volts or less, e.g.,
jukeboxes, coin operated amusement machines, low voltage power circuits, etc., in or on any
commercial or industrial building shall not be required to be installed in a UL approved raceway
unless specifically required by the manufacturer's installation instructions.
D. Electrical services for structures for which poured footings are required must have
a UFER ground consisting of at least twenty feet (20') of bare copper conductor sized in
accordance with table 250-66, but not smaller than no. 4, or other approved conductors.

E. Electrical contractors shall be required to install smoke detectors in accordance
with the international building code regulations for location and installation.
F. For purposes of administration and enforcement, the "authority having
jurisdiction" shall be the building official or any electrical inspector for the city of Chubbuck. In
addition, the following changes to article 80 of the national electrical code, administration and
enforcement, are hereby adopted:
1. That section 80.13(13) of said NEC shall read as follows:
"Whenever any installation subject to inspection prior to use is covered or
concealed without having first been inspected, the authority having jurisdiction
shall be permitted to require that such work be exposed for inspection. The
authority having jurisdiction shall be notified when the installation is ready for
inspection and shall conduct the inspection within two days."
2. That sections 80.15, 80.19(d), 80.19(f)-(4), 80.23(b)-(3), 80.27, and 80.35
be deleted and deemed not to be in effect for the city of Chubbuck
3. That section 80.29 Liability For Damages shall read as follows:
"Article 80 shall not be construed to affect the responsibility or liability of
any party owning, designing, operating, controlling, or installing any electric
equipment for damages to persons or property caused by a defect therein, nor shall
the city of Chubbuck or any of its employees be held as assuming any such
liability by reason of the inspection, re -inspection, or other examination
authorized."
15.08.060: RIGHT TO INSPECT PREMISES: In addition to the provisions of article 80
regarding enforcement of the national electrical code, the city electrical inspector, building
official, or other designated inspector shall have the right to enter any premises to inspect the
electrical work at any time while the work is being done.
Section 3. The following Chapter 15.12 is adopted effective April 15, 2011.
CHAPTER 15.12
PLUMBING CODE
15.16.010: APPLICABILITY OF CODES:
15.16.020: REGISTRATION, LICENSE, BOND AND INSURANCE

15.16.050: EXCEPTIONS AND ADDITIONAL PROVISIONS TO THE UNIFORM
PLUMBING CODE:
15.16.060: RIGHT TO INSPECT:
15.16.010: APPLICABILITY OF CODES: All work in the city pertaining to plumbing
installations, except as provided in this chapter, shall be in conformity with the Uniform
Plumbing Code approved by the International Association of Plumbing and Mechanical Officials

as adopted in chapter 15.04 of this title. Plumbing work shall include the installation, alteration,
repair or modification of water or service lines or fixtures or the performance of work covered by
the uniform plumbing code as amended and adopted by the city and state of Idaho.
15.16.020: REGISTRATION, LICENSE, BOND, AND INSURANCE
REQUIREMENTS: Prior to commencement of any construction regulated by the Uniform
Plumbing Code approved by the International Association of Plumbing and Mechanical Officials
as adopted in chapter 15.04 of this title, or the city code, provisions related to a city business
license and insurance and bond coverage as set out in section 15.04.110 of this title must be met.
15.16.030: PERMITS:
A. Required: Permits are required for plumbing work as defined herein. It shall be
unlawful for any person to perform any work regulated thereby, or to have such work performed
on that person's behalf, unless and until a permit for such work has been secured by a licensed
contractor from the building department prior to the commencement of the work. The plumbing
contractor/property owner doing the work shall ensure that required permits have been obtained
prior to commencement of any work.
B. Exceptions:
1. Permits may be issued to persons constructing, or doing work on, a single-
family or two-family dwelling unit if they own or are the contract purchaser of the land
and the residence.
2. Permits may be issued for work performed by sewer contractors, sewage
disposal contractors, or excavating or utility contractors who generally engage in the
business of installing, altering or repairing sewers, private and public sewage disposal
systems, and water distribution and/or drainage lines outside the foundation walls of any
building or structure.
15.16.040: FEES:

issued if the contractor or property owner fails to acquire the necessary permits prior to
commencement of construction.
15.16.050: EXCEPTIONS AND ADDITIONAL PROVISIONS TO THE UNIFORM
PLUMBING CODE ("UPC"):
A Materials:
1. In place of the provisions for materials in section 604.1 the following shall
apply: Cold water building supply piping from the property line to the building may be
type K copper, PE #PE3408, two hundred (200) pound test bearing AWWA label C901
blue in color, or schedule 40/80 PVC may be used to within three feet (3') of the building.
All under slab water lines must be type K copper or PE #PE3408, two hundred (200)

pound test bearing AWWA label C901. All above grade water lines within a structure
may consist of any material permitted by the UPC except the use of type M copper and
CPVC pipe shall be prohibited.
2. In place of provisions for materials in the Uniform Plumbing Code section
715.1 the following shall apply: A building/structure sewer line, beginning two feet (2')
from the building/structure shall be of cast iron, schedule 40 ABS DWV or schedule 40
PVC DWV.
B. Amendments:
Section 402.4 - Delete - metered faucets - optional only.
Section 418.0 - Pressure balance or thermostatic mixing valves not required for high-flow
(over 8 gpm) tub -filler valves with hand shower attached.
Section 508.5 - Exception - Water heater pans with minimum 1" drains may receive
discharge from 3/4" relief drains.
Section 609.10 - Requirements for water hammer arrestors shall not apply to residential
construction.
Table 6-5 - Change water supply fixture unit values for bathtub, combination bath/shower
and clothes washer from 4 fixture units each to 2 fixture units each.
Table 7-3 - Change drainage fixture unit demand for domestic clothes washer from 3
fixture units to 2 fixture units.
Table 7-5 - Change fixture unit loading value for "/2" horizon drainage piping from 1
fixture unit to 2 fixture units.
Section 710.9 - Exception - Sumps receiving discharge of more than one toilet room.
Section 807.4 - A domestic dishwashing machine may be installed without the use of an
air gap if the drain hose is looped to the bottom side of the countertop and secured properly.
Section 908 - A horizontal wet vent may be created provided it is created in vertical
position and all other requirements of section 908 are met.
Section 1002.3 - Change exception to allow for 180 degrees change of direction without
the use of additional cleanouts.
Chapter 11 - Roof drainage and subsoil drainage shall be required as specified in the
building code, and installed in accordance with the methods and materials of UPC chapter.
15.16.060: RIGHT TO INSPECT: The plumbing inspector, building official, or other
designated inspector shall have the right to enter any premises to inspect the plumbing
installations at any time while the work is being done.
Section 4. The following Section 5.04.120 and 5.04.130 are hereby adopted effective April 15,
2011:

5.04.120: DEFINITION OF CONSTRUCTION TRADE CONTRACTOR:
A "construction trades contractor" within the meaning of this chapter is a person, firm,
partnership, company, corporation, association, or any combination thereof who, for a fixed sum,
price, fee, percentage, or other compensation or combination thereof, performs work described in
the following subsections:
A. Builder: classes A-1, A-2 and B: Undertakes with, or for, another to build,
construct, alter, repair, add to, or demolish any building or structure or any portion thereof, who
performs such types of work as repair/maintenance/installation of siding, windows, roofing, title,
carpet, cabinets, counters, sprinkler systems, water and sewer lines, sheetrock, concrete work,
paint, and plaster, and the like, or who, without compensation, builds, constructs, alters, adds to
or demolishes any buildings or structure either or his own or other property for the purpose of
resale or rental.
Exception: A person may construct one personal primary residence for himself in any
three (3) year period commencing with the date of the certificate of occupancy of the
residence without being considered a contractor and being required to obtain a license as
a contractor.
1. A Class 1 builder is one who engages in the construction, demolition,
alteration or repair of commercial structures.
2. A Class A-2 builder is a person who engages in the construction,
demolition, alteration or repair of any type or size of one and two family structures or
structures accessory to such residential structures.
C. A Class B builder is a person engaging in limited construction trade work
which does not involve construction of a structure itself including, but not limited to,
such types of work as repair, maintenance or installation of siding, windows, roofing, tile,
carpet, cabinets, counters, sprinkler systems, water and sewer lines, sheetrock, patio
covers, porches, decks, certain sunrooms, small sheds, small detaches garages, concrete
work, paint, plaster work and the like.
B. Electrical contractor: One who installs electric wires, wire, fixtures, appliances or
apparatus, or the addition to any wire, fixture, appliance or apparatus, used or to be used on or in
any building for the purpose of transmitting electrical current for electrical light, heat, and power,
house annunciations, burglar alarms, electric bells, electric signal systems, fire and security alarm
systems, classes 2 and 3 signaling circuits, key card operators, nurse call systems, motor and
electrical apparatus controls, lighting fixtures or installing electrical apparatus of any kind or
description covered by electrical codes as amended and adopted by the city and the state of Idaho.
C. Excavator: Performs work either on private property for foundations or
installation of water or sewer lines or excavation work in right of way.
D. Gas fitter/mechanical contractor: Engages in installation of gas piping, venting
and equipment.
E. House mover: Moves buildings of structures upon or across the public rights of
way of the city.

F. Plumbing contractor: Installs, alters, repairs, or modifies water or sewer lines or
fixtures, or performs any work covered by the Uniform Plumbing Code as amended and adopted
by the city and the state of Idaho.
G. Sign contractor: One who engages in painting, installation, erection, or
construction of signs or sign display structure.
5.04.130. BOND AND LIABILITY INSURANCE REQUIREMENTS. Any holder of a
Chubbuck business license that is a construction trades contractor as defined in Section 5.04.120
above performing such services shall be required to obtain and maintain workers' compensation
insurance for each employee hired by such contractor, and to certify in writing that he will obtain
and maintain such coverage. Proof of the following specific insurance and bond coverage is a
prerequisite to holding a business license or obtaining a permit from the Building Official.
ADMINISTRATIVE PROVISIONS
Section 1. Repeal of Conflicting Ordinances. The provisions of any Ordinance of the
City of Chubbuck, Idaho, and any provision of the Chubbuck Municipal Code which are in
conflict with the provisions of this Ordinance are hereby repealed to the extent of such conflict.
All other sections and provisions of Chapter 15 not herein amended shall remain in full force and
effect.

ADMINISTRATIVE PROVISIONS
Section 1. Repeal of Conflicting Ordinances. The provisions of any Ordinance of the
City of Chubbuck, Idaho, and any provision of the Chubbuck Municipal Code which are in
conflict with the provisions of this Ordinance are hereby repealed to the extent of such conflict.
All other sections and provisions of Chapter 15 not herein amended shall remain in full force and
effect.

Section 2. Severability. If any provision of this ordinance is held invalid, for any reason,
by any court of competent jurisdiction, such holding shall not affect the validity or enforceability
of any of the remaining provisions.
Section 3. Effective Date. The rule requiring an ordinance to be read on three separate
days, one of which shall be a reading in full, is hereby dispensed with, and this Ordinance shall
become effective upon its passage, approval and publication as provided by law.

SUMMARY OF ORDINANCE NO. 695
An ordinance of the City of Chubbuck, a municipal corporation of the state of Idaho,
amending section 15.04. 10 to formally adopt the plumbing and electrical codes and to provide
for inspection by the city building department; adding chapter 15.08 electrical code; adding
chapter 15.12 plumbing code; providing for the repeal of conflicting ordinances; providing that
all other provisions of Chapter 15.04 not amended shall remain in effect; providing for the
severability of the provisions of this ordinance; providing that this ordinance shall be in effect
after its passage, approval and publication.

State Journal. As we discussed, you couldn't send this off for publication until we knew
