HomeMy WebLinkAbout0686 Amendment to Ordinance 15.54.070 2010CITY OF CHUBBUCK, IDAHO ORDINANCE NO. 686 AN ORDINANCE OF THE CITY OF CHUBBUCK, IDAHO, AMENDING SECTION 15.54.070 (E) ADOPTED BY ORDINANCE 680 TO MAKE A TECHNICAL CORRECTION FOR A PHRASE OMITTED IN THE ORDINANCE; REPEALING PRIOR CONFLICTING ORDINANCES; PROVIDING FOR THE SEVERABILITY OF THE PROVISIONS OF THIS ORDINANCE; PROVIDING THAT ALL OTHER SECTIONS OF CHAPTER 15.54 NOT AMENDED SHALL REMAIN IN EFFECT; AND PROVIDING WHEN THIS ORDINANCE IS EFFECTIVE. BE IT ORDAINED BY THE MAYOR AND COUNCIL OF THE CITY OF CHUBBUCK, IDAHO: Section 1. Section 15.54.070 (E) is amended to correct an omission made in the paragraph when Ordinance 680 was adopted, said section to read as follows: 15.54.070: SPECIFIC STANDARDS: In all areas of special flood hazard where Flood Protection Elevation data has been provided as set forth in section 15.54.020 or subsection 15.54.050(B) of this chapter, the following provisions are required: A. Residential Construction: New construction and substantial improvement of any residential structure shall have the lowest floor, including basement, elevated to or above the Flood Protection Elevation Fees (FPE). 2. Fully enclosed areas below the lowest floor that are subject to flooding are prohibited, or shall be designed to automatically equalize hydrostatic flood forces on exterior walls by allowing for the entry and exit of floodwaters. Designs for meeting this requirement must either be certified by a registered professional engineer or architect or must meet or exceed the following minimum criteria: a. A minimum of two (2) openings having a total net area of not less than one square inch for every square foot of enclosed area subject to flooding shall be provided. b. The bottom of all openings shall be no higher than one foot (1) above grade. C. Openings may be equipped with screens, louvers, or other coverings or devices provided that they permit the automatic entry and exit of floodwaters. B. Nonresidential Construction: New construction and substantial improvement of any commercial, industrial or other nonresidential structure shall either have the lowest floor, including basement, elevated to the level of the flood protection; or, together with attendant utility and sanitary facilities, shall: Ordinance - Page 1 ch u b bu ck042810ordamen d i n gerroron680.wpd 1. Be floodproofed so that below the flood protection level of the structure is watertight with walls substantially impermeable to the passage of water. 2. Have structural components capable of resisting hydrostatic and hydrodynamic loads and effects of buoyancy. 3. Be certified by a registered professional engineer or architect that the design and methods of construction are in accordance with accepted standards of practice for meeting provisions of this subsection B based on their development and/or review of the structural design, specifications and plans. Such certifications shall be provided to the official as set forth in subsection 15.54.050(C)(2) of this chapter. 4. Nonresidential structures that are elevated, not floodproofed, must meet the same standards for space below the lowest floor as described in subsection A2 of this section. 5. Applicants floodproofing nonresidential buildings shall be notified that flood insurance premiums will be based on rates that are one foot (F) below the floodproofed level (e.g., a building constructed to the base flood level will be rated as 1 foot below that level). C. Manufactured Homes: All manufactures homes to be placed or substantially improved within zones Al, 30, AH, and AE shall be elevated on a permanent foundation such that the lowest floor of the manufactures home is at or above the flood protection elevation (FPE) and by securely anchored to an adequately anchored foundation system in accordance with the provisions of subsection 15.54.060(A) of this chapter. D. Recreational Vehicles: Recreational vehicles placed on sites are required to either: Be on the site for fewer than 180 consecutive days, (or) 2. Be fully licensed and ready for highway use, on wheels or jacking system, attached to the site only by quick disconnect type utilities and security devices, and have not permanently attached additions, or Meet the requirements of MANUFACTURED HOME SECTION above and the elevation and anchoring requirements for manufactured homes. E. Ae and Al -30 Zones with Flood Protection Elevations but No Floodways: In areas with Flood Protection Elevations (but a regulatory floodway has not be (including fill) shall be permitted within Zones Al -30 and AE on the community's FIRM, unless, it is demonstrated that the cumulative effect of the proposed development, when combined with all other existing and anticipated development, will not increase the water surface elevation of the base flood more than one foot at any point within the community. The provisions of any Ordinance of the City and any provision of the Municipal Code which are in conflict with the provisions of this Ordinance are repealed to the extent of such conflict. All other sections of Chapter 15.54 not herein amended shall remain in effect. Section 2. Severability. The sections of this ordinance are severable. The invalidity of a section shall not affect the validity of the remaining sections. Section 3. Effective Date. The rule requiring an ordinance to be read on three separate days, one of which shall be a reading in full, is dispensed with, and this Ordinance shall become effective upon its passage, approval and publication.
