AN ORDINANCE OF THE CITY OF CHUBBUCK, IDAHO, ANNEXING CERTAIN
LANDS TO BE INCLUDED WITHIN THE BOUNDARIES AND JURISDICTIONAL
LIMITS OF THE CITY OF CHUBBUCK, IDAHO; SPECIFYING THE ZONING
CLASSIFICATION WHICH SHALL BE APPLIED TO SAID LANDS NEWLY
ANNEXED TO THE CITY OF CHUBBUCK; DIRECTING THE CHUBBUCK CITY
CLERK TO RECORD THE ORDINANCE WITH BAI`v' -vOCK COUNTY; REPEALING
PRIOR CONFLICTING ORDINANCES; PROVIDING FOR THE SEVERABILITY OF
THE PROVISIONS OF THIS ORDINANCE; AND PROVIDING WHEN THIS
ORDINANCE SHALL BECOME EFFECTIVE.
BE IT ORDAINED BY THE MAYOR AND COUNCIL OF THE CITY OF
CHUBBUCK, IDAHO:
Section 1. Annexation. The following described lands, located within Bannock County
and contiguous to the existing boundaries of the City of Chubbuck, Idaho are hereby annexed and
included within the boundaries and jurisdictional limits of the City of Chubbuck, Idaho:
Matt & Linda Clawson, 14051 W. Chubbuck Rd. - See attached Exhibit for legal
description.
Section 2. Zoning. The above-described lands newly annexed to the City of Chubbuck,
Idaho, shall be subject to the zoning classification of R-2, Limited Family Residential.
Section 3. The Chubbuck City Clerk is hereby directed to cause the ordinance to be
recorded in the records of Bannock County.
ADMINISTRATIVE PROVISIONS
Section 1. Repeal of Conflicting Ordinances. The provisions of any Ordinance of the
City of Chubbuck, Idaho, and any provision of the Chubbuck Municipal Code which are in
conflict with the provisions of this Ordinance are hereby repealed to the extent of such conflict.
Section 2. Severability. If any provision of this ordinance is held invalid, for any reason,
by any court of competent jurisdiction, such holding shall not affect the validity or enforceability
of any of the remaining provisions.

Section 3. Effective Date. The rule requiring an ordinance to be read on three separate
days, one of which shall be a reading in full, is hereby dispensed with, and this Ordinance shall
become effective upon its passage, approval and publication as provided by law.

EXHIBIT "A"
A tract of land in the NE 1/4, NE 1/4 of Section 8, Township 6 South, Range 34 East, Boise Meridian, a
portion of the land described in Instrument No. 740658, more particularly described as follows:
Beginning at the Northeast corner of Section 8, Township 6 South, Range 34 East, Boise Meridian,
thence South 89°43'16" West along the North line of Section 8 for a distance of 469.58 feet; thence
South 00°39'27" East, 371.05 feet; thence North 89°43'16" East, 469.58 feet to a point on the East line
of said Section 8; thence North 00°39'27" West, 371.05 feet to the Point of Beginning.
Excepting a 25' prescriptive right of way along the North (Chubbuck Road) and East (Philbin Road) sides
of the above described parcel.
