HomeMy WebLinkAbout0650 Sanitation Services 2007CITY OF CHUBBUCK, IDAHO ORDINANCE NO. 6 5 0 AN ORDINANCE OF THE CITY OF CHUBBUCK, IDAHO, AMENDING SECTION 13.28.030 TO CLARIFY THAT ALL GARBAGE WITHIN THE CITY SHALL BE COLLECTED BY THE CITY; REPEALING PRIOR CONFLICTING ORDINANCES; PROVIDING FOR THE SEVERABILITY OF THE PROVISIONS OF THIS ORDINANCE; PROVIDING THAT ALL OTHER SECTIONS AND PROVISIONS OF CHAPTER 13.28 NOT HEREIN AMENDED SHALL REMAIN IN FULL FORCE AND EFFECT; AND PROVIDING WHEN THIS ORDINANCE SHALL BECOME EFFECTIVE. BE IT ORDAINED BY THE MAYOR AND COUNCIL OF THE CITY OF CHUBBUCK, IDAHO: Section 1. Section 13.28.030 is amended as follows: 13.28.030 Mandatory Collection; Responsibility For Fees: A. All garbage from the entire residential sectio City, both residential and commercial, shall be collected by the City or its duly authorized agent or contractor as often as is necessary to maintain and preserve the health of the community. Temporary failure to make such collection due to circumstances beyond the control of the City shall not relieve the occupant or owner of the premises from the payment of sanitary service fees hereinafter provided for. B. No person shall be permitted to refuse to accept the sanitary service herein provided for and the failure of any person to receive such service shall not exempt such person from the payment of charges herein provided for, save and except any of those persons residing in areas in which no waste collection service is provided for the entire area, and in such areas where no service is rendered by the City, no charge will be made. The boundaries within the City exempted from such charges shall be established by the Engineer with the consent and approval of the City Council. C. From and after July 1, 1979, all properties, buildings or residences within the City of Chubbuck shall be subscribed by their owners or occupants to the sanitary service system (garbage collection system) of the City and such owners or occupants shall pay the fees Ordinance - Page 1 chubbuck103007ord.wpd W therefor. The City Council may waive this requirement only upon written application and showing of substantial hardship or other good cause. ADMINISTRATIVE PROVISIONS Section 1. Repeal of Conflicting Ordinances. The provisions of any Ordinance of the City of Chubbuck, Idaho, and any provision of the Chubbuck Municipal Code which are in conflict with the provisions of this Ordinance are hereby repealed to the extent of such conflict. All other sections and provisions of Chapter 13.28 not herein amended shall remain in full force and effect. Section 2. Severability. If any provision of this ordinance is held invalid, for any reason, by any court of competent jurisdiction, such holding shall not affect the validity or enforceability of any of the remaining provisions. Section 3. Effective Date. The rule requiring an ordinance to be read on three separate days, one of which shall be a reading in full, is hereby dispensed with, and this Ordinance shall become effective upon its passage, approval and publication as provided by law.
