HomeMy WebLinkAbout007.03.12City of Chubbuck Land Use and Development Commission Meeting Minutes July 3, 2012 - 7:00 p.m. Minutes of the Land Use and Development Commission regular meeting held at Chubbuck City Hall, 5160 Yellowstone, July 3, 2012. Chairman Pete Anderson: Commission Members: Rodney Burch, George Merrill, Morris Kinghorn, James Eborn, Ron Horner, Jason Mendenhall, Bryan Nield. City Staff: Paul Andrus, Sean Harris. Attorney: Tom Holmes. Secretary: Ranelle Simmons Chairman Anderson called the meeting to order at 7:00 p.m. Anderson asked if any commissioners had a conflict of interest within the items before the board tonight. Burch led the commission in the Pledge of Allegiance. APPROVAL OF THE MINUTES: May 1, 2012 Anderson entertained a motion to approve the minutes as mailed. Kinghorn moved the minutes of May 1, 2012 meeting be approved as mailed; Mendenhall seconded. The full authority approved. PUBLIC HEARING 1. An application by Sydney Wood and Dean Wilde, 3433 Alturas, Pocatello, ID 83201, for a Conditional Use Permit for an RV /Boat Storage Facility. The property is located on the south side of East Chubbuck Road in the 400 block, 320 feet east of the Union Pacific railroad. Syd Wood, 3433 Alturas, Pocatello, ID 83201 one of the owners of the property was here representing the application. A 2 acre outside RV storage facility that will be set back from East Chubbuck Road is being proposed. Screen fencing on 3 sides and next to the Parrish tie yard will also be fenced. This land is a long unused pasture that will be converted to a used area. Screening fences will help minimize the impact with the neighborhood behind. Grooming of the lot will help the appearance. The average traffic in and out of this type of facility is 2 % trip per RV a year. Anderson asked if the commission had any questions for Wood. Kinghorn asked if any portion of the storage facility would be covered. It will be an open air facility with compacted gravel. Holmes asked what the design of the screening fence will be. Will probably be chain link fence with slats. Merrill asked if there will be any type of lighting. Is still being decided and is only a possibility. Horner asked what type of gate and would it be powered. The type of gate has not been decided. There is a possibility of having a gate keeper. Horner asked what the 20' setback area will be. A gravel Swale with a vegetation spray. Kinghorn asked what kind of security will be installed. If there is no power how will the gate be opened? Fence will be the security and the gate keeper will meet the clients to let them into the storage area. Eborn wanted clarification on the number of units. 80 to 100 is an estimate. City staff had no comments. Mendenhall asked for the location of the closest water source. Wood pointed out the closest fire hydrant on the overhead projected design layout. Is the front land just going to be dirt? What will be parked just RV and boats? Will cars that don't run be allowed to park in the facility? Dust will be an issue. David Hutchinson, 1147 Holman, Pocatello ID. What is the zoning? Anderson answered it is Industrial to the west, R -2 to the south, R -2 to the east C -1 on north side of Chubbuck Road. How high will the fence be? Holmes answered 6' but the city can ask for higher. Sharon Phillips, 476 East Chubbuck Road. She is concerned with security issued if no lighting is installed. Traffic concerns because the traffic turning into the railroad tie yard can back up and stop traffic on East Chubbuck Road. David Hutchinson, 1147 Holman, Pocatello, ID asked for an explanation of a Conditional Use Permit. Anderson explained. No further comment. Anderson closed the public hearing. Syd Wood addressed the questions from the public hearing: The lease the client will sign has been drafted to include if a vehicle is not being taken care of it will be towed and stored in another location at the owner's expense. There will be compacted gravel on the access road and the storage area. Cost for security in an open air facility is difficult making it harder to be profitable. Traffic will be alleviated because of the long lane before getting to the gate bringing the RVs off of East Chubbuck Road before accessing the storage area. Anderson asked if the Commission had any questions. Eborn asked for width of the access road. Wood believes it is 25'. Anderson asked Wood if he would have an objection to having a condition on the application of all vehicles on the yard being functional and working vehicles. Wood did not have an objection to the condition. Anderson brought the meeting back to commission for discussion. Burch asked Andrus if the access to the site is a typical urban approach not a radius approach. Yes, curb cut was approved by Design Review. Eborn asked about the Swale being able to handle the stormwater run off. Andrus stated the business would need to follow city code. Kinghorn discussed would lighting help the security. Horner discussed a security camera because of the neighborhood. Burch commented security is a business decision not a commission decision. Eborn commented about the foot traffic not being secure. Burch noted the application is for recreational vehicles. Commission need to put a limit on units. The 2 way access road is important. He's concerned with the typical urban approach not being adequate in this case. Kinghorn stated where his RV is stored it is a gravel access and it is fine. Holmes asked Andrus if Design Review had addressed dust control. Design Review felt compacted gravel should take care of the dust issue. Burch asked about signage. Woods states one sign near East Chubbuck Road, it will be low and mounted on the fence. Wood continued, dust would be controlled because all vehicles would be moving very slowly and a dust retardant will be sprayed. Wood explained that a radius curb would make this project too expensive. Anderson agrees with Burch on the curb cut needing to be a radius approach, very concerned with vehicles turning off of East Chubbuck Road into the facility. Burch asked Andrus if zoning is industrial to the west and that it is a platted subdivision. Andrus confirmed the zoning map shows industrial and it is platted. Eagle Road has not been built. Commission discussed a list of conditions to include in the motion. Anderson entertained a motion. Burch made a motion to approve the Conditional Use Permit application by Sydney Wood and Dean Wilde, 3433 Alturas, Pocatello, ID 83201, for a Conditional Use Permit for an RV /Boat Storage Facility located on East Chubbuck Road with the following conditions applied: • Site limited to only storing recreational vehicles and boats • Total number of units not to exceed 85 • Access road from East Chubbuck Road to the 2 acre site be a minimum of 2 lanes • Applicant be required to deal with any dust abetment issues on the access road and storage facility • Solid fence be required on the north, east and south sides and a privacy fence required on the west side • 30 foot radius approach be required to be constructed on East Chubbuck Road at the location selected by the applicant for the access road • Site comply with all other city ordinances for this type of facility Holmes suggested changing the wording from privacy fence on the west side to screening fence because that is the definition in the ordinance. Mendenhall seconded the motion. Anderson asked for any discussion of the motion. Burch commented that a time frame may want to be included. Eborn suggested 3 year time frame and a return to commission to readdress. Burch added to the motion a 3 year time frame. Mendenhall agreed and seconded the motion with the addition of the time frame. Anderson explained this action is Land Use Commission approval. Roll Call Vote: Burch, Yes; Merrill, Yes; Kinghorn, Yes; Eborn, Yes; Horner, Yes; Mendenhall, Yes; Anderson, Yes. Motion carries. Applicant has the right to appeal to City Council within 25 days of this meeting. 2. An application by Matthew Schiffman and Wade Barker, 3800 Northern Lights, Pocatello, ID 83201 for Chubbuck Meadows Subdivision Preliminary Plat. The property is located SE %, NE Y4, Sec 4, T6S, R34E, BM, Bannock County on Homestead Street, Chubbuck, ID 83202. No one was in attendance to represent the application to the Land Use Commission. Mendenhall made a motion to table until applicant is present. Kinghorn seconded. Motion carries. Eric Allen, 502 Homestead Chubbuck, ID 83202 was in attendance to hear the preliminary plat application for Chubbuck Meadows Subdivision. Andrus has had inquiries regarding city code for animals in city limits. Idaho Falls and Boise are 2 cities that have changed their ordinance. Should commission discuss or leave as is. Anderson suggested Andrus get copies of the new ordinance from other cities for commission to review. Anderson entertained a motion to adjourn; Eborn made the motion.
