HomeMy WebLinkAbout03 23 2010 CM 35 COUNCIL MEETING MINUTES March 23, 2010 Minutes of a regular meeting held at the Chubbuck City Council Chambers, March 23, 2010. Present: Mayor Steven M. England, Council members Kent Kearns, Kermit G. Morrison, Kevin England, Joshua D. Ellis, Attorney Thomas J. Holmes, Public Works Director Steven M. Smart and City Clerk Ron C. Conlin. Meeting was called to order at 7:30 p.m. by Mayor England. PLEDGE ALLEGIANCE TO THE FLAG was led by Cory Brown, Troop #361 and Keaton Brown, Troop #131. st INVOCATION was given by Bishop Michael Stevens, Chubbuck 1 Ward, Chubbuck Stake, The Church of Jesus Christ of Latter-Day Saints. APPROVAL OF MINUTES - Mayor England asked for corrections and additions to the regular meeting minutes of March 9, 2010. Councilman Kearns moved to approve the regular meeting minutes of March 9, 2010 with additions on Page 27, Paragraph 9 and Paragraph 13, Councilman Morrison seconded. Roll Call Vote: Kearns, yes; Ellis, yes; England, yes; Morrison, yes. PUBLIC HEARING - An application by Jay Roche, 435 Maysi Lane, Inkom, Idaho 83245 for Colby Estates Preliminary Plat. The property is located at the northwest corner of Homestead and Hawthorne Roads. Rodney Birch, RMES, 4741 Afton Street presented the Colby Estates Preliminary Plat. Mayor England declared the public hearing open asking for comments in favor of, neutral and in opposition. There being no comment Mayor England declared the public hearing closed. Councilman Kearns moved to accept the Land Use & Development Commission’s recommendations to approve the Cobly Estates Preliminary Plat as presented, Councilman England seconded. Roll Call Vote: Morrison, yes; England, yes; Ellis, yes; Kearns, yes. 37 COUNCIL MEETING MINUTES - (cont.) March 23, 2010 ORDINANCE - Adding Section 18.12.070 power generating windmill; providing supplemental controls and guidelines relating to the issuance of a conditional use permit. Second reading by title only. Attorney Holmes read proposed ordinance by title only for the second reading. Councilman Kearns stated he continues to have concern of windmills being allowed in residential zones. Councilman Kearns suggested we step back and try to come up with a more creative way for placement of windmills. Discussion about the maximum noise level of 55 decimals, and how it will affect residential zones. PWD Smart stated he will prepare something for the next meeting regarding the 55 decimal. PWD Smart stated the Land Use & Development Commission developed this proposed ordinance in a three to five month period. They reviewed all information that was available to us. This is the second reading by title only, Council tabled the proposed ordinance until the April13, 2010 Council Meeting. INTERGOVERNMENTAL TRANSFER OF PROPERTY - Police Chief Randy Severe proposed the City of Chubbuck sell two 2004 Police Vehicles to the City of American Falls for $6,000. Councilman Morrison moved to approve the Intergovernmental Transfer of Property Agreement for the sell of two 2004 Police Vehicles to the City of American Falls in the amount of $6,000, Councilman Ellis seconded. Roll Call Vote: Kearns, yes; Ellis, yes; England, yes; Morrison, yes. 2009 FIRE DEPARTMENT ANNUAL REPORT - Fire Chief Eric King presented the 2008-2009 Chubbuck Fire Department Year End Review. (Attached). CLAIMS - Computer print-out claims presented to Mayor England and Council. Councilman Morrison moved to approve computer print-out claims as presented, Councilman England seconded.
