HomeMy WebLinkAbout07 22 2008 CM 81 COUNCIL MEETING MINUTES July 22, 2008 Minutes of a regular council meeting held at the Chubbuck City Council Chambers, July 22, 2008. Present: Mayor Steven M. England, Council members Kent Kearns, Dennis Stoddard, Kermit G. Morrison, Rebecca Ponkow, Attorney Thomas J. Holmes, Public Works Director Steven M. Smart and City Clerk Ron C. Conlin. Meeting was called to order at 7:30 p.m. by Mayor England. PLEDGE ALLEGIANCE TO THE FLAG was led by Mitchell Kmetz, Boy Scout Troop #317. INVOCATION was given by Bishop Timothy Kmetz, Chubbuck Mountain Park Ward, The Church of Jesus Christ of Latter-Day Saints. APPROVAL OF MINUTES - Mayor England asked for corrections and additions to the regular meeting minutes of July 8, 2008. Councilman Kearns moved to approve the regular meeting minutes of July 8, 2008 as read, Councilman Morrison seconded. All council members voted in favor of motion. APPEAL OF A DENIAL OF A BEHAVIORAL/MENTAL HEALTH EMPLOYEE APPLICATION - MARSHA TURGOOSE - Police Chief Randy Severe sent a letter to Ms. Turgoose informing her, her application for a Behavioral/Mental Health License in the City of Chubbuck has been denied due to information revealed during the completion of her background check and her failure to disclose all information on the application. The denial is based specifically on a guilty of possession of a controlled substance conviction, January, 2002 and her failure to disclose the above charges on her application. Ms. Turgoose explained she did not think she was charged with the possession charge at that time, that is why she did not include it on the application. Police Chief Severe explained why the application was denied. PC Severe stated if the conviction is within the last ten years of the date of the application, the application can be denied. This has been six years. PC Severe stated Ms. Turgoose has not had anything of concern since. Ms. Turgoose stated she is working for Children’s Support Services, 4650 Hawthorne Road. 83 COUNCIL MEETING MINUTES - (cont.) July 22, 2008 APPEAL OF A DENIAL OF A BEHAVIORAL/MENTAL HEALTH EMPLOYEE APPLICATION - MARSHA TURGOOSE - Councilman Kearns moved to grant Marsha Turgoose a temporary Behavioral/Mental Health Employee license to Marsha Turgoose with condition Marsha Turgoose pay for, and have a background check completed every six months until the conviction for possession of control substance is nine and a half years past, Council member Ponkow seconded. Roll Call Vote: Kearns, yes; Stoddard, yes; Morrison, yes; Ponkow, yes. ORDINANCE #657 - Providing for a change of Land Use District with respect to certain lands within the boundaries of the City of Chubbuck; declaring such change in Land Use District is compatible with the City’s Comprehensive Plan. Attorney Holmes read Ordinance #657 by title only for the second and final reading. Councilman Stoddard moved to dispense with the rule of reading Ordinance #657 on three separate days, one of which shall be a reading in full, Councilman Morrison seconded. Roll Call Vote: Kearns, yes; Stoddard, yes; Morrison, yes; Ponkow, yes. Councilman Stoddard moved to adopt Ordinance #657 as read, Councilman Kearns seconded. Roll Call Vote: Kearns, yes; Stoddard, yes; Morrison, yes; Ponkow, yes. ORDINANCE - Providing for sewer connection fees in those areas of Bannock County lying within the Chubbuck Area of City Impact; providing for when those fees are applicable to lands annexed to the City of Chubbuck, providing for the applicability of those fees to new construction; providing for a reduced fee for existing development. Mayor England and Attorney Holmes read ordinance in full for the first reading. PWD Smart gave a report on the proposed ordinance. Discussion about connection fees. th Council tabled the ordinance until the August 12, 2008 Council Meeting. CLAIMS - Computer print-out and additional claims presented to Mayor England and Council. After review, Councilman Kearns moved to approve computer printout and additional claims as presented, Councilman Stoddard seconded. All council members voted in favor of motion.
