Minutes of a regular meeting held at the Chubbuck City Council Chambers, October 9, 2007.
Present: Mayor Steven M. England, Council members Leroy S. Quick, Kent Kearns, Dennis
Stoddard, Richard Morgan, Attorney Thomas J. Holmes, Public Works Director Steven
M. Smart and City Clerk Ron C. Conlin.
Meeting was called to order at 7:30 p.m. by Mayor England.
PLEDGE ALLEGIANCE TO THE FLAG was led by Council member Richard Morgan.
APPROVAL OF MINUTES - Mayor England asked for corrections and additions to the regular

meeting minutes of September 25, 2007.

Councilman Kearns moved to approve the regular meeting minutes of September 25,
2007 as read, subject to a correction on Page 183, Paragraph 5, (Councilman Morgan
voted no on the Disposal of City Property - Josh Ellis), Councilman Stoddard seconded.
All council members voted in favor of motion.
PUBLIC HEARING - An application by Randon & Elizabeth Renzello, 4464 Deer Ave,
Chubbuck Idaho for a preliminary plat for Renzello Subdivision.
The applicant nor a representative was present.
Councilman Morgan moved to table the public hearing until a representative is present,
Councilman Stoddard seconded. All council members voted in favor of motion.
APPEAL - Denial of a day care facility license to Dawn Renee Cook, 125 Toponce, Pocatello,
Idaho.
Dawn Renee Cook nor a representative was present.
Councilman Stoddard moved to table the appeal until Dawn Renee Cook or a
representative can be present, Councilman Morgan seconded. All council members voted
in favor of motion.
KAYLEE ESTATES SUBDIVISION FINAL PLAT - Bryce Jolley, Harper-Leavitt Engineering,
Blackfoot, Idaho presented Kaylee Estates Subdivision Final Plat. Mr. Jolley stated this is
the final stage of a four lot subdivision.

KAYLEE ESTATES SUBDIVISION FINAL PLAT - (cont.)
PWD Smart stated the developer has requested a waiver of curb, gutter and sidewalk
requirement on both Hawthorne and Homestead Roads. Staff recommends Council waive
the the curb, gutter and sidewalk requirement on Hawthorne Road and require the
Homestead Road curb, gutter and sidewalk. PWD Smart stated there is about a 10'
difference in the property pins, the two subdivisions do not match at this time. PWD
Smart stated the Land Use & Development Commission recommended the gap between
the two subdivisions be resolved, prior to approval of the Kaylee Estates Subdivision Final
Plat.
Councilman Stoddard moved to approve the Kaylee Estates Subdivision Final Plat as
presented subject to; 1) Resolution of the 10' gap between the two subdivisions, 2) Curb,
gutter and sidewalk on Homestead Road is required, 3) Waive the requirement of curb,
gutter and sidewalk on Hawthorne Road, Councilman Morgan seconded. Roll Call Vote:
Quick, yes; Kearns, no; Stoddard, yes; Morgan, yes. Motion passes 3-1.

COTTAGE PARK 2 ADDITION FINAL PLAT - Rodney Burch, Dioptra,333 Briscoe Road

presented the Cottage Park 2 Addition Final Plat. Mr. Burch stated they have completed

construction on the Cottage Park 2 Addition Final Plat. Mr. Burch is requesting tonight
the addition of a lot, (Lot 2, Block 4) that was originally approved in the preliminary plat.
Mr. Burch explained the change.

PWD Smart stated Staff recommends approval of the Cottage Park 2 Addition Final Plat
as presented.

Councilman Kearns moved to approve this revised Cottage Park 2 Addition Final Plat as
presented tonight, showing the change of Lot 2, Block 4, Councilman Stoddard seconded.
All council members voted in favor of motion.
PUBLIC HEARING - An application by Randon & Elizabeth Renzello, 4464 Deer Ave,
Chubbuck, Idaho for a preliminary plat for Renzello Subdivision. Property is located east
of 520 Homestead and west of 5241 Hawthorne Road.
Randon Renzello, 4464 Deer Ave, Chubbuck, Idaho presented the Renzello Preliminary
Plat. Mr. Renzello stated there is a utility line that runs the east side of the property, Mr.
Renzello stated he is trying to resolve the easement issue.
PWD Smart recommend approval of the proposed plat subject to resolution of the 10'

PUBLIC HEARING - RENZELLO PRELIMINARY PLAT - (cont.)
Mayor England declared the public hearing open, there being no comment for, neutral or
in opposition Mayor England declared the public hearing closed.
Councilman Morgan moved to accept the Land Use & Development Commission's
recommendation to approve the Renzello Subdivision Preliminary plat subject to
resolution of the 10' easement for irrigation line and resolution of the property line,
Councilman Kearns seconded. All council members voted in favor of motion.
FIRE PREVENTION WEEK PROCLAMATION - Mayor England read Fire Prevention Week
Proclamation in full.
Councilman Kearns moved to proclaim, October 7`"- October 13`h, 2007 as "Fire
Prevention Week" throughout the City of Chubbuck, Councilman Quick seconded. All
council members voted in favor of motion.
PROPOSED CONTRACT FOR BPDA, INC. - BPDA, Inc, Contract is for Consulting Services
Classification and Compensation Project between the City of Chubbuck and BDPA, Inc.
BPDA, Inc. agrees to do the following:
1. Conduct a review of internal equity.
2. Conduct a market comparability survey to collect salary and benefit data.
3. BPDA, Inc. analyzes survey results to determine the "overall average"
competitiveness of City salaries.
BPDA, Inc. time line - Completion of the full project is estimated in approx four months
from the start date.
Councilman Stoddard moved to authorize Mayor England to enter into the BPDA, Inc
Contract for Consulting Services, Councilman Kearns seconded. All council members
voted in favor of motion.
RESOLUTION #12 -2007 - Authorizing destruction of records.
CC Ron Conlin presented a list of records prepared for destruction.
Councilman Morgan moved to adopt Resolution #12 -2007 as presented, Councilman
Quick seconded. All council members voted in favor of motion.

APPEAL - DENIAL OF DAY CARE FACILITY LICENSE TO DAWN RENEE COOK -
Dawn Renee Cook was not present at this appeal.
Councilman Morgan moved to uphold Chief of Police Randy Severe's decision to deny
Dawn Renee Cook, 125 Toponce, Pocatello, Idaho a day care facility license,
Councilman Quick seconded. All council members voted in favor of motion.
CLAIMS - Computer print -out claims presented to Mayor England and Council.
Councilman Kearns moved to approve the computer print -out claims as presented,
Councilman Stoddard seconded. All council members voted in favor of motion.
GENERAL DISCUSSION -
1. Discussion about City of Chubbuck sanitation service and rates.
At 8:08 p.m, Councilman Morgan moved, Councilman Kearns seconded, with full council
approve to adjourn.
