HomeMy WebLinkAbout002.07.12City of Chubbuck Land Use and Development Commission Minutes February 7, 2012 7:00 PM Minutes of the Land Use and Development Commission regular meeting held at Chubbuck City Hall, 5160 Yellowstone, February 7, 2012. Chairman Peter Anderson: Commission Members: Rodney Burch, George Merrill, Jay Buttars, Morris Kinghorn, James Eborn, Ron Horner, Jason Mendenhall. City Staff: Steven Smart, Paul Andrus. Attorney: Tom Holmes. Secretary: Ranelle Simmons Chairman Anderson called the meeting to order at 7:00 PM. Burch led the commission in the Pledge of Allegiance. APPROVAL OF THE MINUTES: Anderson entertained a motion to approve the minutes as mailed. Mendenhall moved the minutes of January 3, 2012 meeting be approved as mailed; Horner seconded. The full authority approved. NOTICE OF PUBLIC HEARING 1. An application by Cliff W. Cummings, 4902 Burley Drive Suite 1, Chubbuck, ID 83202, for a Conditional Use Permit for a martial arts facility. The property is located at 4902 Burley Drive Suite 1 & 2. Cliff Cummings is the owner of Gate City ATA Martial Arts and has been in business in Pocatello for approx a year and a half. The business was looking for a larger facility that is kid friendly. Burley Drive is a great location. Anderson asked if the Commission had any questions for Mr. Cummings. No questions were asked. Anderson asked for any additional comments from City Staff. Andrus stated the same type of business was in this location under a different owner. The city has no concerns. Anderson asked if Commission had questions for the City Staff. Eborn asked if Mr. Cummings was living at the address on his application, 4902 Burley Drive. Mr. Cummings stated he is not living at the business location. Anderson opened the meeting for public comments. No public comments. Anderson closed the Public Hearing. Anderson stated the application is for Conditional Use Permit so the motion rests with the Land Use Commission and can be appealed to the City Council. Motion made by Mendenhall to approve the application by Cliff W. Cummings, 4902 Burley Drive Suite 1, Chubbuck, ID 83202, for a Conditional Use Permit for a martial arts facility. The property is located at 4902 Burley Drive Suite 1 & 2. Seconded by Eborn. Roll Call Vote: Burch - Yes; Merrill — Yes; Buttars — Yes; Kinghorn — Yes; Eborn — Yes; Horner — Yes; Mendenhall —Yes; Anderson — Yes. Motion carries. To add the ability of a person with a Major Home Occupation to have not more than one (1) employee who does not reside in the home. Anderson asked for any addition information by city staff. Andrus stated with this change it will help the police department because of the additional help for the business owner. Traffic should not increase. With Major Home Occupations the business owner will need to get the approval from the residents that live within the 300 foot code requirement. Anderson asked for questions from the Commission. No questions. Anderson opened the Public Hearing. No comment. Anderson brought the meeting back to the Commission for discussion. Anderson stated this motion is a recommendation to the City Council. Mendenhall commented this is already taking place, so the change would be helpful to the Police Department. Mendenhall made the motion that the Commission recommends to the City Council an ordinance change to 18.12.030. G2a — Major Home Occupations. To add the ability of a person with a Major Home Occupation to have not more than one (1) employee who does not reside in the home. Seconded by Kinghorn. Anderson asked if there was any discussion on the motion. Roll Call Vote: Burch - Yes; Merrill — Yes; Buttars — Yes; Kinghorn — Yes; Eborn — Yes; Horner — Yes; Mendenhall — Yes; Anderson — Yes. Motion carries. The recommendation will go before the City Council on February 28, 2012. GENERAL BUSINESS Land Use Commission meeting in November falls on Election Day Tuesday November 6, 2012 Kinghorn made the motion to change the meeting date from Tuesday November 6, 2012 to Tuesday October 30, 2012 to avoid Election Day. Seconded by Merrill. Motion carries. Anderson entertained a motion to adjourn; Mendenhall made the Ebtreconded.
