HomeMy WebLinkAbout001.03.12City of Chubbuck Land Use and Development Commission Minutes January 3, 2012 7:00 PM Minutes of the Land Use and Development Commission regular meeting held at Chubbuck City Hall, 5160 Yellowstone, January 3, 2012. Chairman Peter Anderson; Commission Members: Rodney Burch, George Merrill, Morris Kinghorn, James Eborn, Ron Horner, Jason Mendenhall, Bryan Nield. City Staff: Steven Smart, Paul Andrus. Attorney: Tom Holmes. Secretary: Ranelle Simmons Chairman Anderson called the meeting to order at 7:00 PM. Horner led the commission in the Pledge of Allegiance. APPROVAL OF THE MINUTES: for December 6, 2011 Anderson entertained a motion to approve the minutes as mailed. Mendenhall moved the minutes of December 6, 2011 meeting be approved as mailed; Kinghorn seconded. Motion carries. GENERAL BUSINESS Discuss change to 18.12.030(G)2.a — Major Home Occupations. To add the ability of a person with a Major Home Occupation to have one (1) employee who does not reside in the home. Andrus stated that the city has had requests from home occupations applicants to be allowed to have an outside employee. After talking to the Chubbuck City Police Department because they inspect daycare facilities, it does not increase their work load if daycare owners are allowed to have extra help at certain times of the day. After researching what other cities allow Andrus feels it would benefit home occupations to allow one (1) temporary employee other than a resident of that home. Holmes stated that with the current recession more people are trying to survive by working out of their homes and does not see a problem. Eborn asked for clarification regarding daycare licensing. Holmes stated that daycare providers have a separate code and will have to be licensed. Burch stated that the change addresses two different issues. 1 -Under the new provision home occupation is allowed to have one (1) employee. 2 -In addition to the one employee the city will allow in a daycare setting a temporary employee that meets the criteria of less than 14 consecutive days. Andrus clarified this is for home daycare allowing 12 children which includes their own children. Anderson stated if language needs to be changed let Tom know. If the board agrees with the language, a motion would be made for a public hearing. Mendenhall made the motion to take the ordinance change to a Public Hearing for the February Land Use meeting. Burch seconded. Motion passes to move to the February meeting. Anderson entertained a motion to adjourn; Mendenhall made the adjourn at 7:16 PM. Ran le Simmons, Secretary )rn seconded.
