Chairman Peter Anderson; Commission Members: George Merrill, Morris Kinghorn, James Eborn, Ron Horner, Jason Mendenhall, Bryan Nield. City Staff: Paul Andrus. Attorney: Tom Holmes. Secretary: Ranelle Simmons Chairman Anderson called the meeting to order at 7:00 PM. Anderson asked if any commissioners have a conflict of interest within the items before the board tonight. Merrill led the commission in the Pledge of Allegiance. APPROVAL OF THE MINUTES: For August 2, 2011. Anderson entertained a motion to approve the minutes as mailed. Mendenhall moved the minutes of August 2, 2011 meeting be approved as mailed; Merrill seconded. The full authority approved. PUBLIC HEARINGS: 1. An application by Allen Romriell, 4741 Afton Place, Chubbuck, Idaho 83202, for a change in the Comprehensive Plan from Medium Density Residential, MDR to Mixed Use. The property is located at the 5200 block of Mesquite, Chubbuck, Idaho 83202. Rodney Burch with Dioptra, 4741 Afton Place, Chubbuck, ID 83202 is representing Mr. Romriell with this application. At the July 5` 2011 Land Use meeting a similar application was denied with a vote 4 to 2. The application at that time was for a change in the Comprehensive Plan and the entire property at 5200 Mesquite Zoned C2, commercial. As a reminder the C2 zoning allows the widest variety of uses. With concern of 5200 Mesquite being in a residential area the vote to recommend going to City Council was denied. After the Land Use meeting there was a scheduled meeting with the Mayor. Mayor advised to change the application to be a potion of the property zoned C1, Commercial which is more restrictive. Mayor also suggested the back two thirds of the property zoned R4, Residential. The desire to build storage sheds is a Conditional Use Permit. Applicant has agreed with the approach suggested by city staff with essentially the same application as before. There is a fairly comprehensive control in the ordinance for storage units. Residents on the South side are Avalon Park Apartments and Spring Park Apartments, both are residential PUDs, high density residential housing. Avalon Park contains 54 (fifty four) units, Spring Park contains 52 (fifty two) units. On the north is the back property line to the residents who live on the south of Adams Street. On Adams Street there are 7 (seven) single family homes and 8 (eight) rental units. On the west on Lucky Street there are 2 (two) single family 4 (four) rental units. At the previous meeting there were concerns over irrigation. The final plans have to accommodate irrigation. Looking at a traffic count study most similar to a storage unit facility, %2 trip per day in a storage unit while residential unit is 9 X trips per day. Hopefully this will alleviate the concern with a storage unit facility adding significant traffic change. Noise concern was mentioned in the last meeting. If storage units are not built the only other alternative for this property is high density housing. Storage units and commercial uses would be a better neighbor then high density housing for the impact on the neighborhood. Commercial uses are well taken care of and have limited business hours, typically the traffic and the noise goes away by 6:00 PM. Commission needs to consider this property as being an Infill Parcel that may never develop because it is a long skinny piece. Storage units would service the neighborhood and uses the piece of property effectively. Please give consideration and a vote of recommendation of approval to the City Council. Burch explained an attendant will be on site during normal business hours. The hours for access by customers have not been decided. Lisa Montague, is the resident of 5292 Lucky and owner of 5282 Lucky, Chubbuck, ID 83202. The noise from the residents in the apartment is echoing into the backyard. Concerned that with storage units the noise will be more of an issue. Ms. Montague is worried for security and safety being a single woman. Property on each side of 5292 Lucky and 5282 Lucky do not have grandfather rights for animals and irrigation, concerned losing her rights. Fay Burrows, 302 Adams, Chubbuck, ID 83202, across the street from the parcel in questions. Concerned with irrigation problems and whether the water will be piped. Will the 50 (fifty) foot easement be opened into a road and where will the apartments be built? Anderson explained the possible building of apartments is not the concern today, only the Comprehensive Use and the Zoning change. As far as the use of the property the applicant did not need to discuss at this point. Anderson closed the public hearing, and returned to Burch for further comments. Burch explained the city development requirement is to pipe water into a subdivision. The easement will not be used as a road. Applicant has no desire to build apartments. Holmes clarified that the R4 zoning allows Mr. Romriell to get a Conditional Use Permit for a storage unit. Burch discussed Chubbuck Comprehensive Plan Our Valley Our Vision Chapter 4 Land Use. Kinghorn asked for clarification on the fence around the property. Burch explained a 6 (six) foot privacy fence is required by ordinance, the fence will be placed on the entire perimeter of the R4 section. There is no intention of using the 50 (fifty) foot easement. Anderson brought the discussion back to the commission. Kinghorn asked for clarification on whether this application went to the City Council. Burch explained they met with the Mayor prior to City Council meeting, he suggested this change. Mr. Romriell did go to our appeal process with the City Council in an attempt to expedite the process. The recommendation was to come back to the Land Use Commission Anderson entertained a motion. Kinghorn made the motion the application by Allen Romriell to change the Comprehensive Plan from Medium Density Residential, MDR to Mixed Use at 5200 Mesquite be recommended to City Council. Motion carries and will go before the City Council at Oct 11, 2011 meeting. 2. Motion carries and will go before the City Council at Oct 11, 2011 meeting. Anderson concluded the Public Hearing. GENERAL BUSINESS: 1. Request and discussion by United Metal, LLC. PO Box 1219, Caldwell, ID 83606 regarding a change to the City Code Title 18.08.040 to allow recycling centers in the City of Chubbuck. Andrus clarified the discussion tonight with United Metals is a presentation as to why the commission should consider changing the ordinance or understanding the definition of our matrix. United Metals would like to build a recycling center in Chubbuck. City staff did not feel that the ordinance was clear enough. United Metals would like to clarify that they do not fall under the definition of a salvage site. Darrel Hardenbrook is a project manager with United Metals based out of Caldwell, Idaho. UM is here today to plead with the board to amend the City Code Title 18.08.040 to allow recycling facilities in the City of Chubbuck. The ordinance states that a salvage site is not a permitted use within city limits. UM does not consider their business a salvage site. Product would be moved to market by rail to Portland, OR. and not kept on site for any length of time. Bannock County landfill has a life expectancy of 7 (seven) years, accepting 300 (three hundred) tons of waste per day. Approximately 26.67% of waste produced in landfills is recyclable. UM would benefit the landfill. Local economy would be affected by the purchase of the property at over $600,000.00. The company estimated close to 2 (two) million dollars initial investment in that property, will be using local engineer, and in the first year will average 15 (fifteen) to 20 (twenty) jobs with a salary estimate of $30,000.00 a year. The proposed site plan will have a 6 (six) foot berm along Siphon Road with landscaping. Making it difficult to see the business from Siphon Road; therefore not looking like an industrial site. Merrill asked if they will take automobiles. UM will, but not nearly to the same degree as Pacific Recycling. UM currently have locations in Gooding, Mt Home, Caldwell and Boise. Hours of operation are 8:00 AM to 5:00 PM Monday thru Friday. Electronics recycling division was started because there are so many electronics that are being sent to landfills; computers, monitors, modems and most electronics. UM accepts those electronics. Copper wire has a plastic coating that in the past was burned off before shipment. UM now has a copper wire chopper that is unique to the west, one in Salt Lake, Utah and Los Angeles, CA. It chops the wire and removes the coating before shipping. UM enjoys getting involved in the communities, Christmas events, community clean up, little league football team sponsor. "Computers for Kids" is a program in Boise that UM is involved in where some computers are being refurbished and reused. Anderson commented recycling is the future and is cost effective. Anderson has made trips to Boise to recycle electronics. Feeling the definition in the ordinance need to be change. Kinghorn talked about the facility that used to be on Maple Street in Pocatello and how this company seems to compare. Horner asked how the toxins are taken care of. Hardenbrook stated that toxins are regulated by the EPA so some have to be denied. Anderson asked for a time frame on when materials are moved off site. UM can move 5,000 (five thousand) ton in the Caldwell facility a month. Anderson and Kinghorn feel a definition of a recycling center needs to be added. Anderson asked for a time table for trying to get a facility going. UM would like to be up and running in 2012, would also like to get some dirt work done this year. Holmes asked if it took a couple of months to get the ordinance changed would that work into their time frame. The city has to hit public hearing deadlines and when definitions start to be discussed it could be a lengthy process. The quicker the better so UM can purchase the land. If they can take a date to the seller they could hopefully get another extension. Holmes suggested the following schedule: October 4, 2011 LUDC meeting to rework the definition; November 1, 2011 LUDC for ordinance rework; November 22, 2011 City Council meeting; December 6, 2011 could be Conditional Use hearing at LUDC. Holmes will have a draft for the October meeting. Anderson entertained a motion to adjourn; Merrill made 8:28 PM.
