Cotant, Jr., Councilmembers Becky A. Hopkins, Leroy S. Quick, Steven M. England, Boyd L. Fullmer, Attorney B. Lynn Winmill, Engineer Steven M. Smart and City Clerk Ron C. Conlin. Meeting was called to order at 7:32 p.m. by Mayor Cotant. iNVOCATION w~§ given by Bishop Stephen L. Croxall, 35th Ward, Church of Jesus Christ of Latter-Day Saints. APPROVAL OF MINUTES - Mayor Cotant asked for corrections and additions to the minutes of May 26, 1987. Councilwoman Hopkins moved to approve the minutes of May 26, 1987 as read. Councilman Fullmer seconded. All councilmembers voted in favor of motion. PUBLIC HEARING - A proposal by Stan Drew for a change of Land Use District from Agricultural (A) to Single Family Residential (R-l) on land approximately south of the 700 block of Norcrest, north of the 700 block of Moran, west of the 4700 block of Chateau, Approx. 7.8 acres. Land is presently zoned Agricultural (A). Mayor Cotant declared the public hearing open. Mr. Stan Drew, 1957 Jean, Pocatello, Idaho was present to present his plans to the Council. Mr. Drew stated he has approx. 8 acres of land he would like the council to change from Agricultural (A) to Residential (R-I~. Mr. Drew stated he is only planning on developing six building lots at this time, three on Chateau and three on Ramsgate. He is not planning to develop the rest of the land at this time. Mayor Cotant asked if there is any opposition to the change of zoning. There was none. Mayor Cotant declared the public hearing closed. The Land Use & Development Commission recommended the council approve= the request, from Agricultural (A) to Residential (R-l) for the proposed 7.8 acre track referred to as Rolling Hills Subdivision. Councilwoman Hopkins moved to approve the Land Use & Development's recommendation for a change of Land Use District from Agricultural (A) to Single Family Resident- ial (R-l) on land approx, south of the 700 block of Norcrest, north of the 700 block of Moran, west of 4700 block of Chateau, Chubbuck. Councilman England seconded. All councilmembers voted in favor of motion. PUBLIC HEARING - Review of Preliminary Plat of the Rolling Hills Subdivision to be developed by Stan Drew, 1957 Jean, Pocatello, Idaho, a subdivision located approx. south~of the 700 block of Norcrest, north of the 700 block of Moran, west of 4700 block of Chateau. Mayor Cotant declared the public hearing open. 89 PUBLIC HEARING - PRELIMINARY PLAT OF THE ROLLING HILLS SUBDIVISION - (Cont.) Engineer Smart stated there is water and sewer services to lots 4, 5 & 6 at this ttme,,there is space on Ramsgate to get water & sewer services off the existing street. Mayor Cotant asked if there was opposition to the plat. There was n6 opposition. Mayor Cot~nt alosed the public hearing. Councilman Fullmer moved to accept the recommendations of the Land Use & Develop- ment Commission in the approval of the preliminary plat of the Rolling Hills Subdivision with the addition of requiring a cash in lieu of park fee in the amount of $622.00. Councilwoman Hopkins seconded. All councilmembers voted in favor of motion. PUBLIC ~EAR!NG - ORDINANCE #294 - An ordinance of the City of Chubbuckamending section 18.08.010 (b) to prohibit the erection of double household dwellings (duplexes) in single family residential (R-l) land use districts, and thereby clarifying incosistency within Title 18. Mayor Cotant read Ordinance #294 in full. Mayor Cotant opened the public hearing. Mayor Cotant asked if there was any comments in favo~of or in opposition to,the ordinance. There was no comment. Mayor Cotant closed the public hearing. Councilman Quick moved to dispense with the rule of reading Ordinance #294 on three seperate occasions. Councilman England seconded. Roll Call Vote: Hopkins, yes; Quick, yes; England, yes; Fullmer, yes. Councilman England moved to adopt Ordinance #294 as read. Councilman Fullmer seconded. Roll Call Vote: Hopkins, yes; Quick, yes, England, yes; Fullmer, yes. FIREWORKS PERMIT APPLICATION - Jerry Tydeman, 5008 Yellowstone Ave. applied for a fireworks permit to sell fireworks at 4825 Yellowstone Ave. Aftem-r~view of required insurances~provided by Jerry,Tydeman, Councilman Fullmer moved to approve a fireworks permit to Jerry Tydeman to sell fireworks at 4825 Yellowstone Ave. Councilman England seconded. All councilmembers voted in favor of motion. Subject to Fire Chief Cary Campbell's approval of requirements. FIREWORKS PERMIT APPLICATION - Brenda Pollard, 115 Taft applied for a fireworks permit to sell fireworks at Smith's Food King Parking Lot. After review of required insurance provided by Brenda Pollard, Councilwoman Hopkins moved to approve a fireworks permit to Brenda Pollard to sell fireworks at Smith's Food King Parking Lot, subject to Fire Chief Cary Campbell's approval of requirements. Councilman Quick seconded. All councilmembers voted in favor of motion. FIREWORKS PERMIT APPLICATION - Dick McHaffey, 9915 W. Canterburg, Tacoma, Washington has applied for a fireworks permit to sell fireworks at Pine Ridge Mall. 91 FIREWORKS PERMIT APPLICATION - Dick McHaffey - (Cont.) After review of required insurance provided by Dick McHaffey, Councilman England moved to approve a fireworks permit for Dick McHaffey to sell fireworks at the Pine Ridge Mall Parking Lot, subject to Fire Chief Cary Campbell's approval of requirements. FIREWORKS PERMIT APPLICATION - Kelly D. Willie~has applied for a fireworks permit to sell fireworks at 4505 Yellowstone Ave. After review of required insurance provided by Kelly Willie, Councilwoman Hopkins moved to approve a fireworks permit to Kelly Willie to sell fireworks at 45~5 Yellol subject to Mr. Willie providing the City of Chubbuck with a corrected certific~8ne of insurance, naming the City of Chubbuck as an additional insured on Product Lib. policy, also subject to Fire Chief Cary Campbell's approval of requirements. Councilman England seconded. All ceuncilmembers voted in favor of motion. FIREWORKS PERMIT APPLICATION - Tom Brigham, 724 S. 19th St., Pocatello, Idaho has applied for a fireworks permit to sell fireworks at 4010 Yellowstone Ave. (Green Triangle Parking Lot). After review of required insurance provided by Tom Brigham, Councilman Fullmer moved to approve a fireworks permit to Tom Brigham to sell fireworks at the Green Triangle Parking Lot, subject to 6) Mr. Brigham supplying the City with a new premises liability coverage, listing the City of Chubbuck rather than the City of Pocatello.as additional named insured, b) Also provide the City with a product liability insurance certificate with the required amounts, c) Subject to Fire Chief Cary Campbell's approval of requirements. Councilman England seconded. All councilmembers voted in favor of motion. BEER LICENSE APPLICATION - Elwood K. Whitehead, Farmer's Market dba Midway Plaza 4260 Yellowstone Ave. has applied for a license to sell beer at Midway Plaza, 4260 Yellowstone Ave. (Formerly Interstate Service & Sales). Mayor Cotant asked if Mr. Whitehead was present. Mr. Whitehead was not present, therefore the application was tabled until the June 23, 1987 Council Meeting. BUSINESS LICENSE APPLICATION - David Richter, Overland Seafoods, San Leandro, California has applied for a business license to sell seafoods from his truck at the parking lot at 4260 Yellowstone Ave. Mr. Richter provided the council with a letter explaining how he Will operate his business if granted a license. The business license application was tabled until the June 23, 1987 Council Meeting. PROCLAMATION - DOLLARS AGAINST DIABETES (DAD'S) DAY - Mayor Cotant read the proclam- ation in full. Councilman Fullmer moved to direct Mayor Cotant to proclaim June 20, 1987, Dollars against Diabetes (Dad's) Day. Councilwoman Hopkins seconded. All council- members voted in favor of motion. CLAIMS - Computer print-out and Handcheck claims presented to Mayor Cotant and Council. 93 CLAIMS - (Cont.) After discussion Councilman England moved to approve the computer print~out and handcheck claims as read. Councilwoman Hopkins seconded. All councilmembers voted in favor of motion. PAVEMENT BID RECAP - Engineer Steve Smart presented a bid recap to Mayor Cotant and Council. The following quotes were received: Bannock Paving Co. Hunziker Const. Homestead Road $ 7,675.85 $ 9,148.36 Chub. & Hiline Rd. 1,916.20 2,911.15 East Linden 6,671.52 7,932.60 Totals $16,263.57 $19,992.11 Engineer Smart gave a report on the projects. After discussion Councilman England moved to authorize Mayor Cotant to enter into agreement with Bannock Paving Co. with the low bid of $16,263.57. Council- woman Hopkins seconded. All councilmembers voted in favor of motion. FINANCIAL REPORT for the month of May presented to Mayor Cotant and Council. GENERAL DISCUSSIONS: 2) 3) Mr. Duncan Lambert, Pine Ridge Mall was present to explain the Pine Ridge Mall Hall of Fame Tie Promotion. Mayor Cotant told Mr. Lambert he had sent a letter to the Mall asking for participation in Chubbuck Days and had not heard any word back. Mayor Cotant asked if the Pine Ridge Mall would recognize Chubbuck Days. Mr. Lambert stated there should be no problem in the Pine Ridge Mall helping with Chubbuck Days this year and in the future. Anna Green, Portneuf District Library was present to thank Mayor Cotant and Council for the support the Library receives from the City of Chubbuck. Mrs. Green complimented the Chubbuck Police Department for the way they patrol and respond to any problems the Library has. Mrs. Green said the Library is kicking off their summer reading program, beginning Monday, June 15. Councilman Quick reported there is three cars on Siphon RoadAthat are not licensed at this time. It was decided.to tell Officer Phelps~so=he can follow- 4) Councilman England stated he met with Parks Director Larry Miller in regards to the Chubbuck Baseball Program. Councilman England stated Chubbuck Recreation Director Dave Sherman is working on the by-laws for the Baseball Program and hopes to have them ready for Council approval at the June 23, 1987 Council Meeting.
