COUNCIL MEETING MINUTES
February 24, 1987
Minutes of a regular meeting held in the city municipal building,
February 24, 1987.
Present: Mayor John O. Cotant, Jr., Councilmembers Becky A. Hopkins, Leroy S.
Quick, Steven M. England, Boyd L. Fullmer, Attorney B. Lynn Winmill, Engineer
Steven M. Smart and City Clerk Ron C. Conlin.
Meeting called to order at 7:30 p.m. by Mayor Cotant.
PUBLIC HEARING-- ORDINANCE #290 of the City of Chubbuck, Idaho, enacting a new
Chapter 18.14 of the Chubbuck Municipal Code to provide for landscaping
requirements for all set-back and yard areas and off-street vehicular parking
and open-lot sales and service areas; repealing prior conflicting ordinances;
and providing when this ordinance shall become effective.
Mayor Cotant declared the public hearing open.
Mayor Cotant asked for comments in favor of, or in opposition to the ordinance,
there being none, Mayor Cotant closed the public hearing.
Mayor Cotant asked for comments from the council.
The ordinance had been discussed at a~prior publi~c hearing held~on November 25,
1986, with no comment from the audience.
Attorney Winmill gave a report on changes discussed at the council meeting of
February lOth, 1987. The three changes Attorney Wi~mill~epo~ted on came about~
after several discussions at prior council meetings.
Councilman Quick moved to dispense with the rule of reading Ordinance #290
on three separate occasions. Councilwoman Hopkins seconded. Roll Call Vote:
Hopkins, yes; Quick, yes; England, yes; Fullmer, yes.
Councilman England moved to adopt Ordinance #290 as read. Councilman Fullmer
seconded. Roll Call Vote: Hopkins, yes; Quick, yes; England, yes; Fullmer, yes.
BUSINESS LICENSE APPLICATION - David R. Hedditch, Edward D~ Jones & ~o~, 303 North
Hayes Ave., Apt. 302 has appied for a business license to sell stocks door to
door in the City of Chubbuck.

Mr. David R Hedditch was present and reported on his plans to sell stocks door
to door. Mr. Hedditch stated he is a licensed stock broker.

After discussion Councilman Fullmer moved to approve a business license to
Edward D. Jones & Co., David Hedditch to sell stocks door to door in the City.
Councilwoman Hopkins seconded. All councilmembers voted in favor of motion.
JOINT APPLICATION FOR ENERGY CONSERVATZON GRANT - Engineer Steve Smart gave a report
on the Energy Conservation and Clean Air Proposal submitted, weekending February
20~987 by the City of Chubbuck a~d the City of Pocatello.
Engineer Smart reported it is not sure when and if the cities will receive the
the grant.

The application has been presented to the Idaho Department of Water Resources.
POLICE SERVICE DOG PROPOSAL - Officer Brian Emfield and Chief of Police Arnold
Stone were present to introduce Mayor Cotant and Council into the basic operation
and use of a Police Service Dog within the Chubbuck Police Departments Patrol
Division.
Officer Emfield presented to Mayor Cotant and Council an 8 page proposal explain-
ing the Police Service Dog Proposal.
Attorney Winmill stated he had inquired of Tom Nield, Insurance Designers as to
whether the city's insurance carrier would be willing to extend coverage, without
the payment of an additional premium, for a police dog program. Mr. Nield confirmed
Penco. will extend coverage without requiring the payment of an additional premium.
Officer Emfield presented several ways the dog program would benefit the Chubbuck
Police Department.
Considerable discussion in regards to costs of training an officer to handle the
dog.
Chief Stone stated the dog would be cross trained in narcotics, along with
crime prevention.
Officer Emfield reported that through the State of Idaho the City has received a
grant for approx, half of the total cost of the dog. He said the total cost of
the dog would be approx. $8,000.00 which includes: dog, training, travel, lodgqng
and equipment. Keeping the Police Service Dog would cost approximately $800.00
to $900.00 a year, this includes a generous estimate, including vet bills, food,
etc.
Councilman Quick stated there might be some help with costs from some of the
businesses in the City, this has not been explored.
Darnell]Nelson, 4626 Ponderosa asked what would happen if the dog got killed,
is there any kind of a life insurance that could be purchased on the dog. It
was decided the Police Department would check into costs for life insurance for
the dog.and report back.
After considerable discussion it was the concensus of the council to look. at the
information compiled more in,depth, and discuss at the March 10,~1987 council
Meeting.
REQUEST FOR SIDEWALKS IN COUNTRY ACRE SUBDIVISION - Marsha Taylor, 4616 Ponderosa
asked that the Chubbuck City Council approve the organization of a Local Improve-
ment District (LID) to design and construct sidewalks for the entire Country
Acres Subdivision.
Mrs. Taylor stated several reasons for asking for sidewalks in the subdivision.
1) Mrs. Taylor felt the 1971 Council used questionable judgement in not requiring
Fred Chase to construct sidewalks. 2) The value of homes in the neighborhood are
decreased due to unfavorable appearances, 3) Homeowners have constructed fences to
the road, thus haveu~k~wingly fenced the children into the street.

4) A driver's probability of hitting a pedestrian are much higher in the area
because of the large number of children playing in the streets. 5) There is no
place for pre-school children to walk, play or ride safely. 6) Currently all
school-aged children walk to school, and therefore put at risk by passing motorists.
7) There is no place for joggers to run and be out of danger of traffic.
Mayor Cotant gave a report on what he remembered about the waivering of the
sidewalks for the Country Acres Subdivision, December 14, 1971.
Engineer Smart stated sidewalks cost approx. $7.00 per lin.~foot to construct,
also in the cost of a LID, there is bond counselling, legal fees and publication
fees.
Engineer Steve Smart and Attorney Lynn Winmill gave a report on procedures
init~ting an LID.
Councilman Fullmer suggested, in initating the LID, the residents should go into
the project.with answers that might be asked and be prepared.
Darnell Nelson, 4626 Ponderosa said he was going to proceed with initating the
LID.
Attorney Lynn Winmill stated he would prepare the wording of a petition, and
the Ci~ty will get it to Marsha Taylor.
At9~:lSp.m., Councilman Quick moved, Councilman Fullmer seconded, with full
council approval to adjourn meeting.
