Minutes of the Land Use and Development Commission held at Chubbuck City Office, 5160
Yellowstone; September 4, 2007.
Present: Chairman Pete Anderson; Commission Members: Morris Kinghom, Ron Horner,
Rodney Burch, James Eborn, Jason Mendenhall, DeLoy Stuart; City Staff. Steve Smart and Larry
Kohntopp; Secretary Myrna Crapo
Chairman Anderson asked if anyone had a conflict of interest. James Eborn declared a conflict
of interest on item #l, and Rodney Burch on item #2.
Chairman Anderson asked for approval of the minutes for the meeting of August 7, 2007. Morris
Kinghom moved to approve the minutes with Jason Mendenhall seconding; all voted in favor.
1. An application by Westwind L.L.C., P.O. Box 5327, Chubbuck, Idaho for a preliminary Plat
for Gryffin Hollow Subdivision. Property is located south of 14091 W. Chubbuck Road and
West of 10795 North Philbin Road.
Joel Dixon, Rocky Mountain Engineering and Surveying, 2043 E. Center Street. He
showed a map of the proposal. They have 3.0 acres total they are proposing two single
family lots, eight duplex lots and one common open space lot. They want to be the first
twin homes on the market in the spring.
Steve Smart PWD, the width of the road way is a concern and they haven't shown swales.
We need a wider roadway section than the 32 feet. They need to increase it by 18' or 20'.
The meeting was opened for public comment. There was no public comment so the
public hearing was closed and brought back to the commission.
Joel Dixon, They are looking to have a normal easement on the north side of the line.
They are going to put swales in. The sidewalk is outside of the right -of -way, so the
sidewalk would not be put in. They plan on putting swales in the drawings.
The commission discussed:
1. The road needing to function as a collector.
2. Chubbuck Road and Philbin Road will become limited access.
3. The need for emergency vehicles would require a larger street if vehicles were parked
on street.
4. Going to a 40' or 41' section; but not requiring the developer to develop the sidewalks
and swales.
5. It needs to be a collector street instead of a residential street.
6. Recommending no street parking.

Morris Kinghorn moved this plat be approved and recommend to the city council with the
condition that the street be widened to 40 foot and work out with the staff what they need
to do in terms of the utilities. Rodney Burch seconded. Roll call vote: Rodney Burch,
yes; Deloy Stuart, yes; Jason Mendenhall, yes; Ron Horner, yes; Morris Kinghorn, yes;
Pete Anderson, yes.
2. An application by Afton Meadows, L.L.C. 4922 Yellowstone, Suite J., Chubbuck, Idaho for a
Preliminary Plat for Afton Meadows Replat, 147 W. Chubbuck Road.
Rodney Burch, Dioptra, 4922 Yellowstone. They want to replat Afton Meadows
Subdivision. The location of the property is about 300 feet west of intersection of
Yellowstone and W. Chubbuck Road. They want a replat of four lots into one lot.
The meeting was opened for public comment for and against. There was none so the
public hearing was closed and brought back to the commission.
The Commission discussed:
1. It is a proposed mortuary. Access will be off of the East side.
2. They are just replating this portion
Jason Mendenhall moved to recommend to the city council approval of the application by
Afton Meadows, L.L.C., 4922 Yellowstone, Suite J, Chubbuck, Idaho for a replat for 147
W. Chubbuck Road. Morris Kinghorn seconded. Roll call vote: Deloy Stuart, yes; James
Eborn, yes; Jason Mendenhall, yes; Ron Horner, yes; Morris Kinghorn, yes; Pete
Anderson, yes.
3. An application by Darris Ellis, 922 Sawtooth, Chubbuck, Idaho for a Conditional use Permit to
permit twin home cluster. Property is zoned P.U.D., Residential. Property is located at 4654
Galena Street.
Joel Dixon, They want to change lot 3 block 3 of Park Meadows 5 addition from single
family residential to a twin home. There is a large market for twin homes in the area.
Darris Ellis, 4470 Wasatch, it is similar to the other application. He made a mistake by
not plating this in the first place. It is a large lot.
The meeting was opened for public comment for and against.
James D. Haeberle, 4649 Christine for purposed of continuity he would like to have them
all the same.
Gary Gillette, 4645 Galena he doesn't want to have it go in.

1 Nathan Crews, 922 Sawtooth , he feels it would interrupt the flow of the housing.
Anna Pierce, 4685 Galena, she is against this. They brought this home for an investment
and plan to stay here for along time. She thinks Darris should build one nice single
family home there.
Verla Ellis, 4689 Christine Street, she has mixed emotions, there are some disadvantages
These homes are fine for the elderly people. There is no restriction in the cul -de -sac
about rentals. It has been quite an annoyance to her. The children who play in the street
is a worry.
Diane Swallow, 4662 Christen, she has two children at home. She wanted something
small enough.
Doreen Jones 4642 Christen, they love the twin home. She feels their home is as
important as single family homes.
Sheryl Haeberle, 4649 Christen, they are renting their home right now. There was a
family that let the kids running in the street. She likes twin homes.
Darris Ellis, 4470 Wasatch, the twin home will be $180,000 for each home.
Gary Gillette, 4645 Galena Avenue, he still objects to the twin home. It does not go with
the continuity on Galena Avenue.
The public hearing was closed and bought back to the applicant. There is a diverse
population that lives in the twin homes.
The commission discussed:
1. When people built across the street they were planning on having a large home there.
Rodney Burch moved to deny the conditional use permit for the application of Darris
Ellis for the location of 4654 Galena Street. Ron Horner seconded. Roll call vote:
Rodney Burch, yes; Deloy Stuart, yes; James Eborn, yes; Jason Mendenhall, yes; Ron
Horner, yes; Morris Kinghom, yes; Pete Anderson, yes.
4. An application by Darris Ellis, 922 Sawtooth, Chubbuck, Idaho for a Designated Geographic
Area to permit twin home cluster. Property is zoned P.U.D., Residential. Property is located at
4654 Galena Street
Joel Dixon, there is no other lot big enough to do this again in this area. They are under
the 10% of twin homes in this area.

Darris Ellis, 4470 Wasatch, Phase 4 and phase 5 were in different additions. He would
like to have a geographic area. The geographic area would take in phase 1, 2, 3,4, and
part of 5.
Gary Gillette, 4645 Galena, he is not in favor of twin homes.
The public hearing was closed and brought back to the commission for discussion.
Rodney Burch moved to deny the application by Darris Ellis for a Designated Geographic
Area to permit twin home clusters on the property located at Park Meadows 1 through 6.
Seconded by Morris Kinghorn. Roll call vote: Rodney Burch, yes; Deloy Stuart, yes;
James Ebom, yes; Jason Mendenhall, yes; Ron Horner, yes; Morris Kinghom, yes; Pete
Anderson, yes.
GENERAL BUSINESS:
4. Discussion on a proposed ordinance to adopt section 16.16.150 to require each building site to
provide toilet facilities.
Steve Smart explained the changes that had been requested by the commission. Jason
Mendenhall moved to take section 16.16.105 and 18 to a public hearing at our next
meeting. Deloy Stuart, seconded. All voted in favor.
