HomeMy WebLinkAbout008-7-07LAND USE AND DEVELOPMENT COMMISSION August 7, 2007 Minutes of the Land Use and Development Commission held at Chubbuck City Office, 5160 Yellowstone; August 7, 2007. Present: Chairman Pete Anderson; Commission Members: Shawna Elzner, Jason Mendenhall, Ron Horner, Morris Kinghorn, James Ebom, DeLoy Stuart; City Staff. Sean Harris, Larry Kohntopp and Steve Smart; Secretary Myrna Crapo Chairman Anderson asked for approval of the minutes for the meeting of July 10, 2007. Morris Kinghorn, moved to approve the minutes with Jason Mendenhall seconding; all voted in favor. PUBLIC HEARING: 1. An application by Thomas Development, Co. 413 W. Idaho Street, Boise, Idaho for a Change of Land Use District from Limited Family Residential (R -2) to Dense Residential (R -4). Property is located at 4856 Hawthorne Road. Hethe Clark, 251 E. Front Street in Boise, they want to have a apartment complex for citizens of limited means. Property is 3.2 acres. They will have 48 units. The commission asked: 1. Would this meet the requirement of the adjacent animals in the area. 2. What was the building going to be like. The meeting was opened for public comment. Wayne Roderick, 4920 Hawthorne, he lives 100 feet from this project. He is in favor of their projects. He feels the zoning change should be tied to the sale of the property and the development as planned. If those two items aren't carried through he would like the zoning to revert back to R -2. Don Zebet, 465 Berrett, they have an earnest money agreement. The change to R -4 doesn't include the house on the property. They are under contract for area B and not A as indicated in the drawings. The Staff discussed: 1. There is shortage in the area of this type of development 2. Will this stay low income housing 3. Who has ownership of this property 3. The existing house to be excluded from the zoning 4. The zoning change contingent upon the sale of the property 5. Parking space requirements 6. Open space requirement .-� 7. What happens if this becomes a low income housing and not a low income seniors housing Land Use and Development August 7, 2007 Page 2 Deloy Stuart moved to recommend to the City Council approval of the application by Thomas Development, 413 W. Idaho Street, Boise, Idaho for a Change of Land Use District from Limited Family Residential (R -2) to Dense Residential (R -4). Property is located at 4856 Hawthorne with the exclusion of Area A is not included in this rezone and this is contingent on the sale of the property to Thomas Development. Jason Mendenhall seconded. Roll call vote: DeLoy Stuart, yes; Jason Mendenhall, yes; James Eborn, yes; Shawna Elzner, yes; Ron Horner, yes; Morris Kinghorn, yes; Pete Anderson, yes. 2. An application by Cardona Limited Partnership, 413 W. Idaho Street, Ste 200, Boise, Idaho for a Preliminary Plat for Cardona Subdivision. Property is located at 4856 Hawthorne Road. Hethe Clark 251 E. Front Street, Boise, Idaho This is not a nursing home, there will be no meals or nursing care. There will be common areas inside. Commissioner discussed: 1. They have asked to reduce the number of parking spaces. 2. The egress onto Hawthorne is it adequate for site clearance. 3. The exterior perimeter will have a solid six foot fence. They will be 6" behind the property line. 4. There will be one elevator 5. The interior doors will be Y doors. 6. Their will be no manager on site. Justin Wall, 9195 Edna, Boise, Idaho. They will have on going programs in common areas. They will supply exercise units. The meeting was opened for public comment. There was none. The public hearing was brought back to the commission for a discussion and a motion. The commission asked. 1. If is geared toward the seniors in the width of the interior doors 2. Will there be any type of notice that will notify drivers of this facility. Jason Mendenhall moved that we recommend to the city council approval of the application by Cardona Limited Partnership, 413 W. Idaho Street, Ste 200, Boise, Idaho for a preliminary Plat for Cardona Subdivision. Property is located at 4856 Hawthorne Road. James Eborn seconded. Roll call vote: DeLoy Stuart, yes; Jason Mendenhall, yes; James Eborn, yes; Shawna Elzner, yes; Ron Horner, yes; Morris Kinghorn, yes; Pete Anderson, yes. 3. An application by Clare and Allene Stucki, 14091 W. Chubbuck Road, Pocatello, Idaho for Annexation and Zone change to Limited Family Residential (R -2). Property located south of 14091 W. Chubbuck Road and West of 10795 North Philbin Road. Land Use and Development August 7, 2007 Page 3 James Ebom has a conflict of interest with this item and will not participate in this discussion. Joel Dixon, Rocky Mountain Engineering and Surveying, 2043 E. Center Street. They would like to have an R -2 zoning. They are planning six twin homes on three acres. The meeting was opened for public comment for or against. There was none. The commission discussed: 1. If a geographic area will be needed 2. The reason for annexation. Jason Mendenhall moved to recommend to the city council approval of the application by Clare and Allene Stucki, 14091 W. Chubbuck Roa , Pocatello for Annexation and Zone change to Limited Family Residential (R -2). Property located south of 14091 W. Chubbuck Road and West of 10795 North Philbin Road. Deloy Stuart, seconded. Roll call vote: DeLoy Stuart, yes; Jason, Mendenhall, yes; Shawna Elzner, yes; Ron Horner, yes; Morris Kinghom, yes; Pete Anderson, yes. GENERAL BUSINESS: 4. Discussion on a proposed ordinance to adopt section 16.16.150 to require each building site to provide toilet facilities. Steve Smart, PWD, explained that they had complaints from adjoining property owners on builders who let their trash blow and accumulate on adjoining properties. It only effects those doing water, sewer and street construction through the city. The wording should be construction instead of building site. We need to take a look at how building is being used in the ordinance. The commission discussed: 1. Xeriscape needs to be defined. 2. One of the requirements needs to be that the plan needs to be approved by the City 3. Steve Smart asked that Pete Anderson let him know the experiences that he has had on control and etc. 4. We need to encourage water irrigation systems in landscape areas 5. Limiting the hours of operation for watering. Dean Kreger, Building Contractors Association of the Southeastern Idaho, 770 E. Chubbuck Road. They feel the developer should make the cost up front for each builder and maintain the outhouse during the period of construction. In the case of an isolated ^ subdivision or building site that the contractor remain responsible on his own. A Portable toilet that is easily accessed by all workers on the work site. Land Use and Development Commission August 7, 2007 Page 4 The Commission requested that Tom Holmes redo the ordinance and bring it back to them for the next meeting.
