Minutes of the Land Use and Development Commission held at Chubbuck City Office, 5160
Yellowstone; June 5, 2007.
Present: Acting chairman Jason Mendenhall; Commission Members: Michelle Christy, DeLoy
Stuart, Jim Ebom, Morris Kinghom; City Staff: Larry Kohntopp, and Steve Smart; Attorney Tom
Holmes, Secretary Myrna Crapo
Chairman Mendenhall asked if anyone on the commission had a conflict of interest. There was
none.
Chairman Mendenhall asked for approval of the minutes for the meeting of May 1, 2007. Morris
Kinghorn moved to approve the minutes with Michelle Christy seconding; all voted in favor.
PUBLIC HEARING:
1. An application by Mandy Zweigert, 5795 Industry Way, Chubbuck, Idaho for a
Conditional Use Permit to develop a gymnastics/ Cheerleading/childcare center with
build in residence. Property is located South of Siphon Road/ West of Whitaker/ North
of Victorian Village /East of Union Pacific Railroad. Property is zoned C -1, Limited
Commercial.
Mandy Zweigert, 583 Ravin Way #B, it will be a limited after school program, Cheer
leading, gymnastics, birthday parties, etc.
The Commission asked for further information:
1. The cheerleading attendees is 3 to 18 years of age.
2. The hours for summer are from 7:30 to 6 pm.
3. The hours during school time are 9:00 am to 8:30 pm.
4. Kindergarten and older children will be at the day care.
5. They want their home above the business.
6. The set back from Siphon Road.
7. The children's safety
She passed out pictures of different places in town giving an indication of what it would
look like; along with a scaled model.
The public hearing was opened.
Glen Marshall, P.O. Box 520, Pocatello, Idaho; he owns the property opposite this on
Siphon Road. He doesn't object to this project just the residence.

Bryce Jolley, Harper- Leavitt Engineering, having the resident above the business will
help in the security of the building.
The public hearing was closed.
Mandy Zweigart, compared Geraldines with a resident above their business.
Morris Kinghorn moved to approve this project for Mandy Zweigart, with the condition
that there be a vinyl fence along the property minimum of 6' on the west and south; and
connectors on the back corners of the building for confinement and that there be 1" tree
every 20 Feet on the south side of the building. Deloy Stuart seconded. Roll call vote:
DeLoy Stuart, yes; Jim Eborn, yes; Michelle Christy, yes; Morris Kinghorn, yes; Jason
Mendenhall, yes.
2 An application by Mandy Zweigart, 1620 Onyx, Pocatello, Idaho 83202 for a preliminary plat
for Zweigart Subdivision. Located at the 300 block of Siphon Road.
Bryce Jolley, Harper- Leavitt Engineering. Dedicate 40' right of way along Siphon road.
They will allow one access between the joining property on the east side which is shown
on the plat. They would like to access from lot one for a temporary access.
The public hearing was opened. There was no public comment; so the public hearing was
closed and brought back to the commission.
The Commission discussed:
1. The original plat was not recorded; so it had to be replated.
Deloy Stuart moved to recommend to the City Council that they approve the application
by Mandy Zweigert, 1620 Onyx, Pocatello, 83202 for a preliminary plat for Zweigart
Subdivision located at the 300 block of Siphon with the condition that they will be able to
use the temporary entrance until further development calls for them to go back to
accommodate the other lots. Morris Kinghorn seconded. Roll call vote: DeLoy Stuart,
yes, Jim Eborn, yes; Michelle Christy, yes; Morris Kinghorn, yes; Jason Mendenhall, yes.
3. An application by Gary Ratliff, 3960 S. 2' Avenue, Pocatello, Idaho for a Preliminary Plat for
Garage Town Subdivision. The property is located at the north end of Burley Drive.
No one was here to represent the applicant.

Morris Kinghorn moved to table this application until further notice. Michelle Christy
seconded. Roll call vote: DeLoy Stuart, yes; Jim Eborn, yes; Michelle Christy, yes;
Morris Kinghorn, yes; Jason Mendenhall, yes.
4. An application by Todd Briscoe /Jay Roche, 5241 Hawthorne Road, Chubbuck, Idaho for a
preliminary plat for Kaylee Subdivision. Located at Hawthorne and Homestead Roads
Bryce Jolley, Harper- Leavitt Engineering, P.O. box 866 Blackfoot, Idaho. Four lot
subdivision, currently zoned R -2 Limited Residential. One existing home on lot one. Lot
four would access off Homestead Street. Lots 2 and 3 would access a shared access off of
Hawthorne.
Steve Smart, P.W.D. - The existing zoning is R -2. Lot width ratio exceeds the allowable.
The ratio is 2:1 and this is 3:1. They couldn't create lot 4 as presently zoned.
The public hearing was opened.
Todd Briscoe, 5241 Hawthorne, lot 1 enters from Hawthorne. They followed the rest of
n the lots on Homestead when they designed lot 4.
The public hearing was closed and brought back to the commission.
Bryce Jolley, clarified that the entrance was off of Hawthorne.
The commission:
1. The rule of ratio 2:1.
Morris Kinghorn moved to tabled it and have them fix it and bring it back to the
commission. Michelle Christy seconded. Roll call vote: DeLoy Stuart, yes; Jim Eborn,
yes; Michelle Christy, yes; Morris Kinghorn, yes; Jason Mendenhall, yes.
GENERAL BUSINESS:
5. Bannock Planning Organization - Mori Byington: Long Range Transportation Plan
presentation and discussion.
Mori Byington, Bannock Planning Organization, 210 E. Center; gave an overview plans
for highway, bicycle, transit and pedestrian modes. They are the recommendations for
next 20 years.

Mori did a presentation on the 2006 Long Range Transportation Plan.
Deloy Stuart moved to recommend to the City Council that they review and accept the
long range transportation plan done by Bannock Planning Organization. Michelle Christy
seconded. All voted in favor.
6. Discussion on lighting ordinance for the City of Chubbuck.
The commission discussed lighting in the city and what was driving this.
DeLoy Stuart moved that the City Council if they with too, to form a committee that
looks into how the city in conjunction with the power company can change out street
lamps and city lights to become more nighttime sky friendly. If we can do that then later
we look at extending that to the general public but worry about the cities first. Jim Eborn
seconded.
The commission then discussed:
1. Too many ramifications for this type of ordinance
e 1 2. Let City staff look into this
DeLoy Stuart retracted his motion.
DeLoy Stuart moved that as a Land Use Commission we find no need to spend the cities
money on investigating the light ordinance. James Eborn seconded. Deloy Stuart, yes;
Jim Eborn, yes; Michelle Christy, no, Morris Kinghorn, yes; Jason Mendenhall, no.
Deloy Stuart moved to adjourned at 9:10 pm with Morris Kinghorn
