Present: Chairman Pete Anderson; Commission Members: Michelle Christy, Gayle Anderson, Rodney Burch, Shawna Elzner, Deloy Stuart, Morris Kinghorn, Mary Harker; Attorney: Tom Holmes; City Staff. Steve Smart, Larry Kohntopp, Sean Harris; and Secretary Myrna Crapo. Chairman Anderson asked if anyone on the commission had a conflict of interest. There was none. Chairman Pete Anderson asked for approval of the minutes for the meeting of February 6, 2007 Morris Kinghorn moved to approve the minutes as mailed. Gale Anderson seconded; all voted in favor. GENERAL BUSINESS: 1. Presentation on secondary irrigation systems. Chairman Anderson turned this part of the meeting to Steve Smart. n Steve Smart, 5028 Pleasant View, Public Works Director, introduced the people he asked to be here. Alan Oliver, Supervising Engineer for Fort Hall Irrigation; Steve Wilcox, Country Acres Irrigation System; Franklin Briscoe, Briscoe Subdivision Irrigation System, Richard Morgan, Gold Lateral Irrigation System, and Joel Dixon, Rocky Mountain Engineering. Alan Oliver, Fort Hall Irrigation - Fort Hall water is tied to the land base. The code allows land users to form water users associations. There about 25 water users in the association. Steve Wilcox, Country Acres Irrigation System: they have 80 residents. The pump is at 535 Bonanza on the canal bank and the system is about 40 years old. Richard Morgan, 646 Boyd, Gold Lateral Irrigation System. Point of delivery is off Canal street. They have a 6" line with 28 lots. Franklin Briscoe, Briscoe Subdivision Irrigation System - they have an 8" line, with 27 people on the system. Joel Dixon, Rocky Mountain Survey. Grove subdivision, discussed the association that they were putting together. Land Use and Development March 6, 2007 Page 2 PUBLIC HEARING: 2. An application by the Alpine Animal Hospital, 4000 Yellowstone Avenue, for a Veterinary Clinic and Business Park Development: Conditionally permit a veterinary clinic, revise the P.U.D. and Preliminary Development Plan, (narrative), replat the alterations to the original plat for property at 147 W. Chubbuck Road. Property is zoned Commercial P.U.D (Planned Unit Development). Jim Mullen, Keller Associate, 412 W. Center, presented a revised plat to the Land Use Commission. They have increase lot # 6 for the Veterinary facility and blockl, lot 3. They anticipate the canal to be covered. They don't want to cover it right now. Scott Higgins, 4000 Yellowstone, building will be on lot 6 and lots four and five will be places for horse trailers; lots 7, 8, 9 will be pasture areas. Matt Dredge, 645 Alpine, they would like to have a chain link fence. The public hearing was opening for comment. Marylou Kinlock, 240 W. Chubbuck, she is concerned about barking dogs and the disposal of the animal at the business - what will the smell be like. Linda Hillman, 221 W. Chubbuck Road, they are concerned with 1) the irrigation; 2) the size of the business complex; what will it be like. Bill Aller, 222 W. Linden, they join on the south west corner of their property. What type of fence do they plan on using. He doesn't have problems with the open ditches. The hearing was closed and the application was allowed to address any concerns that came up during the public hearing. Matt Dredge, The only time there are barking dogs, will be 10 or 20 minutes in the morning and evening while kennels are being cleaned inside. The small dead animals will be kept in freezers until they can be taken off the property. They get rid of big animals as quickly as possible. Their Irrigation plans are to flood irrigate. They will be berming this area. /'\ Land Use and Development Commission March 6, 2007 Page 3 The commission discussed: 1. This being the 3rd or 4` proposal on this property. 2. A section of pipe will be more dangers than an open ditch. 3. Using it as a pasture. Mary Harker proposed that we approve the conditional use permit for the veterinary clinic Alpine Animal Hospital located at 4000 Yellowstone Avenue, Pocatello, Idaho, 83202. Item located at the Afton Meadows subdivision NW Corner section 10 T6Sr34E at this point with no accommodations. Michelle Christy seconded. Roll call vote: Rodney Burch, no; DeLoy Stuart, no; Mary Harker, no; Gayle Anderson, yes; Morris Kinghorn, no; Shawna Elmer, no; Michelle Christy, yes; Pete Anderson, no. Discussion on the motion: 1. Veterinary clinic being allowed under what zoning in the city 2. The structure of the clinic Rodney Burch moved to table the application for a P.U.D. Development by Alpine Animal Hospital. Mary Harker seconded. All voted in favor. Chairman Andersen informed the applicant that it would take someone on the commission that voted against the item to bring the item for conditional use up again for consideration. Morris Kinghorn moved that the outlined Animal Hospital proposed replat that the area be tabled until when we can readdress these issues. Deloy Stuart seconded. All voted in favor. 3. An ordinance by the City of Chubbuck, 5160 Yellowstone, repealing section 17.12.340 and adopting a new section 17.12.340 to reflect a new instrument number which corrected an error in the underlying survey The public hearing was opened for public comment. There was none so the hearing was closed and brought back to the commission for discussion. Gayle Anderson recommend to the city council that we adopt this ordinance of the City of Chubbuck, 5160 Yellowstone, repealing section 17.12.340 and adopting a new section 17.12.340 to reflect a new instrument number which corrected an error in the underlying survey.
