Minutes of the Land Use and Development Commission held at Chubbuck City Office, 5160
Yellowstone; November 1, 2006.
Present: Chairman Pete Anderson; Commission Members: Morris Kinghom, Michelle Christy,
DeLoy Stuart, Gale Anderson, Rodney Burch; Attorney: Tom Holmes; City Staff: Larry
Kohntopp; and Secretary Myrna Crapo.
Chairman Anderson asked if anyone on the commission had a conflict of interest; there was
none.
Chairman Pete Anderson asked for approval of the minutes of the meeting of October 3, 2006;
Morris Kinghom moved to approve the minutes as mailed. Gale Anderson seconded; all voted in
favor.
PUBLIC HEARING:
1. An application by Miller Properties, LLC, 6034 Fruitwood Lane, Pocatello, Idaho - for
the Sunset West Subdivision, for annexation and Zoning change to Limited Residential
R -1). The property is located at the Northwest corner of Philbin Road and West
Chubbuck Road.
Roy Miller, 6034 Fruitwood Lane, the annexation request is for phases one through five in
Sunset West Subdivision. Those are the platted phases that exist today. This is in compliance
with their previous agreement with the City of Chubbuck in regard to the development and
annexation of Sunset West.
The meeting was opened for public comment for or against. There was none. The public hearing
was closed and brought back to the Commission for discussion.
Larry Kohntopp, the application shows R -1 as limited residential and it should be single family
residential. It was a clarification of the publication.
The commission discussed:
1. If we have sewer capacity for them to hook up to city water and sewer.
2. Fire department availability for servicing the area.
Deloy Stuart moved to recommend to the city council approval of the application by Miller
Properties, 6034 Fruitwood Lane, Pocatello, Idaho for the Sunset West Subdivision, for
annexation and zone change to R -1. The property is located at the Northwest corner of Philbin
Road and West Chubbuck Road. Michelle Christy seconded. Roll call vote: Rodney Burch, yes;
Deloy Stuart, yes; Michelle Christy, yes; Gale Anderson, yes; Morris Kinghom, yes; Pete

2. An Application by Kevin Booth, et. al. 4745 Declaration - for the Grove Subdivision
for annexation and zoning change to Limited Residential R -1) The property is located
approximately 1/4 mile south of West Chubbuck/Philbin Road. Intersection, west side of
Philbin Road.
Kevin Booth, 4745 Declaration, they are basically doing the same as Sunset West; they went
through the county process and applied for sewer and water with the City of Chubbuck. They are
following the desires of the City of Chubbuck and applying for annexation..
The public hearing was opened. There was no public comment; so the public hearing was closed
and brought back to the commission for discussion.
Commission:
1. In the future they would like to have us annex property as soon as we can before they have to
go through the county level.
Deloy Stuart moved to approve the application and recommend to the city council they approval
the application of Kevin Booth, 4745 Declaration, for the Grove Subdivision for annexation and
zoning change to R -1. Property is located 1/4 mile south of West Chubbuck and Philbin road
intersection. Morris Kinghorn seconded. Roll call vote: Rodney Burch, yes; Deloy Stuart, yes;
Michelle Christy, yes; Gale Anderson, yes; Morris Kinghorn, yes; Pete Anderson, yes.
The commission requested an update on the duplex ordinance at the city council. Attorney
Holmes informed the commission that the city council asked that it goes through a conditional
use if it is not owner occupied.
