HomeMy WebLinkAbout008-1-06LAND USE AND DEVELOPMENT COMMISSION August 1, 2006 Minutes of the Land Use and Development Commission held at Chubbuck City Office, 5160 Yellowstone; August 1, 2006. Present: Acting Chairman Jason Mendenhall; Commission Members: DeLoy Stuart, Mary Harker, Rodney Burch, Michelle Christy, Shawna Elzner; City Staff: Steve Smart and Larry Kohntopp; and Secretary Myrna Crapo. Chairman Jason Mendenhall asked for approval of the minutes of the meeting of July 6, 2006; Mary Harker moved to approve the minutes as printed. Michelle Christy seconded; all voted in favor. PUBLIC HEARING: 1. An application by Darris Ellis, 922 Sawtooth, Chubbuck, for annexation and zoning of remaining land in Park Meadows P.U.D.; for development of a residential Planned Unit Development (P.U.D.) Combination of R -1 and R -2 sized lots. The property is located west and south of 6`' and 7` additions of Park Meadows P.U.D. Darris Ellis, 922 Sawtooth 16.3 acres will be annexed. They have three more phases. The public hearing was opened for Public comment. There was none so the hearing was closed and brought to the Commission. The commission discussed: 1. If there would be any commercial development. Mary Harker moved to recommend to the City Council acceptance of the application by Darris Ellis, 922 Sawtooth for annexation and zoning of remaining land in Park Meadows P.U.D. as referenced to in the description of the application; for development of a residential Planned Unit Development (P.U.D.) Combination of R -1 and R -2 sized lots. The property is locate west and south of 6` and 7' additions of Park Meadows P.U.D. Seconded by Michelle Christy. Roll call vote: Rodney Burch, yes; Deloy Stuart, yes; Mary Harker, yes; Michelle Christy, yes, Shawna Elzner, yes; Jason Mendenhall, yes. Millie McNabb, 12973 N. Philbin Road asked for clarification on the motion. 2. An application by Pocatello Christian School, 5163 Yellowstone, Chubbuck for a Conditional Use Permit for a Christian School with 20 students approximately. Property is zoned General Commercial C -2). Property is locate at 5163 Yellowstone. Land Use and Development Commission August 1, 2006 Page 2 Colan Deatherage, 2003 Ada Street, Pocatello, he is the director of the Pocatello Christian School. They will have four classrooms with a staff of two; with kindergarten through 6` grade. They will start August 21. They expect 20 or more children. There will be split grades. This is the second year for the school in Pocatello The Commission discussed: 1. Playground facility for the children 2. The balance of the area being put into grass 3. If they are busing children Larry Kohntopp informed the commission. 1. They recommend the street type approach rather than existing curb cuts 2. Outdoor advertising for the school will require design review 3. Landscaping on the outside is not applicable to this application because of the concrete barrier onto Yellowstone 4. There is a 5% landscaping requirement 5. Storm water drainage needs to be retained on site 6. Parking requirements need to be a total of 8 parking spaces. The public hearing was opened: There were not comments, so the hearing was closed. The Commission discussed: 1. Two classed will be kindergarten 2. The other classes will have combined grades 3. The last room will be empty 4. The access in and out is tough and they need a stop sign there 5. Two way traffic will be needed 6. The need to have a review and have us revisit it if they want to do additional work 7. They will need an approach permit from the Transportation Department 8. The hours are 8:30 am to 3 pm 9. The off street parking is required to be paved. 10. The sign needs to be approved by the city staff 11. The off street parking is required to be paved plus the driveway from Yellowstone. 12. They need a caution sign going onto Yellowstone Deloy Stuart moved to approve the conditional use permit of the Pocatello Christian School, located at 5163 Yellowstone, for a Christian School with approximately 20 students. Property is zoned C -2; property is located at 5163 Yellowstone with the following conditions: 1. They change the curb cut to a full street access cut and they have until October 15 to complete that. 2. Prior to opening they have their pavement in. Shawna Elzner, seconded. A presentation by Adams Company for future annexation and zoning of Jensen property, north of Bunce Subdivision, (Pleasant View, Elizabeth) and west of I -15 approximately 400 acres. David Adams, 475 N. 300 W.; Kaysville, Utah is with Adams Company, they wanted to show the commission what they were proposing. Troy Sanders, with A. S.W.N. 5151 S. 900 E. Salt Lake City, Utah. Presented their proposal. The commission discussed: 1. Buffalo Road is a bad intersection 2. They could extend Garden Drive 3. They would like to start next spring and would start in the R -1 area 4. The sewer being outside the urban service area 5. Tree Valley exit. 4. Discussion on a proposed ordinance repealing section 18.04.05; adopting chapter 18.06 definitions, including definitions for residential rental dwellings. Mary Harker proposed that we recommend a public hearing for the adaptation of ordinance 18.06.00 for the definitions of units, building, kennels, and other dwellings in the City of Chubbuck. Michelle Christy seconded. All voted in favor. 5. Discussion on a proposed ordinance adopting section 18.06.200 definition for residential rental dwelling; amending section 18.08.040, schedule of general controls as to residential use. The commission discussed: Parking spaces could limit those who want to do this 2. Compensation being a key work in who was required by the ordinance The commission decided to put it on next month as a general business item.
