Minutes of the Land Use and Development Commission held at Chubbuck City Office, 5160
Yellowstone, July 6, 2006.
Present: Chairman Pete Anderson, Commission Members: DeLoy Stuart, Jason Mendenhall, Mary
Harker, Shawna Elzner, Gale Anderson; City Staff: Steve Smart, and Larry Kohntopp; Attorney
Tom Holmes and Secretary Myrna Crapo
Chairman Anderson asked for approval of the minutes of the meeting of June 6, 2006; Mary
Harker moved to approve the minutes as written. Jason Mendenhall seconded; all voted in favor.
PUBLIC HEARING:
1. An application by West Care Management, Inc., 3625 Vaughn St., Pocatello, for a
Change of Land Use District from Limited Residential (R -2) to Limited Commercial
C -1) to allow for office spaces. Property is located at 4806 Hawthorne Road.
Kelly Head, 3625 Vaughn Street, the Regional Director with West Care Management
They are a health care, management and consultation firm. They have been in Pocatello since
1998. They started with 23 people in an institutional setting; they are providing care for 34
individuals in their homes and are in need of more office space.
The meeting was opened for public comment. There was none, so the public hearing was closed
and brought back to the commission.
The commission discussed:
1. It is a perfect fit for that spot.
Jason Mendenhall moved to recommend to the city council approval of the application by West
Care Management, Inc., 3625 Vaughn Street, Pocatello, for a Change of Land Use District from
Limited Residential R -2) to Limited Commercial C -1) to allow office spaces. Property is located
4806 Hawthorne Road. Mary Harker seconded. Roll call vote: DeLoy Stuart, yes; Jason
Mendenhall, yes; Mary Harker, yes; Shawna Elzner, yes; Rodney Burch, yes; Gale Anderson, yes;
Pete Anderson, yes.
2. An application by Darris Ellis, 13560 N. Hawthorne Rd., Pocatello, for a
Preliminary Plat for Park Meadows 9 1h Addition. Property is located east of Philbin
Road and south of Chubbuck Road
Brian Flynn, Rocky Mountain Engineering Survey. This is Park Meadows 9"' addition; they will
extend off of 7 "' and 8 "' addition. There will be 16 lots with two common lots.

The meeting was opened for public hearing. There were no comments so the public hearing was
closed and brought back to the commission for discussion.
The commission discussed:
1. If the water rights for the area are being given to the city
2. The punch list that needs to be completed
3. What had been done on the punch list was discussed with Darris Ellis
Gale Anderson recommend approval of the application by Darris Ellis for a preliminary plat for
Park Meadows 9' Addition. Property is located east of Philbin Road and south of Chubbuck
Road. Jason Mendenhall, seconded. Roll Call vote: DeLoy Stuart, yes; Jason Mendenhall, yes;
Mary Harker, yes; Shawna Elzner, yes; Rodney Burch, yes; Gale Anderson, yes; Pete Anderson,
yes.
3. An application by Darris Ellis, 13560 N. Hawthorne Rd. Pocatello, for a
preliminary Plat for Cambridge Estates I" Addition. Property is located south of
Ellis School, east of Nathan and Taylor Avenue.
Brian Flynn, Rocky Mountain Engineering Survey. This will be an extension of Cambridge V
addition. There will be 16 residential lots and 3 common lots, with an access into Ellis
Elementary and will be zoned R -1. It will be a paved walking path to the school on lot 2.
The meeting was opened for public comment. There was none so the public hearing was closed
and brought back to the commission for discussion.
The commission discussed:
1. The walking path to Ellis School.
2. Lot 1, block 6 are twin homes.
3. If the twin homes on plat are ok because of the clustering of twin homes
4. If a definition of a geographic area is needed.
5. If they satisfied the 10% requirement on twin homes.
6. 40' right of way on the west side of Hiline.
7. Lot 6 of block 1 is a restricted lot and will take a separate deed to the City.
8. Lot 2 can be dedicated to the City.
9. The common lot on lot 4 block 3.
Rodney Burch, moved to recommend to the City Council for approval of preliminary plat by
Darris Ellis for Cambridge Estates V addition, with the conditions included in the staff report
specifically that we obtain 40' right of way on Hiline Road and also an additional requirement of
lot 2 block 1 be dedicated to the City of Chubbuck for access to Ellis Elementary. Deloy Stuart

GENERAL BUSINESS:
4. An application by Terra Firma Properties, Scott Briscoe, 558 West 75 South,
Blackfoot, Idaho for a PUD Final Development Plan.
The commission discussed:
1. May 2 meeting minutes:
2. All parking areas are common access areas
3. Having individual lots
4. Landscape maintenance easement in favor of the Home Owners Association
5. Leaving the lots to stand alone with the requirement that they are commonly maintained.
6. The Association taking care of the parking and reserving the parking lot as an access
7. Defining the common area.
8. Having the home owners maintain the parks and retention area
9. Designation of the open space with the ownership being two park areas and everything outside
of the building for maintenance purposes.
10. The access easement being shown.
11. Discussed on the homeowners association restrictive covenants; items not on the plat. They
need to be added to the plat.
12.The common area disappearing except the two parks
13. The rights to cross all of the properties for maintenance
14. The need to add cross access rights.
Bryce Jolley, of Harper, Leavitt Engineering explained to the commission the plat and restrictive
covenants. They will cover the ditch and put up fence adjacent to properties on the West on
Lucky and on the South. They have taken all of the setbacks from the common area.
Richard Wood, there are no overhangs on the buildings. They will have a Patio; but there will not
be any balconies.
Rodney Burch moved to recommend to the city council the approval of the Final plat, for Terra
Firma LLC for Spring park Residential infill P.U.D with the following conditions:
1. that the areas to be depicted as open space is limited to lot 8 a park and lot 15 a park
2. all yards on individual lots in the exterior is commonly maintained.
3. that rights of access for maintenance in all those areas be depicted on the plat
4. that a specific note granting easements for egress and ingress in the park areas be depicted on
the plat
5. that the developer be willing to participate 50% on a fence if requested by Avalon ownership.

5. Discussion on a proposed ordinance repealing section 18.04.05; adopting chapter 18.06
including definitions for residential rental dwellings; amending section 18.08.040 schedule
of general controls as to residential use.
The commission discussed:
1. Owner - occupied structures
Attorney Tom Holmes will rework the proposed ordinance and bring it back to the
Commission.
