Minutes of the Land Use and Development Commission held at Chubbuck City Office, 5160
Yellowstone, May 2, 2006.
Present: Chairman Pete Anderson; Commission Members: DeLoy Stuart, Shawna Elzner, Mary
Harker, Jason Mendenhall, Rodney Burch. City Staff. Steve Smart, Sean Harris and Larry
Kohntopp; Attorney Tom Holmes and Secretary Myrna Crapo
Chairman Anderson had a conflict with item #6 as they are a current client of his; so he will turn
the meeting over to Jason Mendenhall at that point to handle that item.
Chairman Anderson asked for approval of the minutes of the meeting of April 4, 2006; Jason
Mendenhall moved to approve the minutes as mailed. Mary Harker seconded; all voted in favor.
1. An application by Terra Firma, LLC - Scott Briscoe, 558 W. 75 S. Blackfoot, ID for a
PUD (Preliminary Development Plan). The property is located at approximately 5200
Mesquite. The property is zoned R -2 Limited Residential.
Bryce Jolley, Harper- Leavitt Engineering, P.O. Box 866, Blackfoot, this will be one platted lot
with 3.95 acres. They have proposed 13 four - plex's with garages for each unit. They will have a
privacy fence along the south and west, and plant trees along residential homes. They will have
a park, and a retention area. It will be a home owner association for the mowing, snow removal
and maintenance. Each unit will be sold to an individual and will be rental units.
The meeting was opened for public comment.
John Del Debbio, 5172 Mesquite Drive, he is glad to know that there will be trees for a buffer
zone. He asked if there would be any trees along Mesquite Drive.
Mike Pritchett, 278 James Avenue, he wondered if the fence would go up prior to construction.
He would recommend the fence up prior to the construction to keep the kids out.
Virginia Hale, 5265 Mesquite J107, They want to know if they are liable for any children on
their playground at the clubhouse. They are concerned about the new people using their
playground and club house. They don't have a fence around them.
The commission recommended that the two subdivision get together on the fence.
The public hearing was closed.
Mr. Jolley, they don't mind putting a tree or two along Mesquite Drive and could put that up
before the construction begins. They would be willing to split the cost between them and Avalon
Apartment for a fence. The open space factor will be 50 %.

The public hearing was closed and brought back to the commission.
The commission discussion:
1. Open space calculation is about 50 %.
2. Fencing the individual areas and not making open space.
3. Having one big open space with so many individual owners
4. A reserved easement being put on the plat
5. It will be a common maintenance for all the units.
6. We need something on the plat that shows it is dedicated as.a common space
Deloy Stuart moved to recommend to the city council approval of the application by Terra Firma,
LLC -Scott Briscoe for a PUD. The property is located at 5200 Mesquite with the conditions that
they meet our open space ordinance and all the requirements of the P.U.D. Rodney Burch
seconded. Roll call vote: Deloy Stuart, yes; Shawna Elmer, yes; Mary Harker, yes; Jason
Mendenhall, yes; Rodney Burch, yes; Pete Anderson, yes.
2. An application by Terra Firma, LLC - 558 West 75`" South, Blackfoot, Idaho for a
preliminary plat for Spring Park P.U.D. Subdivision. The property is located
approximately 5200 Mesquite.
Bryce Jolley, there will be 14 lots with 4- Plex's on them. One lot on Mesquite Drive is a park
retention area that will be planted to grass. They will loop the water line and tie it into Avalon
park.
The meeting was opened for public comment. There was none so the public hearing was closed
and brought back to the commission.
The commission discussed
1. The open space needs to be shown on the plat.
Mary Harker moved to recommend to the city council the approval of the application by Terra
Firma, LLC, 558 West 75`' South, Blackfoot, ID for a preliminary plat for Spring Park P.U.D.
Subdivision with the following stipulation; that the P.U.D. requirements be fulfilled and that all
others stipulations as recommended be completed; and a new map be printed with the open space
requirements shown. Deloy Stuart seconded. Roll call vote: Deloy Stuart, yes; Shawna Elmer,
yes; Mary Harker, yes; Jason Mendenhall, yes; Rodney Burch, yes; Pete Anderson, yes.
3. An application by Darns Ellis, 13560 N. Hawthorne Road, for an annexation and
Zone change to PUD (Planned Unit Development) mixture of R -1 and R -2; for Park
Meadows Subdivision. The property is located East of Philbin Road, South of Chubbuck
Road and South of 7`" Addition Park Meadows.

Sean Lynd, Rocky Mountain Engineering. 5.3 acres will be annexed to be used for
residential development.
The meeting was opened for public comment. There was no comment so the public hearing was
closed and brought back to the commission.
The commission discussed:
1. Retention ponds in parks
Rodney Burch moved to recommend to the city council approval of annexation and zone change
to P.U.D. mixture of R -1 and R -2 for Park Meadows Subdivision, application by Darris Ellis,
13560 N. Hawthorne Road. Jason Mendenhall seconded. Roll call vote: Deloy Stuart, yes;
Shawna Elzner, yes; Mary Harker, yes; Jason Mendenhall, yes; Rodney Burch, yes; Pete
Anderson, yes.
4. An application by Darris Ellis, 13560 N. Hawthorne Road, Pocatello, for a
preliminary plat for Park Meadows 8`' addition. Property is locate East of Philbin Road,
South of Chubbuck Road.
Sean Lynd, Rocky Mountain Engineering, 155 S. 2 Pocatello, 16 residential single family
homes with two lots dedicated to storm retention. They will be doing swells. They will tie into
the 7' addition. There will be a 47' wide street for Galena. The swells will be part of the park
system.
The meeting was opened for public comment. There was no public comment so the meeting was
closed and brought back to the commission.
Jason Mendenhall moved to recommend to the City Council approval of the application for
Darns Ellis, 13560 N. Hawthorne Road, Pocatello, for a preliminary plat for Park Meadows 8 d '
addition. Property is located east of Philbin Road South of Chubbuck Road. Deloy Stuart
seconded. Roll call vote: Deloy Stuart, yes; Shawna Elzner, yes; Mary Harker, yes; Jason
Mendenhall, yes; Rodney Burch, yes; Pete Anderson, yes.
Chairman Anderson turned the meeting over to Jason Mendenhall for item number 6.
6. An application by Premier Technology, 170 E. Siphon, Chubbuck, Idaho for a
Preliminary Plat for Northside Plaza, Division I. Property located at the intersection of
Southside Way and Industrial Way.
Bryce Jolley, Harper- Leavitt Engineering, P.O. Box 866, Blackfoot the northeast corner of lots
one and three. They would like to split the 3.68 acres subdivision into three lots with access from
Southside Way and Industry Way. They would extend city sewer and water. Storm water will be
taken care of on site for each lot.

The public hearing was opened. There was no public comment the hearing was closed and
brought back to the commission.
The commission discussed:
1. This will quality as a short plat.
2. 15' easement along the frontage road.
Mary Harker moved to recommend approval of application by Premier Technology, 170 E.
Siphon in Chubbuck, Idaho for a Preliminary Plat for Northside Plaza, Division I. Property
located at the intersection of Southside Way and Industrial Way with recognition of the 15'
easement on the frontage road. Deloy Stuart seconded. Roll call vote: Deloy Stuart, yes; Shawna
Elmer, yes; Mary Harker, yes; Jason Mendenhall, yes; Rodney Burch, yes; Pete Anderson,
abstained.
Jason Mendenhall turned the meeting back to Chairman Pete Anderson.
7. An application by Robert Giesbrecht, 2815 W. 2200 S., Aberdeen, Idaho for change
of Land Use District from Agricultural (A) to Industrial (I). Property is located 4615
/'� Fairgrounds Road.
Gene Hancock, 12367 N. Hawthorne, Pocatello, they want to put in three opened sided buildings
with covered roof for R -V parking. It will be just beyond the cell towers and will back up to the
interstate. It is land locked as far as sewer and water. It will have a chained link fence around
the property. There will be 45 RV stalls.
The meeting was opened for public comment for and against. There was none. It was then
brought back to the commission.
Jason Mendenhall moved to recommend to the city council approval of the application of Robert
Giesbrecht, 2815 W. 2200 S. Aberdeen, Idaho for a change of Land Use District from
Agricultural (A) to Industrial (I). Property is located west of Fairgrounds Road, east of I -15,
south of Bayview Subdivision. Mary Harker, seconded. Roll call vote Deloy Stuart, yes; Shawna
Elmer, yes; Mary Harker, yes; Jason Mendenhall, yes; Rodney Burch, yes; Pete Anderson, yes.
8. An application by Robert Giesbrecht, 2815 W. 2200 S., Aberdeen, Idaho for a
conditional use permit for a combined vehicle storage site /self service storage facility.
Property is located west of Fairgrounds Road, east of I -15, south of Bayview Subdivision.
City staff pointed out self - service storage is an approved use in industrial zone, but the vehicle
storage site requires the conditional use.
Gene Hancock: no other type of storage will be build there it will only be an RV storage site.
The meeting was opened for public comment, for or against. There was none; the public hearing
was closed and brought back to the commission.

The commission discussed:
1. The condition that it hinges upon the approval of the change of land use to Industrial by the
city council before the conditional use goes into effect.
2. Self- Service vehicle storage facility - no other storage except vehicle storage.
Jason Mendenhall moved to approve the application by Robert Giesbrecht, 2815 W. 2200 S.,
Aberdeen for a conditional use permit for a combined vehicle storage site /self service storage
facility. Property is located west of Fairgrounds Road, east of I -15, south of Bayview
Subdivision with the condition that the conditional use permit be approved upon the passage of
the zone change to industrial. Deloy Stuart seconded. Roll call vote: Deloy Stuart, yes; Shawna
Elzner, yes; Mary Harker, yes; Jason Mendenhall, yes; Rodney Burch, yes; Pete Anderson, yes.
9. An application by the City of Chubbuck for annexation of Right -of -way hereto not
annexed. Property located on Hawthorne Road Right -of -Way, northerly, east side,
between James /Hawthorne Rd Intersection and Lariat/Hawthorne Rd. Intersection.
Larry Kohntopp, this is a house keeping issue annexing the easterly portion of the right -of -way
between those two streets. The right -of -way exists already and the canal is part of it. It is mostly
the canal.
The meeting was opened for public comment.
Gayleen Chandler, 5365 Hawthorne asked to have the location clarified for her. So city staff
clarified.
The public hearing was closed and brought back to the commission for comments.
Mary Harker moved to recommend to the city council approval of the application of the City of
Chubbuck for annexation of Right -of -way hereto not annexed for property located on Hawthorne
Road Right -of way, northerly, east side, between James/Hawthorne Rd Intersection and
Lariat/Hawthorne Rd. Intersection. Jason Mendenhall seconded. Roll call vote: Deloy Stuart,
yes; Shawna Elzner, yes; Mary Harker, yes; Jason Mendenhall, yes; Rodney Burch, yes; Pete
Anderson, yes.
Larry Kohntopp passed out some light ordinance papers.
Rodney Burch moved to adjourn at 8:25 PM; with N�ok M41d6phall seconding.
