Minutes of the Land Use and Development Commission held at Chubbuck City Office, 5160
Yellowstone, April 4, 2006.
Present: Chairman Pete Anderson; Commission Members: Rodney Burch, Mary Harker,
Michelle Christy, Gale Anderson, Jason Mendenhall. City Staff: Steve Smart, Sean Harris and
Larry Kohntopp; Attorney Tom Holmes and Secretary Myrna Crapo
Chairman Anderson asked for approval of the minutes of the regular meeting of March 7, 2006;
Mary Harker moved to approve the minutes as prepared. Gayle Anderson seconded; all voted in
favor.
3. An application by Jeff Hawkes 17140 Bernardo Center Drive, Suite 300, San Diego,
California, for a Change of Land Use District from Dense Residential (R -4) to Limited
Commercial (CI) to allow for commercial development with food and retail. Property is
located at 4170 Hawthorne.
Jeff Hawkes, 17140 Bernardo Center Drive, Suite 300, San Diego, California. The property is
south of Home Depot. SHJH LLC owns the property. The concept is a restaurant row and is
poplar in California. They want to create a high end development that will attract high -end
national tenants. It would have four separate pads and include 42,000 square feet.
The commission discussed:
1. The buffer area
2. A walk access for Ridgewind residents.
3. The access road being mall entrance
4. The site will be done as they secure tenants
5. The staff meeting minutes for the meeting held earlier in the day
6. The comprehensive plan designation
The meeting was opened for public comment for or against. There was no public comments so
the public hearing was closed.
Jason Mendenhall moved to recommend to the city council approval of the application by Jeff
Hawkes, 17140 Bernardo Center Drive, Suite 300, San Diego, California for a Change of Land
Use District from Dense Residential (R -4) to Limited Commercial (C -1) to allow for commercial
development with food and retail. Property is located at 4170 Hawthorne. Mary Harker
seconded. Roll call vote: Michelle Christy, yes; Mary Harker, yes; Rodney Burch, yes; Jason
Mendenhall, yes; Gale Anderson, yes; Pete Anderson, yes.
These two items were moved to the end of the public hearings, as no one was in attendance to
represent the application. At that time there still was no one here; so these two items were tabled.

2. An application by Robert Giesbrecht, 2815 W. 2200 S., Aberdeen, Idaho for change
of Land Use District from Agricultural (A) to Industrial (I). Property is located 4615
Fairgrounds Road.
3. An application by Robert Giesbrecht, 2815 W. 2200 S., Aberdeen, Idaho for a
conditional use permit for a combined vehicle storage site /self service storage facility.
Property is located west of Fairgrounds Road, east of I -15, south of Bayview
Subdivision.
Jason Mendenhall moved to table item #1 and #2. Rodney Burch, seconded. All voted in
favor.
GENERAL BUSINESS:
Discussion of a proposed lighting ordinance for the City of Chubbuck - proposed by Kent
Kearns.
The commission discussed:
1. The island park ordinance is not a good ordinance to use for a guideline.
2. It is a technical issues. - how can Chubbuck enforce lighting issues on adjacent parcels.
3. The need to look at going over the city and create various lighting zones. The ordinance could
be simple.
The commission would like to get a copy of Flag Staff, Arizona and Boulder, Colorado.
We will take a look at the different ordinances and see where we need to go from there.
