Present: Chairman Pete Anderson; Commission Members: Gayle Anderson, Jason Mendenhall, Lee Merrill, Michelle Christy, Deloy Stuart, Shawna Elzner, Rodney Burch; City Staff Steve Smart, Larry Kohntopp, Sean Harris; Attorney Tom Holmes and Secretary Myrna Crapo. Chairman Anderson asked for approval of the minutes of regular meeting of January 3, 2006; Jason Mendenhall moved to have the minutes approved as mailed, seconded by Gale Anderson, All voted in favor. PUBLIC HEARING: 1. An application by Phoenix Development, LLC 13560 N. Hawthorne Road, Chubbuck, Idaho, for annexation and zone change to P.U.D. (Planned Unit Development) for Park Meadows 7` addition, contingent upon requested annexation. Property is located south of Galena Street. Mitchell Greer, Rocky Mountain Engineering, 155 S. 2 " Avenue, He explained what they were planing and showed the plat map. The plan will follow the master plan except they will straightened the roads out. The meeting was opened for public comment for or against. There was no public comment. Gerald McNabb, 12973 N. Philbin Road appreciate the support of the commission. The public hearing was closed and brought back to the commission. The commission discussed: 1. Who on the city staff made sure this was the same as the master plan that was previous presented. Rodney Burch moved to recommended approval of the application by Phoenix Development, LLC 13560 N. Hawthorne Road, for annexation and zone change to Planned Unit Development for Park Meadows 7` addition. Property is located south of Galena Street. Lee Merrill seconded. Roll call vote: Gayle Anderson, yes; Deloy Stuart, yes; Jason Mendenhall, yes; Lee Merrill, yes; Shawna Elzner, yes; Michelle Christy, yes; Rodney Burch, yes; Pete Anderson, yes. 2. Property is located south of Galena Street Mitchell Greer, Rocky Mountain Engineering. There will be 16 lots. He showed a drawing of the proposal. The meeting was opened for public comments, there was none so the public hearing was closed and brought back to the commission for comments. Gayle Anderson, moved to recommend to the city council approval of the application by Phoenix Development LLC for a preliminary plat for Park Meadows 7 Addition. The property is located south of Galena; with the condition that staff recommendations be met. Michelle Christy seconded. An application by William Slaven, 147 W. Linden, Chubbuck, Idaho for a conditional use permit for transitional alcohol /drug living and outpatient alcohol /drug counseling. Property is located at 147 W. Linden Avenue William Slaven, 1517 #57 Eastridge, Pocatello, Idaho he wants to open a transitional alcohol / drug living and outpatient alcohol /drug counseling. People will live there 24 hours a day. They will be involved in drug/alcohol counseling. The commission questioned Mr. Slaven about: 1. The type of supervision. There will be eight people who will be supervising themselves with him overseeing it. They will have house rules to following. Alcohol and drug education will be provided for the out patients. A typical patient would work with case manager. He passed out a brochure explained the facility. The residents are free to come and go as they choose. Land Use and Development Commission February 7, 2006 Page 3 Wk Mr. Slaven will not reside in this building. It is a house with a large room for a sleeping area, dining area, laundry facility, it will be a community living environment, males only. The sleeping room is 14'X 25'. They will have a bed and dresser. It gives them a safe environment and they are monitored with rules and curfews. There will not be 24 hour supervision. The people will be screened carefully. He will be in there everyday. They will need to be activity involved in some type of substance abuse treatment. In the future when it becomes a half -way house there will be 24 hours supervision. He will have a locked area for when they need to have personal items locked up. They will have visiting hours on Saturday between 12 pm and 5 pm. All visitation will be monitored. City Staff: The site map that was mailed out should have read Lighthouse for Recovery. The meeting was opened for public comment: Kevin Sutphin, 221 W. Linden, There are a lot of kids on that street and it is a dead -end street. He is concerned about the additional people. Robert Duvill, Assistant manager of Norco, they moved into their property just recently. They have a lot of drugs on the premises that some of these people like to use and it is right over the fence from this place. They could got to their property and then back to this home. The house is pretty small, what will he have to do to make it bigger as the program grows. Carol Reyes, 4710 S. Afton, her parents are retired and live on the street, she is concerned about the people who are going to be there. There are a lot of retired people in the area. Her children can now play outside up and down the street on their bikes. She wouldn't be comfortable in letting them do it after this goes in. She feels safe in that area as it is right now. It's not a good idea. She is concerned about the traffic, what kind of control will they have, if he isn't there and people come to visit them at all hours of the night. Bill Aller, 222 W. Linden, lack of supervision is his main concern. If they are indigent, he is concerned with them taking things from the neighborhood. Bill Slaven: they will all be adults. Some of them will be court ordered to his facility. The commission discussed: 1. The facility will not be locked down at 10 pm. 2. This is the beginning to the middle of their treatment 3. Linden, for a conditional use permit for transitional alcohol /drug living and outpatient alcohol /drug counseling. Property at 147 W. Linden Avenue with the condition that we review it in one year from now and that Mr. Slaven sits down and works with the police chief and cooperated with any thing that our police chief would ask for; also a maximum of 8 full time people with an occasion of 9 people during the transition. An application by Charlie Frasure, 102 Laurel Lane, Chubbuck, Idaho 83202 for a preliminary plat for Frasure Industrial Park 3` Addition. Located on Brook Lane. Jeff Hull, 740 Terry, Inkom, Idaho representing Double H survey. This is a 12 lot addition to the current subdivision, it will finish out Brooke lane and the whole development. The meeting was opened for public comment. There was none; so The meeting was closed and brought back to the commission for a discussion and a motion. Jason Mendenhall moved to recommend to the city council approval of the application by Charlie Frasure, 102 Laurel Lane, Chubbuck, Idaho 83202 for a preliminary plat for Frasure /'*N Industrial Park 3` addition. Located on Brook Lane. Gayle Anderson Seconded. Roll Call vote: Gayle Anderson, yes; Deloy Stuart, yes; Jason Mendenhall, yes; Lee Merrill, yes; Shawna Elzner, yes; Michelle Christy, yes; Rodney Burch, yes; Pete Anderson, yes. 6. An application by the City of Chubbuck to amend Section 18.20.060 to clarify open space used and requirements for residential and nonresidential planned unit developments. The meeting was opened for public comment. Darris Ellis, wanted a better understanding on what was proposed. The commission explained that we have tightened up the requirements of the P.U.D. The main portion of the revision has to do with the open spaces in a P.U.D. It was brought back to the commission for a discussion. Jason Mendenhall moved to recommend to the city council the adoption of the amended ordinance 18.20.060 to clarify open space used and requirements for residential and nonresidential Planned Unit Developments.
