HomeMy WebLinkAbout012-6-05LAND USE AND DEVELOPMENT COMMISSION December 6, 2005 Minutes of the Land Use and Development Commission held at Chubbuck City Office, 5160 Yellowstone, December 6, 2005. Present: Chairman Pete Anderson; Commission Members: Rodney Burch, Jason Mendenhall, Mary Harker, Shawna Elzner, DeLoy Stuart, Gale Anderson, Michelle Christy and Lee Merrill. City Staff. Steve Smart and Larry Kohntopp; Attorney Tom Holmes and Secretary Kathy Christensen. Chairman Anderson asked for approval of the minutes of the regular meeting on November 1 s` ; Mary Harker moved to approve the minutes as mailed. Lee Merrill seconded; all voted in favor. Rodney Burch has a conflict with item #3 and asked to be removed. PUBLIC HEARING ITEMS: An application by Blake Jones, 411 Chesapeake, for a Preliminary Plat for Taylor Made Estates. Property located south of Victorian Village, NW 1/4 of Section 3. Taylor Made Estates Project represented by Rob Heuseveldt, Engineer, Rocky Mountain Engineering, 155 S. 2 " Pocatello, Id. Sewer and water will be connected into Chesapeake Street in Victorian Village. The Land Developer obtained additional property to get a 50' right -of -way that is required at the entrance of the property to provide that standard. The existing land use District is R -2. Proposing this area stays at the same R -2 Residential. Proposing 5 lots. They will be paying for the park area which will be paid at $400 a lot for a total of $2000. Proposed curbing is high back. Ribbon curb was suggested, if that is what the Commission wants, they will do so. Rob states this project meets and surpasses all requirements. Feels it is a good project for everyone involved. No questions from Commission. Steve Smart stated the high back curb has had some negative feedback. It also does not work well with swale. The utility easement shown on the project is only 10' wide and it needs to be 15'. We need to require secondary irrigation with the Fort Hall Irrigation in keeping with recent development requirements. Public Comment: Verlyn Ashton, 5369 Whitaker. He is not disappointed with the project. The developer is planning on using irrigation. He had a question on the park fee. He thought that the fees had been paid previously.. This was platted earlier as a subdivision and currently this is a different subdivision within the original plat, Verlyn questioned if park fees are due again. Ken Funk, 441 Chesapeake, mentioned the engineer stated this could go as R -1. Will it be R -1 instead of R -2? Pete Anderson stated this is zoned R -2, they decided not to request zone change. Wendy Velman, 5157 Whitaker Rd. She feels this is fit for the area and is not opposed to the plans. The public hearing was closed and brought back to the commission for a discussion. Deloy Stuart says it is important that it fits City requirements. Mary Harker asked if twin homes can be built. Pete Anderson said it was not indicated on the plat so they will probably be single family homes. n Jason Mendenhall moved to recommend the city council approve the application by Blake Jones, 411 Chesapeake, for a Preliminary Plat for Taylor Made Estates. Property located south of Victorian Village, NW 1/4 of Section 3 with the condition as outlined by City staff of 1) the 15' easement, ribbon curb, 2) the use of fort hall irrigation water as secondary water supply. Seconded by Gayle Anderson. Roll call vote: Jason Mendenhall, yes; Lee Merrill, yes: Mary Harker, yes; Rodney Burch, yes; Deloy Stuart, yes; Michelle Christy, yes; Shawna Elzner, yes; Gayle Anderson, yes; Pete Anderson, yes. Motion carries and goes to city council next week. 2. An application by B N R, LLC, 4907 Easy Street, Chubbuck, Idaho for a preliminary plat for Sunrise Estates. Property is located west of Petersburg Drive. Jay Roach, 802 E Natalie, Inkom. There is a street stub into the property at Petersburg. There is a gas, water, and sewer available in Petersburg. Continuation of Petersburg should be fine. Preliminary plat consists of 48 lots and 14 acres. Lot sizes exceed minimum lot sizes. He met with Ray and Steve for pre - development conference. Planning to develop in three phases. 1" Phase, deep as we can without going back to sewer. We will resubmit that on final plat. n Deloy Stuart asked what is the potential to construct street or sewer out to Philbin or Chubbuck? Jay answers that the people owning the property are not interested in doing anything now, property cannot be obtained to have an access out to Philbin or Chubbuck. Rodney Burch asked if they are proposing to eliminate the lift station and only do enough in the I' phase that can gravity into the existing line. Jay said this is what is planned. Rodney noted that lot 13 is designated as a storm water retention pond. Steve states the City recommends against that. Swales work much better. City staff comments: Steve draws attention that the city recommends utility easements be bigger than the 10' proposed, and also have the pressure irrigation using fort hall water. The developer requests the park requirement be waived but would need to pay park fees in lieu of dedication. City staff is not interested in sewer lift station for that small of area. Steve recommends City not consider lift stations. Pete asked if there is plenty of depth to get sewer to Philbin or Chubbuck. Steve states that there is either way. Public Comment: Sherm Schmidt, 5148 Leesburg. He represents the neighborhood and is concerned over only one access. He suggests putting a new stub street into Hunter Ave and then have a direct shot out to Philbin. Another suggestion is bringing in East and West streets into the Thompson Property. It would provide secondary access. This could be potential access to Philbin Rd because Ms Thompson is Stuart Nelson's daughter and Stuart is a partner. Any other access might not ever happen because Ruth Johnson has no intention of selling her property. If no access at this time, let's put this on hold until easement comes through Philbin and then build. He feels that other neighborhoods have at least two main entrances. The neighborhood is also concerned about excess construction, traffic flow, concrete trucks, children's safety, and large vehicles. A possible corrective action could be access thru Philbin, speed bumps and higher police patrol. Another concern is schools. There is full capacity in Chubbuck, Tyhee, and Ellis schools. Mark Matson, 5077 Independence, states he is concerned about the traffic issue also. Was originally R -2 and was changed to R -1 by the developer. He would like to have no twin homes or duplexes. Heritage wants to keep with the type of homes that are there now. He had a question on access in and out of subdivision. How many homes are needed for another entrance? Tom Holmes states there is no standard for entrances. Heidi Higashi 4849 Independence is concerned about no other access. She is also concerned about water use because water pressure is not up to where it should. Heidi feels these issues need to be addressed. Matt Shreve 5110 Constitution. He is concerned about traffic. Reiterated traffic problems. W Jay Roach, Natalie, Inkom, responded to public comments. They are not proposing any twin homes. There is that option, but none are purposed. Jay feels the situation for the original access entrance is OK. Other subdivisions have just one entrance. The lot sizes are well above minimum. Brought back to Commission for discussion. Jason Mendenhall asks Steve Smart, how many lots can be built to punch out for sewer on a gravity feed. It all depends on how shallow they want to get. The sewer line is shallow. They can put lift pumps in each home to drain lower levels. It is a developer marketing decision. Lee Merrill would like to see Philbin or Chubbuck access for gravity feed sewer. Attorney says alternative is not to approve lift station, they have to solve sewer problem. Steve Smart says lift stations are a fact of life and necessity. They are expensive, maintenance and operation costs are too high. Lee Merrill asks about a lift station out of each basement. Steve responded that they are very common in some areas.. Steve states the City does not want a lift station for this small subdivision. Shawna Elzner: What about approving a lift station? Who polices the sewer issues? It is the City and the Developer. Rodney Burch, discussion on how many lots can be developed with the sewer. Regarding traffic from Rodney, he would approve with only one entrance. Shawna Elzner asked does city mandate speed bumps? Pete stated the city does not like bumps because of snow removal. Lee Merrill asked if there is any requirement as to how far the sewer line has to be under ground. Steve said three feet. Deloy Stuart moved to recommend the City Counsel approve BNR Development, LLC, 4907 Easy Street, Chubbuck, Idaho, for the preliminary plat for Sunrise Estates. Property located West of Petersburg. with the condition that 1) gravity feed sewer is required to be used, 2) 10' utility easement along frontage be changed to 15', 3) they utilize Fort Hall Irrigation water, 4) the subdivision be developed in compliance with park ordinances. Shawna seconded. Roll call vote, Jason, yes; Lee, no; Mary, yes; Rodney, yes; DeLoy, yes; Michell, no; Shawna, yes; Gayle, no; Pete, yes. An application by Doug Briscoe /Dioptera- Giomatics, 325 Briscoe Road, Chubbuck, Idaho for an annexation and zone change to Limited Residential (R -2). The property is located West of Hiline Road, East of Whitaker Road, North of Vern Road, and South of Cambridge Estates. Tabled at last meeting. Doug Briscoe 2900 Birdie Thompson, Pocatello, apologized for not being here last month. Martha street is outside of city boundaries. The City asked them to annex Martha street into the subdivision. There was discussion on the zoning being R -2 and staying that way with the new plats being R -1. Vern Briscoe, 5112 Whitaker Rd. The covenants and lot sizes are R -1. Future zoning will be R -1. Steve Smart stated Martha just needs to be annexed into the city and zoned. Open up for public comment. Wendy Velman, 5157 Whitaker Rd said she had a question on Phase One being R -1 or R -2. She is not opposed annexing this into City. But one concern Cambridge Estates and Victorian Village are going to have white vinyl fence facing Whitaker? Can this division have it also? Linda Mottishaw 5130 Whitaker Rd, is opposed to having this stay R -2. She thought it was going to be R -1 and is opposed to it staying R -2. n Ken Funk. 441 Chesapeake, wants the development R -1. The developer was allowed to proceed and would in turn do what was necessary to re -zone to R -1. He would like all re -zoned to R -1. Paul Mottishaw, 5130 Whitaker Rd. Does not oppose the annex or Phase 1. Just wants it R -1. Verlyn Ashton, 5269 Whitaker. Vern Briscoe does not want to pay fees to R -1. It is platted that way, why change it? I think it is moot to change to R -1. Rick Keller, 5215 Whitaker Rd, said he is not opposed to annexation. What does it cost to change R -2 to R -1 ? Steve replied several hundred dollars, application fees, and public hearings again. Mary Harker, wanted to clarify the time line involved in changing from an R -2 to an R- 1.Steve Smart say time limit would be set to of Feb or 1 S` part of March. Steve Smart says all new property that is annexed will have to go through an annexation request and re- zoning. Lee Merrill moved to recommend to the City Council that they approve the application by Doug Briscoe /Dioptera- giomatics, 325 Briscoe Rd, Chubbuck, Idaho, for an annexation and zone change to Limited Residential (R -2). The property is located West of Hiline Road, East of Whitaker Road, North of Vern Road, and South of Cambridge Estates. Mary Harker seconds. An ordinance by the City of Clubbuck adding section 18.12.060, "Restrictions in a Limited Commercial (C -1) zone." There was no public comment. No discussion from the commission. Gayle Anderson moved to recommend the City Council adopt the ordinance by the City of Chubbuck adding section 18.12.060; "Restrictions in a Limited Commercial (C -1) zone. Jason seconded. No discussions or question on the motion. Roll call vote, Jason, yes; Lee, yes: Mary, yes; Rodney, yes; DeLoy, yes; Michelle, yes; Shawna, yes; Gayle, yes; Pete, yes. . GENERAL BUSINESS 5. Discussion on proposed lighting ordinance. Tom's letter explains why the proposed ordinance is before the commission. Jason questioned if there is a lighting problem in city. Deloy would like to know where the problem is, why are we addressing this? Larry Kohntopp stated this could be an issue. Feels maybe this is more of a commercial problem. Jason said City Council brought up the fact the round about is not lit up. What is the issue for the lighting. Steve Smart says Kent has a concern somewhere. Attorney says lights shining up may be some concern. Lighting is going on to other residential lots. Mary states that some floods keep light in neighborhoods eyes and houses. Jason sees this ordinance hard to enforce. Lights are hard to enforce and he still wonders what the problem is. Consensus among the LUDC members was that they didn't feel there was a problem and concluded to drop the proposal. 6. Discussion on proposed ordinance - amending section 18.20.060 to clarify open space uses and requirements for residential and nonresidential planned unit developments. Jason Mendenhall had questions on several items in the section. Several items need to be clarified. This will be further discussed at the January /—� Deloy moved to adjourn, Mary seconded.
