HomeMy WebLinkAbout011-1-05LAND USE AND DEVELOPMENT COMMISSION n November 1, 2005 Minutes of the Land Use and Development Commission held at Chubbuck City Office, 5160 Yellowstone, November 1, 2005. Present: Chairman Pete Anderson; Commission Members: Rodney Burch, Jason Mendenhall, Mary Harker, Shawna Elzner, DeLoy Stuart, Gale Anderson; City Staff. Steve Smart and Larry Kohntopp; Attorney Tom Holmes and Secretary Myrna Crapo. Michelle Christy and Lee Merrill were excused. Chairman Anderson asked for approval of the minutes of regular meeting of October 4`" ; and Study Session of October 13"; Jason Mendenhall moved to approve the minutes as mailed, Mary Harker seconded; all voted in favor. Rodney Burch has a conflict with item #1 and asked to be excused. PUBLIC HEARING: 1. An application by BNR Development, LLC, 4907 Easy Street, Chubbuck, Idaho, for a annexation and zone change to Limited Residential (R -2). The property is located west of Petersburg Drive, South of irrigation lateral, north of Chick Bilyeu Property, East of Horse Arena. Jay Roaches, Inkom, Idaho, he is one of three members of the development. The development borders the city of Chubbuck. Single family dwelling units are proposed. They have a stud in street available. They are willing to have an R -1 instead of R -2. Larry Kohntopp: The comprehensive plan shows it as R -2. The meeting was opened for public comment. Ruth Johnson, 13562 W. Tyhee Road, will they be giving up their usage for the Fort Hall irrigation water. Cliff Kelley, 5013 Constitution, he would like to have it as R -1 because the access is going to be through that neighborhood. He would like it zoned the same as the rest of the neighborhood Kelvin Smith, 5140 Constitution they moved to the area because it was a quiet family area. He would like to see it designated as an R -1. Sherman Schmidt, 5148 Leesburg, he is opposed to the R -2. Troy Dye, 5001 Constitution, he would like us to look at the designation in the Comprehensive n Plan and consider changing it; having north of Chubbuck Road being designated as R -1. If we keep it R -2 we need to have a different route for the traffic. Darris Ellis, 912 Sawtooth, discussed the comprehensive plan. Derick Leslie, 5131 Constitution most of the neighbors are not opposed to the subdivision they want to maintain the same setup that is already in that area. With Sunset west the area is set for residential development. There is no shortage of R -2 in the City of Chubbuck. The public hearing was closed and was brought back to the commission for a discussion. The commission discussed: 1. If we could recommend to the council to zone it R -1 Deloy Stuart moved to accept the application by BNR Development, LLC, 4907 East Street, Chubbuck, Idaho for a annexation and zone change to an R -1 which differs from the comprehensive plan. The property is located west of Petersburg Drive. Jason Mendenhall seconded. Roll call vote: Jason Mendenhall, yes; Rodney Burch, yes; Mary Harker, yes; Deloy Stuart, yes; Shawna Elzner, yes; Gale Anderson, no; Pete Anderson, yes. 2. An application by BNR Development, LLC, 4907 Easy Street, Chubbuck, Idaho, for a preliminary Plat for Sunrise Subdivision. The property is located West of Petersburg, South of Irrigation lateral, North of Chick Bilyeu property, East of horse arena. Jay Roach, they asked to withdraw this item from the agenda. 3. An application by Doug Briscoe /Dioptera - Giomatics, 325 Briscoe Road, Chubbuck, Idaho for a annexation and zone change to Limited Residential (R -2). The property is located West of Hiline Road, East of Whitaker Road, North of Vern Road, and South of Cambridge Estates. There was no one in attendance to represent the applicant. Mary Harker moved to table the application by Doug Briscoe Doug Briscoe /Dioptera - Giomatics, 325 Briscoe Road, Chubbuck, Idaho for a Annexation and zone change to Limited Residential (R -2). The property is located West of Hiline Road, East of Whitaker Road, North of Vern Road, and South of Cambridge Estates. Seconded by Shawna Elzner. Roll call vote: Jason Mendenhall, yes; Rodney Burch, yes; Mary Harker, yes; Deloy Stuart, yes; Shawna Elzner, yes; Gale Anderson, yes; Pete Anderson, yes. seconded. 4. An ordinance by the City of Chubbuck amending section 18.12.040(D) to clarify when a trash container must be in a fenced area. So it was closed and brought back to the commission for discussion. Jason Mendenhall moved to recommend to the city council approval of an ordinance by the City of Chubbuck amending section 18.12.040 (D) to clarify when a trash container must be in a fenced area. Discussion on an proposed ordinance restrictions in limited commercial zone; changing the maximum height of a building in an R -2 Limited Residential Zone to 35 feet. Jason Mendenhall moved to take this ordinance for public hearing. Gayle Anderson seconded. All voted in favor. 6. Discussion on the P.U.D. ordinance changes. n Attorney Holmes explained the changes made to the ordinance. This ordinance will be discussed next month. The current PUD infill ordinance will be taken out. The PUD infill will be combined with the PUD Ordinance. It was requested that we give the developers a copy after our next meeting and prior to going to a public hearing.
