HomeMy WebLinkAbout007-5-05n LAND USE AND DEVELOPMENT COMMISSION July 5, 2005 Minutes of the Land Use and Development Commission held at Chubbuck City Office, 5160 Yellowstone, July 5, 2005 Present: Chairman Pete Anderson; Commission Members: Michelle Christy, Mary Harker, DeLoy Stuart, Lee Merrill, Rodney Burch, Jason Mendenhall; City Staff: Larry Kohntopp; Attorney Tom Holmes and Secretary Myrna Crapo. Chairman Anderson asked if any commission member had a conflict of interest with anything on the agenda. Rodney Burch will not be involved in item 5 as he is providing survey services for that item. Chairman Anderson asked for approval of the minutes of June 7, 2005; Jason Mendenhall moved to approve the minutes as mailed, Michelle Christy seconded; all voted in favor. PUBLIC HEARING: 1. An application by Elk Ridge Construction, 451 East Elaine Circle, Inkom, Idaho, for a Change of Land Use District from (R -2), Limited Family Residential to P.U.D. (Planned Unit Development). The property is located behind 5401 Whitaker. Robert Heuseveldt, Rocky Mountain Engineering, 155 S. 2nd Avenue, they will have 30 lots, 28 lots will contain units for 14 twin homes. The remaining two lots will be for open space and recreation area. They will attach the water to Whitaker along Aaron Lane and the sewer from Victorian Village at Chesapeake Avenue. An association will maintain the development. The commission asked: 1. If they would purchase adjoining property to the south in the future. 2. The property will be separated from the existing house. 3. The location of the common area and the amount of land set aside. 4. Fence on the south property line would be considered. 5. The units will be sold 6. The inadequate application. 7. Need to know what the units are going to look like; quality of landscaping is going to be, architectural character, more complete drawing indicating where there is going to be patios, where RV parking will be provided. 8. The recreation area on the east will be .15 acres. 9. They will have a 5' deck on the back Jason Mendenhall moved to table this item until our next meeting so the engineers of this development could bring us back a completed application. Property is located behind 5401 Whitaker. Mary Harker moved to table this motion until the engineers can prepare a complete package for use to consider. Jason Mendenhall seconded. Roll call vote: Michelle Christy, yes; Mary Harker, yes; Jason Mendenhall, yes; Rodney Burch, yes; Lee Merrill, yes; Deloy Stuart, yes; Pete Anderson, yes. 3. An application by Taibrie Weaver/ Alisa Payne, 1732 Dorset, Pocatello, Idaho for a Conditional Use Permit to have a Childcare Center in an R -1, Single Family Residential. Property is located at 680 E. Chubbuck Road. Taibrie Weaver, 11965 N. Rio Vista, and Alisa Payne 1732 Dorset were the applicants. Between the two of them they have 15 years experience. Commission discussed. 1. They have put earnest money on it. 2. They do not plan to live there. 110� 3. They will have circular driveway. 4. They feel a sidewalk is very important. 5. They will close July 8' on the purchase of the property. 6. They plan on eventually have 49 children. 7. When full they would need three additional staff members. 8. Handling of traffic and people dropping off children with the cars spilling into the road. The meeting was opened to the public for testimony: Ranae Worthen, 730 E. Chubbuck Road, there is not enough room to accommodate the traffic. She doesn't want the additional cars in the area. LesLee Stoddard, 780 E. Chubbuck road, she doesn't want a day care there and feels it is inappropriate there. Rosanne Horner, 755 Monika court, she things Chubbuck needs more day cares, but doesn't like the traffic in the area. Cars are parking in the bicycle path. Alfi Freeman, 4914 Pleasant View, they already have a day care in the area. The traffic is a problem. Jeremy Briscoe, 193 Adams, the applicants have been through a lot of work and have a n lot of experience. He thinks it is a great idea. He supports it. n Land Use and Development Commission July 5, 2005 Page 3 n Wendy Velman, 5175 Whitaker, we need more daycares. Chubbuck has been identified as a possible extension for I -15. She doesn't know if it a good place for a child care facility. Taibrie Weaver and Alisa Payne addressed the concerns traffic is not a concern. They would not be able to park in the bicycle lane. If they did they would be warned and then if they continue parking there the child would have to be removed. They choose this house because Chubbuck Road could handle the traffic and they didn't want to put it in a residential neighborhood. The commission discussed: 1. Getting in and out of the driveway is a problem. Chubbuck Road is steep and the driveway is steep 2. The traffic coming down the road creating a problem Lee Merrill moved to deny the application by Ms. Weaver and Ms. Payne, 1732 Dorset, Pocatello, Idaho for a Conditional Use Permit to have a Childcare Center in an R -1, Single Family Residential. Property is located at 680 E. Chubbuck Road; Jason Mendenhall seconded. An application by Charter Builders, 2084 S. Eagle Road, Meridian, Idaho for a preliminary Plat for Afton Meadows Business Park. Property is located at 147 West Chubbuck. Mitchell Greer, Rock Mountain Engineering, 155 S 2nd Avenue this is what the City of Chubbuck requested. They will be doing commercial businesses. They will pipe the canal. They will develop the pad site and the size of the building will be limited by the parking allowed. It will be a Professional style development. It is expected that the units will be sold. The meeting was opened for public comment. Raymond Tracy, 162 W. Chubbuck Road, he is concerned about the zoning with his residence across the street, and wonders if his area would be zoned commercial. Traffic is a concern; the traffic is really busy. He questioned the need for a business park in the area. The public hearing was closed. Mitchell Greer, 155 W. 2 Avenue, the developer is keeping with the vision that the city is requesting as this is a commercial corridor. They have allowed for the widening of Chubbuck and have provided a connection onto Afton on the south. The commission discussed: 1. If Afton road would be wide enough. 1111 2. Roll call vote: Michelle Christy, yes; Mary Harker, yes; Jason Mendenhall, yes; Rodney Burch, yes; Lee Merrill, yes; Deloy Stuart, yes; Pete Anderson, yes. 5.An application by Doug Briscoe, 890 Redman, Chubbuck, Idaho for a Preliminary Plat for Briscoe Addition. Property is located East of Whitaker, West of Hiline, North of Vern and South of Cambridge Estates. Mike Jaylousice, 412 W. Center, Keller Associates, the master plan includes area outside of the city limits. There is 100 lots in the master plan on 32.5 acres. 14,000 sq feet is maximum lot sizes. The smaller lots are 7800 square feet. Future phases will include annexation into the city. The want to have a park that lines up with Cambridge Estate Park. The commission discussed: 1. If they have been in discussion with Cambridge Estates on their park; they have not. 2. Vern street will be complete. n 3. They could put a turning bay onto Hiline 4. Create minimal open space. The meeting was opened for public comment. Paul Mottishaw, 5130 Whitaker, he is concerned about traffic dumping onto Whitaker in a 20 mile zone he wonders if the street can handle that. Verlyn Ashton, 5369 Whitaker, he is concerned for the kids, and the increase in traffic. Carole Hagler, 5059 Marie, she lives two houses from Vern Road. She is concerned with the traffic and the children in the neighborhood and the additional cars. Darris Ellis, 13516 N. Hawthorne Road. He reviewed previous recorded plat maps. Kent Funk, 441 Chesapeake avenue, he questioned the width of the lots along Whitaker. He would like them to consider a fence. He questioned if phase 1 would stand alone; he felt it would be an asset to the community. Wendy Bowman, 5057 Whitaker the traffic on Whitaker Road, she doesn't oppose this project. She is concerned with back yard space. The traffic is a big issue on Whitaker Road. She is concerned about only two accesses for this subdivision. Land Use and Development Commission July 5, 2005 Page 5 The public hearing was closed. Mike Jaylousice they will have a channelized intersection on Whitaker. They will have two accesses into the subdivision. The commission discussed: 1. The concerns of people in the area. 2. Moving the park into phase 1 if it doesn't line up with Cambridge Estates 3. The prior preliminary plats. Deloy Stuart moved to recommend to the city council approval of the application by Doug Briscoe, 890 Redman for a Preliminary Plat for Briscoe Addition phase one, property is located East of Whitaker, West of Hiline, North of Vern with the condition that we make sure that the plats that have been recorded previous have been taken care of. Jason Mendenhall, seconded. Roll call vote: Michelle Christy, yes; Mary Harker, yes; Jason Mendenhall, yes: Rodney Burch, abstained; Lee Merrill, yes; Deloy Stuart, yes; Pete Anderson, yes. 6. An ordinance by the City of Chubbuck amending chapter 16.12 to update the provisions for streets and street construction and to change the right -of -way widths; to amend references to "city engineer" to "city;" to change the length of cul -de -sac streets by setting a design standard and factors to consider rather than a set length. Within chapter 17.12 to update the provisions for plats; to provide a time limit for the validity of final plats if not recorded within two years of council approval. The meeting was opened for public comment: Hal Overdorf, 4535 Burley Drive, he is concerned about Burley Drive being affected. Burnside will be adopted into the Idaho Central Parking Lot. The citizens on Burley Drive were under the understanding that Evans would be brought through to Burley, so it wouldn't be a dead end cul- de -sac. The city told him that Evans won't be put through at this time because of a lack of funds. He reviewed the prior city council minutes; showing the city council had agreed to put Evans through. Gene Aiken, 4528 burley Drive, he has the same concerns as Hal Overdorf. They thought that Evans Lane would be finished. They will be having a lot of traffic going down Burley Drive; including construction traffic. Darris Ellis, 13561 N. Hawthorne Road, it deals with widening the street for cul -d -sacs. He questioned if the new changes would affect subdivisions that are already being build concerning there future phases. What happens to the current master plans. We need to sit down and work out the changes of street widths. Public hearing was closed and brought back to the commission. Land Use and Development Commission r July 5, 2005 Page 6 The commission discussed: 1. Having the ordinance being phased in over 6 months. 2. The City Council needs to make the determination 3. There needs to have some language to give the city flexibility for prior developments 4. The valid points raised by Darns Ellis 5. The need to get the other items on this ordinance approved 6. Would like a study session to see if 100 feet is right Jason Mendenhall move to recommend to the city council approval of the ordinance chapter 16.12 to update the provisions for streets and street construction and to change the right -of -way widths; to amend references to "city engineer" to "city;" to change the length of cul -de -sac streets by setting a design standard and factors to consider rather than a set length. Within chapter 17.12 to update the provisions for plats; to provide a time limit for the validity of final plats if not recorded within two years of council approval; recommend that section C of 16.12.020 under street be exempt from consideration at this time. An ordinance allowing a greater percentage of structures to be allowed in certain zones and establishing procedures to allow such exceptions within a defined geographic n area. The commission discussed: 1. R -1 being reserved for as single family residential 2. Whitaker Road infill 3. Graduation in residential zones for the number of duplex's, etc. allowed Jason Mendenhall made a motion to go to a public hearing for our August meeting. Mary Harker seconded. All voted in favor. 8. Discussion on a proposed study session. The commission discussed: 1. Requests presented to the Land Use Commission that are presented one way and then are different from what was presented when the project is done. 2. Going through ordinances and looking at set - backs. 3. Design review coming back to the land use 4. Needing the building official, Steve, and Larry to the study session We will hold a study session July 19` at 7:00 pm. Jason Mendenhall moved to adjourn at 9:30 pm wits r'1 Myrna Or , Secretary
