STUDY SESSION
July 19, 2005
Minutes of the study session meeting of the Land Use and Development Commission held at
Chubbuck City Offices, 5160 Yellowstone, July 19, 2005.
Present: Chairman Pete Anderson; Commission Members: Mary Harker, Michelle Christy,
DeLoy Stuart, Shawna Elzner, Jason Mendenhall, Rodney Burch; City Staff: Larry Kohntopp and
Steve Smart; Attorney Tom Holmes, and Secretary Myrna Crapo.
Chairman Anderson called the meeting to order at 7:00 pm.
1. Review of Comprehensive Plan Goals
Larry Kohntopp: The Land Use commission represents the public and need to be informed.
We need to take the time to go to the code book -Title 18 of the Land Use Code for reference.
Larry review the goals of the comprehensive plan and encourage Land Use Members to become
acquainted with it. Land use elements in chapter 4 in the comprehensive plan is another area the
Land Use Members need to be familiar with.
Chairman Anderson asked for any constructive criticism.
1. Having the staff report after the applicant does his presentation, it will help clarify some of the
issues that the applicant presents.
/'1 2. Staff educating the applicants about what would happen. If the staff has some leeway to tell
them that it might not go through.
3. Feed back on what the city council does at the next meeting.
4. Copy of the minutes for items that come through the Land Use Commission; especially when
there is a reversal of the Land Use decision so we can understand the reason for the reversal.
2. Additional items, issues and ordinances from the Land Use Commission
1. Discuss the street widths
2. The amount of acreage's we have in the comprehensive plan.
3. Steps for the P. U. D. and review of that ordinance
Larry Kohntopp reviewed the Planned Unit Development (P.U.D.) uses. The commission
discussed P.U.D. on Whitaker Road. They reviewed Meridian and Pocatello ordinances.
The commission discussed:
1. Addressing the goals within the ordinances for what the common spaces are to be used for.
2. Having a check list as part of our application.
3. We need to have more information up front than we are getting now.
4. Having the P.U.D. final come back to the Land Use Commission.
5. Considering different stages in the development
A. Including three phases 1. Concept 2. Design/development phase 3. Construction phase
7. Give design review the right to send it back to the Land Use Commission
/1 8. Having a sign off process by building department, Fire Marshall, etc. before going to Land Use
Commission.
9. If some P.U.D. application should be done as an infill and not as a P.U.D.
10. The Gate City Christian Church being approved by council without doing a conditional use permit.

12. Providing the Design Review with a copy of the land use conditions for a conditional use permit
13. Check list by the land use development commission.
14. Design Review only considers: Traffic Safety, Outdoor advertizing, landscaping, structures and site
layouts, storm water drainage.
15. The Land Use or Council Requirements for conditional use permit being included in the Design
Review packet.
16. The Land Use Commission needs to be able to see the whole picture
The Commission decided to have another session on the P.U.D. Ordinance and putting together a check
list.
Larry Kohntopp was asked to put together a draft of a check list.
The next study session will be August 16`' at 7:00 pm.
