HomeMy WebLinkAbout006-7-05AND USE AND DEVELOPMENT COMMISSION June 7, 2005 Minutes of the Land Use and Development Commission held at Chubbuck City Office, 5160 Yellowstone, June 7, 2005 Present: Chairman Pete Anderson; Commission Members: Gayle Anderson, Lee Merrill, Mary Harker, Rodney Burch, Shawna Elzner, Michelle Christy; City Staff Steve Smart, Larry Kohntopp; Attorney Tom Holmes and Secretary Myrna Crapo. Chairman Anderson asked if any commission member had a conflict of interest with anything on the agenda. There was none. Chairman Anderson asked for approval of the minutes of May 3, 2005; Mary Harker moved to approve the minutes as mailed, Michelle Christy seconded; all voted in favor. Chairman Anderson asked for approval of the minutes of May 31, 2005 work session; Lee Merrill moved to accept the minutes as mailed; Gale Anderson seconded. All voted in favor. PUBLIC HEARING: 1. An application by Dennis & LesLee Stoddard and Ron & Rosanne Horner, 780 E. Chubbuck Road for a change in the comprehensive plan to eliminate the MU, Mixed Use corridor and go back to LDR, Low Density Residential designation from Hiline Road to Chubbuck's most eastern boundary. Chairman Anderson asked for any additional comments from the city staff; they had no additional comments. Dennis Stoddard, 780 E. Chubbuck Road, told the commission that they had collected signatures from the people located off of East Chubbuck Road. Most of the people were in favor of leaving it a residential area. LesLee Stoddard, 780 E. Chubbuck road, they like the area they live in. They want to preserve the residential area. Rosanne Horner, 755 Monika Court, they want the area zoned to LDR, Low Density Residential. They do not want it to be mixed use. Kent Kearns, 4831 Elizabeth, reviewed the comprehensive plan for the commission. He supports the request that it be removed and changed back to low residential. He supports the request by Dennis Stoddard. Mike Buchanan, 4751 Chateau, He wants to change the zoning to R1. Mark Edwards, 779 Monika Court, the new commercial building is in his back yard. It ruined his view of the mountains. He doesn't want any more like it on Chubbuck Road. Alfi Freeman 4914 Pleasant View Drive, they liked the neighborhood. The neighborhood needs to say the way it is zoned. They have worked hard on their property to improve it. She wants it changed to low density. Lora Lee Zimmerly, 4879 Johannasen, They would like consistent aesthetic buildings placed in that area. Land Use and Commission June 7, 2005 Page 2 10� Brent Buck, 887 E. Mountain Park Road, he wants to get rid of the commission members if they don't vote their way. Kent Dayley 5018 Mary Lane, they moved from Pocatello because of a change of zoning in the neighborhood They want the neighborhood to stay the same. Kent Kearns, 4831 Elizabeth, he doesn't support neighbor commercial in existing residential areas. He supports the mixing of commercial in residential areas in new development. We need ordinances to design an architectural review process to decide what is appropriate. Catherine McMurty 700 Brundage, Chubbuck is an arterial road and this is not the time to change the comprehensive plan. Chubbuck Road is a high traffic area. The streets next to it are residential areas. It needs to be business friendly. Laverna Zohner, 701 E. Chubbuck road should not go commercial. She is against freeway entrance on the road. Cheri Edwards, 779 Monika Court wants it to stay residential area. She doesn't want any more businesses. Cathy Hatch, 5119 Tree Valley Road the traffic is really bad now. It will increase the value on the homes for people on East Chubbuck Road, but decrease the value for those homes behind Chubbuck Road. J. D. Simons, 4970 Pleasant View, works for Bob Elzner who is building this building. They have changed these windows because of the people in the area. He supports it. The public hearing was closed and brought back to the commission for a discussion. The commission discussed: 1. The changes of the Comprehensive Plan in the past 2. The areas of the city that are mixed use 3. The changes of business uses in the area 4. R -1 zoning 5. Changes the city needs to make in the process Lee Merrill moved to recommend denial of the application of Dennis & LesLee Stoddard and Ron & Rosanne Horner, 780 E. Chubbuck Road for a change in the comprehensive plan to eliminate the MU, Mixed Use corridor and go back to LDR, Low Density Residential designation for Hiline Road to the most eastern boundary of Chubbuck with the stipulation that there be some tight guide lines on any kind of C -1 conditional use permit given in that area; and that tight guidelines be developed on any C -1 in that area. A conditional use permit application by The Church of Jesus Christ of Latter Day Saints, 1133 Call Creek, Pocatello, Idaho for a conditional Use Permit for a Church. Property is zoned R -1, Single Family Residential. Property is located West of I -15, East of Victory Way, North of Patriot Street. Land Use and Development Commission June 7, 2005 Page 3 Hal Jensen, 1133 Call Creek, they want to leave Patriot as an access to the property There will be a fence across the hammerhead. A third access off of patriot would make it easier to move the traffic. Steve Smart, the city has liability concerns if Patriot Street would be opened. The meeting was opened for public comment. Cathy McMurty, 700 Brundage, she would like to have an access to Patriot Street. The public hearing was closed and brought back to the commission. The commission discussed: 1. Keeping Patriot opened Mary Harker moved to approve the application by The Church of Jesus Christ of Latter Day Saints, 1133 Call Creek, Pocatello, Idaho for a Conditional Use Permit for a church. Property is zoned R1, Single Family Residential. Property is located West of I -15, East of Victory Way, North of Patriot Street with the hammerhead opened. Michelle Christy seconded. An application by the City of Chubbuck to change the comprehensive plan a. to include proposed Homestead Estates Subdivision, The public hearing was opened. Travis Julius, 13519 Moonglow, asked for a clarification on the urban service boundary. Chairman Anderson gave a clarification. Paul Cramer, 575 Homestead, do we want to consider expanding the boundaries. He would like us to deny this until we have developed the ability to handle the water and sewer. Robert Ray, 803 East Mountain Park Road, he questioned why it came back to the Land Use as it had been before the City Council. Bruce Richmond, 690 Homestead, he reviewed the recent study. He is against this piece of property. We need to reserve the capacity for infill areas. Glen Cranor, 617 Dell, our newer subdivisions do not have adequate street parking. He wants to have subdivisions that bring pride into the city. Larry Bald, 5787 W. Portneuf Road, reviewed the history on what had gone on in the past. He is requesting that this 20 acres be included in the sewer. Land Use and Development Commission June 7, 2005 Page 4 Bob Elzner, 207 E. Chubbuck Road, He represented the Building Contractors, they support this. Debbie Wagner, 5359 Hawthorne Road they don't have sewer available for them to hook up to. Joshua Ellis, 188 Mesa, he supports the annexation. The current adjoining residents are wanting to maintain the feel of the area. Theron Driever, 695 Homestead, there are liability issues on Joy if the people in the area has flooded basements with sewer. The public hearing was closed and brought back to staff. Steve Smart, told the commission that right now the sewer could handle this; but there is concern about future development. The Commission discussed: 1. How can we trim the urban service boundary 2. Where growth will take place in the city 3. The need to figure out where the growth will take place Lee Merrill moved to recommend to the city council that we do not change the urban service boundary; Mary Harker seconded. Roll call vote: Rodney Burch, yes; Shawna Elzner, no; Mary Harker, yes; Michelle Christy, yes; Lee Merrill, yes; Gayle Anderson, yes; Pete Anderson, no. b. Eliminate high density (HD) along Quinn Rd. and Hawthorne Road and change to Commercial designation. The public hearing was opened Dale Shook, 4020 Ronald Road, he would like C -1 and C -2 which is allowed before this is considered. He would like to see it remain the same as it is now. Gary Carlsen, 4880 Buffalo Road, he is not in favor of it being zoned commercial. Mixed use would be just fine. Joann Hoffine, 4058 Ronald, she doesn't want it zoned commercial. Bob Rudolph, 950 West Quinn, he opposed the commercial zoning. He would like it to stay residential. The public hearing was closed and brought back to the commission for discussion. The commission discussed: 1. Why we are addressing this Lee Merrill moved to recommend to the city council that the comprehensive plan for this property be changed from High Density Residential to Mixed Use. An ordinance of the City of Chubbuck, Idaho, adding section 18.14.020 (D)(4) to provide any area within the Right of Way shall be landscaped if not covered by pavement, curb, gutter or sidewalk; adding section 18.14.050 to require that any trees removed during development be replaced. Rob Ray, 803 Mountain Park Road, represented the tree committee. They would like any developments that removed trees to replace them. The meeting was opened for public hearing comment; there was none. So it was brought back to the commission for discussion and a motion. The commission discussed; 1. The city having a list of trees 2. The utility friendly trees 3 Within 20' of the back of the sidewalk Mary harker moved to recommend to the City Council that they approve the amended ordinance section 18.14.020 (D) (4) and 18.14.050 concerning the replacement of trees and that such proposal be published with the amended discussion items: appropriate trees from an approved list and 20 feet from the side edge of the sidewalk Michelle Christy seconded. Roll call vote: Rodney Burch, yes; Shawna Elzner, yes; Mary Harker, yes; Michelle Christy, yes; Lee Merrill, yes; Gayle Anderson, yes; Pete Anderson, yes. GENERAL BUSINESS: 5. An ordinance allowing a greater percentage of structures to be allowed in certain zones and establishing procedures to allow such exceptions within a defined geographic area. Mary Harker requested to put this item on the next agenda. 6. An ordinance amending chapter 16.12 to update the provisions for streets and street construction and to change the right -of -way widths; to amend references to "city engineer" to "city;" to change the length of cul -de -sac streets by setting a design standard and factors to consider rather than a set length. Within chapter 17.12 to update the provisions for plats; to provide a time limit for the validity of final plats if nor recorded within two years of council approval. The commission discussed: 1. Change page 4 section 16.12.30 to read current adopted edition Lee Merrill moved to advertize this for a public hearing. Gayle Anderson, seconded. All voted in favor. Steve Smart recommended that this revision be dropped from the agenda The commission discussed if the July 5 meeting would cause any problem.
