HomeMy WebLinkAbout005-3-05LAND USE AND DEVELOPMENT COMMISSION May 3, 2005 Minutes of the regular meeting of the Land Use and Development Commission held at Chubbuck City Offices, 5160 Yellowstone, May 3, 2005. Present: Chairman Pete Anderson; Commission Members: Deloy Stuart, Shawna Elzner, Michelle Christy, Gale Anderson, Jason Mendenhall, Lee Merrill, Mary Harker, City Staff: Steve Smart, Larry Kohntopp, Sean Harris ; Attorney Tom Holmes, and Secretary Myrna Crapo. Acting Chairman Jason Mendenhall asked if anyone had a conflict of interest. There was none. Acting Chairman Jason Mendenhall asked for approval of the minutes of March 24 and April 5, 2005, Lee Merrill moved to approve the minutes as mailed, DeLoy Stuart seconded; all voted in favor. PUBLIC HEARING: Chairman Pete Anderson introduced the public hearing item 1. 1. An application by Blaine Howell, 2908 Sunbeam Rd. #B, American Falls, Idaho, for a Designated Geographic area for cluster twin homes with zero -lot- lines. Property is zoned Limited Residential (R -2). Property is located at 903, 906, 907, 916 Ryan and 910 Stanley, Crestfield Subdivision. Blaine Howell, 2908 Sunbeam, American Falls the property has been an eyesore for several years. They developed one side last year and are now ready to develop the other side. When they looked at the area they decided to do a zero lot line. They wanted to put in nicer homes and that is why they designed their property the way they did. Zero lot lines on the back part, none on the front line. The homes are intended for sale and will be on separate lots. The meeting was opened for public hearing comment. John Boyle, 4891 Cole he is located right behind this property. He doesn't like the looks of the houses and would like to do away with the zero clearance. The public hearing was closed. The commission discussed: 1. What the designated geographic area would contain 2. The location of the multiple family units in the designated area Land Use and Development Commission May 3, 2005 Page 2 Deloy Stuart moved to approve the application by Blaine Howell, 2980 Sunbeam Rd. #B, American Falls, Idaho, for a Designated Geographic area for cluster twin homes with zero -lot- lines. Property is zoned Limited Residential (R -2) at the time. Property is located a 903, 906, 907, 916 Ryan and 910 Stanley, the area includes Boyd on the north, Chubbuck to the south, Cole to the west east, the subdivision lot line between Freedom and Galena. Mary Harker proposed a change in the motion to read the lot line between Alturas Park and Height Subdivision on the back side of houses facing east on Cole. Deloy Stuart accepted the change. Property is zoned Limited Residential (R -2). Property is located at 903, 906, 907, 916 Ryan and 910 Stanley, Crestfield Subdivision. Mr. Howell had no further comments. n Ginger Miller, 924 Ryan, she asked if it is zoned to zero lot lines will they have to stick to the plan that they have shown us or can they change it. John Boyle, 4809 Cole, he wants distance between the twin homes and not clustered homes. Bill Miller, 924 Ryan, that many homes and that many cars in that cul -de -sac are to many. Commission Discussed: 1. Individual owned homes Lee Merrill recommenced to approve the application by Blain Howell, 2908 Sunbeam Rd, #B, American Falls, Idaho for a Conditional Use Permit to cluster Twin Home, with zero- lot -line- structures. Daniel Bull, 3408 West Portneuf, Inkom, Idaho, for a Annexation and zoning Change to Residential Subdivision (R -1). Property is located West of Homestead Road and North of Canal Street. Mayor Cotant called a meeting with Mr. Bull and Rocky Mountain Engineering to express concerns. As a result of that the following changes were made: 1. the park was changed to the east side; 2. preserving Homestead as a minor arterial as required in the comprehensive plan. 3. The street will be wider and striped for three lanes. 4. Every lot that faced Homestead will have circular driveways. Land Use and Development Commission May 3, 2005 Page 3 Mitchell Greer, 155 S. 2 nd avenue, Rocky Mountain Engineering, they are proposing to annex property immediately north of the Height subdivision. It is a 20 acre piece of property and they are requesting R -1 zoning. A study was made to see if the existing facilities could handle this development. It was found that the sewer system could serve this development. Chairman Anderson opened the meeting for public hearing. Don Cotant, 637 Dell Road, he questions the capacity for the sewer line, and the maximum water needs for the area. The area is concerned about water pressure. They have people that do not have sewer access. He does not have sewer access. L. D. Walford, 550 Homestead, they want to know the current zoning of homestead road. They are now classified as a R -1 zone. The commission discussed an R -1 zone. Theron Driever, 695 Homestead, asked why people weren't contacted about the zoning change. He would like to see bigger lots in the area. Debbie Wagner, 5359 Hawthorne, asked about the grandfather rights definition along concerning their acreage. She was informed she could keep their livestock. Don Cotant, 637 Dell Road he wants to know the capacity of the sewer. Bruce Richman, 690 Homestead, he is concerned about the water capacity down the street. He is concerned with the density of the lots and that density going across the rest of the area. He is concerned with traffic control and the rest of the services for the areas. Darns Ellis, 13560 N. Hawthorne Road, they are outside the urban service boundary with this development and according to that boundary there isn't services available. How do we change the Urban Service Boundary and what process does that take. Theron Driever, 695 Homestead, a truck came down Homestead and cleaned out the cities sewer system and filled their house with sewer smells. Chris Seals, 573 Dell asked about the zones of the city. Gary Carlsen, 4880 Buffalo, owns 103 acres west of this property. He has farmed the property for 20 year. Paul Cramer, 575 Homestead, we need to look beyond this annexation it will set a precedence for what will happen in the future. Bruce Richman, 690 Homestead, some of the people he has talked to are concerned with the extra traffic that would be dumped on Cole Road. Land Use and Development May 3, 2005 Page 4 John Boyle, 4891 Cole, he is concerned the traffic that will be generated. There are a lot of kids of that street. The street is not designed for that kind of traffic. He is opposed to it. Glen Cranor, 617 Dell, Why don't we have one study to cover the 120 acres. It puts an added burden on the water and sewer systems. The public hearing was closed. Mitchell Greer, 155 S. 2 " Avenue, Pocatello, Rocky Mountain Engineering, most of the lots are larger than 7,000. The trend with development is that lot sizes have gotten smaller because it is difficult to provide utilities to those areas. Large lots are expensive to develop. They are creating a loop with the traffic and water system. They are only considering this piece of property. Steve Smart - the urban boundary study was done two years ago. The council decided to take the risk and allow this development to go in. Another development has developed being lest dense and the council felt like we could do this 20 acres with little risk. The commission discussed: 1. Everyone will benefit with what will be put in this development. , * -, *N 2. Staff recommended against this Jason Mendenhall move to recommend to the city council denial of the application by M. Daniel Bull, 3408 West Portneuf, Inkom, Idaho, for a Annexation and zoning Change to Residential Subdivision (R -1). Property is located West of Homestead Road and North of Canal Street. An application by M. Daniel Bull, 3408 West Portneuf Road, Pocatello, Idaho, for a Preliminary Plat for Homestead Estate. Property is located at the west end of Homestead. Mitch Greer, Rocky Mountain Engineering, the study indicated that the system can accommodate it. It is a trade off. They took in account the petitions of the residents and met with the mayor. Redesigned the plat. They comply with the minimum lot sizes for an R -1 zoning. Walter Roundtree, 558 Dell Road, the real question is preservation of neighborhood character. What we want for the future of the city. Do we want neighborhoods of different character. He would like a new residential zoning classification that allows a residential character. Paul Cramer, 575 Homestead, they moved in the neighborhood to have that type of neighborhood. Sally Peterson, 570 Homestead, they have people wanting to have their types of homes. They have people stop that want to buy their home. She doesn't want people too close. Land Use and Development May 3, 2005 Page 5 Lori Reynolds, 558 Dell Road, she would like to consider having larger lots with large big shade trees. The public hearing was closed and brought back to the commission. The commission discussed: 1. If people own property they ought to be allowed to develop their ground. 2. It falls within the comprehensive plan. Jason Mendenhall we recommend to the City Council denial of the application by M. Daniel Bull, 3408 West Portneuf Road, Pocatello, Idaho, for a Preliminary Plat for Homestead Estate. Property is located at the west end of Homestead, Michelle Christie seconded. Roll call vote: Deloy Stuart, no; Shawna Elzner, no; Michelle Christy, yes; Lee Merrill, yes; Mary Harker, yes; Gale Anderson, yes; Jason Mendenhall, yes; Pete Anderson, yes. GENERAL BUSINESS: 5. An ordinance eliminating from Title 18 those portions of the ordinances that restrict duplexes and zero lot line residences to ten percent of the units within a defined geographic area. /'\ The past history was discussed. The Heights subdivision had a number of lots that they couldn't sell they build them as duplex's and sold them as R -2. The commission discussed: 1. Leaving an opening for judgements. 2. Using a plat to control it or a conditional use 4. Allowing flexibility with land use and city council 5. Being put on the plat of new subdivisions. 6. The commission felt that the 10% should stay, leave the ordinance the way it is but give the city some flexibility through a conditional use. 7. Controlling through a platting process or conditional use process The commission decided to table this ordinance. 6. An ordinance amending chapter 16.12 to update the provisions for streets and street construction and within chapter 17.12 to update the provisions for plats. Lee Merrill moved to table items 6 and 7, Mary Harker seconded, all voted in favor 7. An ordinance amending various provision with chapter 16.12 to conform the street and right -of -way widths to the master street plan; adding a new chapter 17.24 "Master Street Plan". An ordinance adding section 18.14.020 (D) (4) to provide any area within the right of way shall be landscaped if not covered by pavement, curb, gutter, or sidewalk; adding section 18.14.050 to require that any trees removed during development be replaced. Dave Orthel, 799 Leonidas, Tree Committee Chairman. This will bring continuity to the rest of the codes and bring them in alignment. Mary Harker moved that we address the ordinance adding section 18.14.020 (D) (4) to provide any area within the right of way shall be landscaped if not covered by pavement, curb, gutter, or sidewalk; adding section 18.14.050 to require that any trees removed during development be replaced. Michelle Christy seconded. All voted in favor. The Commission decided to hold a work session for next months meeting and it was scheduled for May 31, at 7:00 pm.
