HomeMy WebLinkAbout004-5-05LAND USE AND DEVELOPMENT COMMISSION April 5, 2005 Minutes of the Land Use and Development Commission held at Chubbuck City Office, 5160 Yellowstone, April 5, 2005. Present: Chairman Pete Anderson; Commission Members: Jason Mendenhall, Gayle Anderson, Lee Merrill, Mary Harker, Rodney Burch, Deloy Stuart; City Staff: Steve Smart, Larry Kohntopp; Attorney Tom Holmes and Secretary Myrna Crapo. Chairman Anderson asked if any commission member had a conflict of interest with anything on the agenda. There was none. Chairman Anderson asked for approval of the minutes of March 1, 2005. Jason Mendenhall moved to approve the minutes as mailed, Gayle Anderson seconded; all voted in favor. PUBLIC HEARING: 1. An application by Charter Builders, 2804 S. Eagle Road, Meridian, Idaho, 83642 for a Change of Land Use District from (C -2), General Commercial to P.U.D. (Planned Unit Development) for 4- Plex's. The property is located at 147 W. Chubbuck Road. Mitch Greer, Rocky Mountain Engineering, 155 S. 2" a Avenue, There will be a foot overhang on all of the buildings, the lots go to the foundation of each structure. They are proposing a stucco exterior and all will have access to the common area. They are being sold as 4- Plex's which will make about 15 owners. The developer has built a couple developments like this in the area. The home owners association will oversee the upkeep of the property. A management company will be set up to maintain the property. The meeting was opened for public comment for and against: Linda Hillman, 5015 Whitaker Road, owns the property west of this development. She asked the commission if there would be fire land between her property and the development? Will her livestock be a problem? Will it interfere with her development or land usage in the future? What type of fencing will they have? Gary Chisum, 4856 Hawthorne, the development doesn't belong on that property. It will take away potential commercial development in that area. It looks like a good layout and would be a nice addition in another part of the city. Dave Pearson, 4525 Mountain Park, he agrees with Gary Chisum. It is a prime commercial block and he doesn't feel like it should be built in a commercial area. John Aller, 222 %2 West Linden, part of his pasture borders this development. Is the proposed set -back adequate for widening of West Chubbuck Road? What kind of screening will there be on the back side of this property? Livestock may cause some problems. With Afton Road being taken through will the developer offset some of that cost? There is now a bottleneck at the bottom of Linden. The public hearing was closed and the applicant was allowed to address the questions that were brought up. Land Use and Development April 5, 2005 Page 2 Mitchell Greer, Rocky Mountain Engineering, there are no plans for a fire lane at this point. Livestock is an issue - people moving in will pose some conflict. They will put a 6' vinyl privacy fence. The south boundary line is the canal; fencing becomes an issue. They are looking at piping the canal and using that area. They will put landscaping along Chubbuck Road. It is commercial ground, but other areas have the same type of projects with residential and commercial together. The residents won't have to drive to get to the businesses. The project wouldn't be a hindrance to other commercial developments. The setback on Chubbuck Road will be what is required by the city. They will do Afton and build a crossing across the canal. Most of the traffic will come out on Chubbuck Road and come down to the light. Some vehicles will head south on Afton. The commission discussed: 1. Completing all at once or in phases. It will be one phase. 2. There will be grass by the canal and what else the canal company will allow them to do. 3. Putting a fence around the three sides. 4. Piping the canal will eliminate the danger of the canal. 5. The city will require an additional 15' right of way. 6. R -4 is permissible in this area. 7. Provisions for handicapped - all the bottom floor will be handicapped accessible. Gary Chisum, 4856 Hawthorne, has four acres on Hawthorne it would fit in and he would be glad 10—*N to sell it to them. Deloy Stuart moved to recommend to the City Council approval of the application of Charter Builders, 2804 S. Eagle, Road, Meridian, Idaho 83642 for a change of Land Use District from (C -2) General Commercial to P.U.D. for 4- Plex's. The property is located at 147 W. Chubbuck Road. An application by Charter Builders, 2804 S. Eagle Road, Meridian, Idaho, 83642 for a Preliminary Plat for Afton Meadows Subdivision. Property is located at 147 W. Chubbuck. Mitchell Greer, Rocky Mountain Surveying, they would be opened to the fencing that would be required by the city. John Aller, 222 '/2 W. Linden the fence needs to be taken a closer look at. They all have a problem controlling their property. Their privacy needs to be taken into account. The fence needs to be chain link - not vinyl. Linda Hillman, 5015 Whitaker Road, the irrigation flows to the east. Allen's take the water from Hillman's and she asked how the water would be taken care of They would like a privacy fence. She doesn't want chair link. Dave Pearson, 4525 Mountain Park, will they have to put landscaping in. Piping the canal is a safety issue. Land Use and Development Commission April 5, 2005 Page 3 Robert Porter, 208 W. Linden - he is on the south end down Afton. He doesn't want the street taken all of the way through. They need a fencing plan. He would like a chain link fence and a fence to block the view. Gary Chisum - 4856 Hawthorne, the long tern effect of absentee owners is a problem. He asked about building height restrictions. Mitch Greer; 155 S. 2 nd Avenue, there will be two fences, the current owners fence and the proposed development fence. The west side would be fenced on their property line. They could fence the south side of the canal line along the property line. They will be a continuos irrigation pipe. There won't be a gape at the one end. The commission discussed: 1. The canal flow is from west to east 2. Three sides need to be fenced in 3. Continuing the canal piping and having it piped in as the property developed Mary Harker moved to recommend approval of the application by Charter Builder, 2804 S. Eagle Road, Meridian, Idaho 83642 for a Preliminary Plat for Afton Meadows Subdivision. Property is located at 147 W. Chubbuck Road with the additional provision that fencing on three sides of the property being indicated as discussed with the addition of an anticipated green way area working with Fort Hall. Fence to at least 6' on the south side; applicable privacy fencing on the west side next to the tanning salon, and on the east side privacy fencing. Lee Merrill seconded. An application by Idaho Central Credit Union for a Preliminary Plat for Idaho Central Campus. Property is located at 4425 Burley Drive. Steve Smart, Public Works Director - We have been meeting with Idaho Central on this property for over a year. They wanted to eliminate Burnside next to the interstate. Evans Lane will be opened up on the east end. They are hoping to construct Burley through to Chubbuck Road and perhaps Linden as well this summer. Bryce Jolley, P.O. Box 866, Blackfoot, Idaho, Idaho Central has purchased houses in the area. There is 8.12 acres on which they will build a new building. A part of Burnside couldn't be vacated because it is the state's property. A bike path and a pedestrian path are planed along the vacated street. The meeting was opened for public comment. Doris Ranstrom, 4418 Burley Drive, asked how the vacates will affect her property value, Her property taxes jumped $500.00 because of the development. She would like to move because of the things that are going on and wants to know what Idaho Central would pay for her property. The public hearing was closed. Ken Orom, Idaho Central Credit Union, 12439 Reservation Road, he showed a picture of the building. The value will go up on Mrs. Ranstrom's property. It will be a four story building. It is a nice development for the City of Chubbuck Jason Mendenhall moved to recommend to the City approval of the application by Idaho Central Credit Union for a Preliminary Plat for Idaho Central Campus. Property is located at 4425 Burley Drive. DeLoy Stuart seconded. Roll call vote: Gayle Anderson, yes; Jason Mendenhall, yes; Mary Harker, yes; Lee Merrill, yes; Rodney Burch, yes; Deloy Stuart, yes; Pete Anderson, yes. 4. An application by Idaho Central Credit Union to vacate the 200 Block of East Burnside Avenue as it adjoins the Idaho Central Credit Union Property. Chairman Anderson asked if there was any public comment. There was no indication of public comment. Commission discussed: 1. The length of the cul -de -sac Deloy Stuart recommended approval of the application by Idaho Central to vacate the 200 block of East Burnside Avenue as it adjoins the Idaho Central Credit Union property. Gayle Anderson seconded. Roll call vote: Gayle Anderson, yes; Jason Mendenhall, yes; Mary Harker, yes; Lee Merrill, yes; Rodney Burch, yes; Deloy Stuart, yes; Pete Anderson, yes. GENERAL BUSINESS: 1. An ordinance amending chapter 16.12 to update the provisions for streets and street construction and within chapter 17.12 to update the provisions for plats. Steve Smart Public Works Director, discussed the fire departments information "Appendix D" from the Fire Code and reviewed different areas of the country requirements for Cul -de -sac. The commission discussed: 1. The land use having control over the cul -de -sac 2. Tie it to a residential development 3. Setting a maximum length of 750' and then coming before the commission (residential use) 4. 75' per lot 5. Commercial cul -de -sac being shorter than residential 6. The maximum lengths maybe limited by the city in considering topography, land use, width of street, volume of traffic. 7. Cit�En Engineer changed to read city S. Changes for mapping system. Attorney Holmes will make changes to the ordinance and present it to the commission for the n May meeting. Land Use and Development Commission April 5, 2005 Page 5 2. An ordinance amending various provisions within chapter 16.12 to conform to the master street plan: adding a new chapter 17.24 "Master Street Plan;" The commission discussed: 1. Documentation along the corridor and the need to preserve the corridor. We would file it and it would create a encumbrance and when the property is sold we would have the right to purchase the corridor 2. The street in the Eagle area being wide and able to handle a lot of traffic 3. We need to contract Canyon County and see what their policy was 4. Change the width by itself Attorney Tom Holmes will do some work on this ordinance and bring it back to the commission. 3. Section 18.08.010 and 18.12.040 this ordinance will be discussed next month.
