LAND USE AND DEVELOPMENT COMMISSION
January 4, 2005
Minutes of the regular meeting of the Land Use and Development Commission held at Chubbuck
City Offices, 5160 Yellowstone, January 4, 2005.
Present: Chairman Pete Anderson; Commission Members: DeLoy Stuart, Michelle Christy,
Shawna Elzner, Mary Harker, Rodney Burch, Jason Mendenhall, Lee Merrill, Gayle Anderson;
City Staff Steve Smart, Larry Kohntopp, and Sean Harris; Attorney Tom Holmes, and Secretary
Myrna Crapo.
Chairman Anderson asked if anyone had a conflict of interest. Rodney Burch stated that he had a
conflict with item number 4 and will step down at that time.
Chairman Anderson asked for approval of the minutes of December 7, 2004. Jason Mendenhall,
moved to approve the minutes as mailed, Gayle Anderson, seconded; all voted in favor.
PUBLIC HEARING:
1. An application by Margaret McNabb, 14053 W. Tyhee Road, Pocatello, Idaho for an
annexation and zone change to Planned Unit Development for residential use with
subordinate commercial uses. Property located south of West Chubbuck Road and West
n of existing Park Meadows Subdivision.
Darris Ellis, 13560 N. Hawthorne, they will put a 6' walk way into the park and lot 8 would be a
continuation of the existing park. This request is a continuation of the master plan.
Chairman Anderson opened the meeting for public comment, for and against the application.
There was none. The public hearing portion was closed was brought back to the commission for
discussion and a motion.
The commission discussed;
1. Access into the park.
Gayle Anderson moved to recommend to the City Council approval of the application by
Margaret McNabb, 14053 W. Tyhee Road, Pocatello, Idaho for an Annexation and zone change
to Planned Unit Development for residential use with subordinate uses. Property is located south
of West Chubbuck Road and North of existing Park Meadows Subdivision. DeLoy Stuart
Seconded. Roll call vote: Michelle Christy, yes; Shawna Elzner, yes; Mary Harker, yes; Rodney

2. An application by Margaret McNabb Family Living Partnership, 14053 W. Tyhee
Road, Pocatello, Idaho for a conditional use permit to construct a church in a residential
subdivision. Property is located at West Chubbuck Road and the future extension of
Independence Street.
Chairman Anderson asked for additional comments from staff. Steve Smart told the
commission that they have been working with Mr. Ellis to change the approach onto Chubbuck
Road to a shared approach west of the property that will be shared by them and other commercial
developments.
Jim Lystrup, 1133 Call Creek Road, Pocatello, Idaho, representing the Church of Jesus
Christ of Latter -Day Saints. The church is looking to build on this piece of property.
The meeting was opened for public comment for or against. There was none. The public
portion was closed and brought back to the commission for discussion and a motion.
Mary Harker moved to recommend to the City Council approval of the application by Margaret
McNabb Family Living Partnership, 14053 W. Tyhee Road, Pocatello, Idaho for a conditional
use permit to construct a church in a residential subdivision on the condition that the approach
from West Chubbuck Road be altered to include the adjoining property of this shared access into
such property. This property is located at West Chubbuck Road and the future extension of
Independence Street; seconded by Lee Merrill. Roll call vote: Michelle Christy, yes; Shawna
Elmer, yes; Mary Harker, yes; Rodney Burch, yes; Jason Mendenhall, yes; Lee Merrill, yes;
DeLoy Stuart, yes; Gayle Anderson, yes; Pete Anderson, yes.
3.An application by Phoenix Development, 13560 N. Hawthorne Road, Pocatello, Idaho
for a Preliminary Plat for Park Meadows Subdivision 6`' Addition. Property is located
south of West Chubbuck, West of Home Run, West of Sawtooth
Chairman Anderson opened this item for public hearing.
Bob Elmer, 207 E. Chubbuck Road, representing the Building Contractors Association of
Southeastern Idaho, the association supports this next phase of park meadows.
The public hearing was closed and brought back to the commission for discussion and a motion.
Jason Mendenhall moved to approved the application by Phoenix Development, 13560 N.
Hawthorne Road, Pocatello, Idaho for a Preliminary Plat for Park Meadows Subdivision 6 "'
addition. Property is located south of West Chubbuck, West of Home Run, North of Sawtooth.
Lee Merrill Seconded. The commission discussed adding the staff recommendations of requiring
a high back curb to the motion. Jason Mendenhall added to his motion the requirement of a high
back curb. Lee Merrill seconded this change to the motion. Roll call vote: Michelle Christy,
yes; Shawna Elmer, yes; Mary Harker, yes; Rodney Burch, yes; Jason Mendenhall, yes; Lee

GENERAL BUSINESS:
4. An application by Rodney & Tami Burch, 333 Briscoe Road, Chubbuck, Idaho for a
Preliminary Plat for Cottage Grove Additions. Property is located at the end of Briscoe
Road and Sample Way
Rodney Burch passed out revised copies of the preliminary plat to the commission. The
commission reviewed the new plat.
The commission discussed:
1. What are we doing with Briscoe Road. Are we doing a bridge across the canal. We are still
showing Briscoe Road as being a minor collector road.
2 Changes on the radius's on Briscoe and Chase Way
3. Cul -de -sac on Lori Lane not being solved. It exceeds the distance.
4. Designated geographic area being designated on the preliminary plat. They could have 4.2
twin homes in the area
Rodney Burch, 333 Briscoe Road, the four issues - 1. the radius on both cul -de -sacs have been
changed. 2. the geographic area is not needed as they are within the amount allowed. 3. a TX
12' piece on Oak Trail is being dedicated for a future road. 4. The length of the cul -de -sac, is
600' in length. It exceeds the ordinance length, but staff can wave that requirement.
The public hearing was opened for the revisions made on the plat.
Steve Christensen, 5357 Lori, they have changed from new manufactured homes to older
manufactures homes in the area of Garden Oaks I` division. This will flow the traffic out of the
area better. He thinks this proposal is the safest for children and doesn't hurt their property
value.
Steve Boll, 5377 Lori Lane, the roadway exists to allow fire truck into the area. The traffic will
not have a straight shot for the residential areas. It seem feasible.
Jay Betters, 5320 Stuart, when Sample Way was put in they were concerned with property values
they have taken care of a lot of concerns. This is the best plan that he has seen.
Bob Elzner, 207 E. Chubbuck Rd. representing the Building Contractor of Southeast Idaho - they
think this is a good proposal.

The commission discussed;
1. What kind of ramifications will we have with the cul -de -sac. It will need to be justified if the
commission accept it.
2. Bending the rule
3. Property value issue.
4. The attorney not being able to defend it
5. Property value is not the ultimate consideration
Rodney Burch, 333 Briscoe, making changes to the cul -de -sac will cost them money.
Lee Merrill moved to recommend to the city council approval of the application by Rodney and
Tami Birch, 333 Briscoe Road, Chubbuck, Idaho for a preliminary plat for Cottage Grove
Addition. Seconded by DeLoy Stuart. Roll Call vote: Michelle Christy, no; Shawna Elzner, yes;
Mary Harker, yes; Jason Mendenhall, no; Lee Merrill s; DeLoy Stuart, yes; Gayle Anderson,
