Minutes of the regular meeting of the Land Use and Development Commission held at Chubbuck
City Offices, 5160 Yellowstone, December 7, 2004.
Present: Chairman Pete Anderson; Commission Members: Shawna Elzner, Mary Harker, Jason
Mendenhall, Gayle Anderson, Lee Merrill, Rodney Burch; City Staff. Steve Smart, Larry
Kohntopp; Attorney Tom Holmes, and Secretary Myrna Crapo.
Chairman Anderson asked for approval of the minutes of October 5, and October 19, 2004. Lee
Merrill moved to approve the minutes as mailed, Gayle Anderson, seconded; all voted in favor.
PUBLIC HEARING:
1. A conditional use permit application by Casey Osterhout, Noyz -toys, 5050
Yellowstone, Chubbuck, Idaho for a Conditional Use Permit for an apartment in the
business building at 5050 Yellowstone. Property is zoned C -2, General Commercial.
Pete Anderson asked city staff if they had any additional comments, they had none.
Casey Osterhout, 5050 Yellowstone, he wants to live in the apartment in back for security
reasons.
The meeting was opened for public comment for or against. There was none. The public hearing
was closed and brought back to the commission for discussion.
The commission discussed:
1. It being used by other occupants
Lee Merrill moved to approve the conditional use permit of Casey Osterhout, Noyz -toyz, 5050
Yellowstone, Chubbuck, Idaho for a conditional use permit for an apartment for business
building at 5050 Yellowstone. Property is zoned C -2, General Commercial, with the condition
that when Mr. Osterhout leaves that residence it no longer has conditional use permit. Jason
Mendenhall seconded. Roll call vote: Shawna Elzner, yes; Mary Harker, yes; Jason Mendenhall,
yes; Gayle Anderson, yes; Lee Merrill, yes; Pete Anderson, yes.
2. An application by Rodney & Tami Burch, 333 Briscoe Road, Chubbuck, Idaho for a
preliminary Plat for Cottage Grove Additions. Property is located at the end of Briscoe
Road and Sample Way.
City staff. Steve Smart is concerned with the smaller cul -de -sac bulbs at intersections. We need
to be able to maintain them without having to backup our vehicles. He wants them to have a 55
foot radius instead of 45 feet. The twin homes construction on 7 or 8 lots will necessitate a
designated geographic area. The proposed cul -de -sac on Lori would exceed the maximum length
in city code.

The commission discussed:
1. This is a buffer area from modular homes and other homes. Garden Oaks is set up for modular
homes.
2. The park location.
3. Stuart name being changed
4. The cul -de -sacs causing problems
5. Park area being adequate
6. The need for geographic area designation
7. Lori Land cul -de -sac problem
Rodney Burch, 333 Briscoe Road, this is an identical layout without the cul -de -sac in the original
application. They are planning to rename the streets, and have changed the location of the park.
It is located 90 degrees from where it was. The cul -de -sac on Lori Lane will help to protect the
homes. It is not their intention to build twin homes, but it needed to be listed on the plat in the
event they decide later to build them.
The meeting was opened for public comment.
Pete Boll, 5377 Lori Lane, they are in favor of the development. Stuart will not be a straight
shot, and that should help with concerns for the welfare of the children in the area.
Andrew Fontana, 5483 Stuart asked some questions concerning the proposed plan.
Darns Ellis, 13560 Hawthorne Road, he wanted to remind the commission that a minor arterial
should be a straight through street. It needs to get traffic out of the subdivision onto the main
arteries. If you set cul -de -sac less than what it is in the ordinance it would set a precedence. The
City needs to be consistent from one developer to another.
The public hearing was closed and brought back to the commission for a discussion.
The commission discussed:
1. Exceptions to cul -de -sac and setting precedence
2. The need to be consistent
3. Designated Geographic Area
4. Land locking Klein's property.
Rodney Burch, 333 Briscoe Road, they could dedicate lot 8R as a roadway into Klein's property.
Dedicating it to the city for future access to Klein's property.
Chairman Anderson outlined the items the commission are concerned with:
1. Issue of access and the lot 8r into Klein's property
2. Defining the center point at where the cul -de -sac is at
3. Length of cul -de -sac off of Lori Lane and how it will be brought back into compliance with
our ordinances.
4. The city staff providing more information about the area surrounding this property as
designated for the twin homes.

Mary Harker proposed to table the item set before us by Rodney & Tami Burch, 333 Briscoe
Road, for the Cottage Grove Addition, Briscoe and Hawthorne, for further consideration A ith the
city staff and for us to then further consider the improvements on the plat now presented to Lis.
Jason Mendenhall seconded. All voted in favor.
Larry Kohntopp mentioned that School District 25 had a location for a proposed elementar\
school near Philbin and West Chubbuck. They want to change the comprehensive plan for that
location. It will be May 9 before we could consider the change.
Jason Mendenhall moved to adjourn at 8:15 pm; Gayle AIderson,, seconded.
